@@StayAlert1 Wow! Thats awesome but where was god when this guy was getting busted in front of his child? Where was god when so many kids are being molested in church? If you are saying god cares about you and finding your car keys or finding out about this story but doesn't care about protecting children in his own churches. I'd say there was a defect in the thinking abilities of us humans.

This is one of the things that people forget and think "It'll never happen to me." Then they get busted and they're screwed. Nick got lucky for sure. Good look putting this info and experience out there for all of the newbies to the community.

EXACTLY! Nick's experience was the perfect storm because he is like most people with a cutter and press at home. and if this happened to him, it could easily happen to anybody else! no matter the size of your operation.

At first, I was like "Why did he pay for a sports logo, when you can find free vector files?" But it was probably a custom design done by the person. To add onto your warning, I work at a print shop, and we have to turn down people who want to print licensed brands. They need a waiver from the license owner, or remove the infringing art. Otherwise, we could be held liable.

it was more so about "buying to protect himself" that was the thought process behind purchasing the vector files. "im paying for the files and not ripping them off google so im doing things correctly" and i agree. i used to work in a reprographics shop as well and we needed proof from the owner to duplicate anything that was copywritten. we used to turn down jobs all the time because we would be held accountable for reproducing something that was copywritten

I seen a few friends doing exactly this and they are selling left and right... glad I checked this video out I will be using my own designs because I can not afford to get busted and pay fines or whatever.. I came so close to buying those svg files for Dodgers logos.. glad I waited.

you wont be gettin that video from me. hahahaa These company's dont license to everybody. it has to be in their favor. thats why companys like New Era and 47 are the main ones who stitch sports teams on hats. if the yankees licensed their logo out to everybody and anybody theyre be some really shitty yankee merch out there hahaha get me?

Usually it’s gonna be a huge upfront fee and possibly a small royalty on top. And like brandoh said they won’t give it to anybody. Like Yankees ain’t gonna let u make shirts out of ur bedroom. U would have to be a bog player that is scaled up like 10,000 units a day type of production

It's been a while since I used Premiere, but I used to cut the audio channel out and save both the audio and (silent) video as separate files. Then I made a new project and combined them back.

Thank you for sharing his story! This is my biggest fear. Putting all my time and effort into opening shop to later having it closed down over some illegal stuff. I see that hiring a graphic designer may be my best bet! How can I make sure a certain word or phrase is not already trademark if I wanted to make a decal out of it?

There's a few factors going into that. One is that it is difficult to definitively track down the seller. In Nick's case, they knew exactly who he was, where he lived, and had hard physical proof of what he was doing. Digital sellers can easily hide behind VPNs, fake or misleading addresses, fake names, etc. Two, many digital sellers are not located in the same country as the trademark/copyright holder which makes finding them nearly impossible and if you are able to find them, the international laws don't have any bite. They can send a cease and desist or a court summons, but the seller can just ignore it with virtually no repercussions, especially if the seller lives in a country that doesn't respect or abide by copyright laws. That is why you see a lot of knockoffs and bootlegs coming from places like Russia and China. Massive companies with a physical and legal presence in other countries, like Disney in China, have an easier time going after those sellers but it is still a big undertaking and they will usually lose more money than they recoup. So they don't go after all sellers, they'll usually go after a few at once, once they are fed up enough to, to serve as an example and warning to others. Disney specifically did something like that on Etsy at the end of 2019 and beginning of 2020. The third and probably biggest aspect is that the marketplaces hosting these products, like Etsy and Ebay, are protected under "garage sale laws". Basically it means you can't sue Etsy because a seller on their site is guilty of stealing artwork or using trademarked images without a license, you can only go after the seller themselves. Since Etsy gets a piece of every sale but assumes none of the legal liability, they really don't do much to police the sellers on their own site because a MASSIVE portion of their sales are from copyright and trademark infringing goods. It isn't in their financial interest. They'll usually monitor it just enough to maintain their brand and image, they don't want to look like Wish or AliExpress, but they also don't want to monitor it so much that they lose money. There's even more to it than that, but all of that makes it easy to get away with selling trademark infringing stuff online and makes it extremely difficult to stop people that sell digital assets.

He's got to have eyes on now, because they have up to 3 years to pursue a lawsuit. The PI probably already did a credit check and background. Sometimes the "Big Guns" will let you go with a "Cease and Desist" letter. However, smaller IP holders (trademark or copyright properties), like individuals will likely follow through with the lawumsuit and the minimum exposure will be $30k once lawyers get involved. Just remember, like said in the video, you have to license intellectual properties to have the right to print or profit from the IP. You will be engaged with the original creator or on large IP, you'll be engaged with their litigation department that handles licensing

Should i start my dba now or wait till the start of the new year like you mentioned in one of your videos. Last You mentioned in this video to not do logos understood, However can you still use the logo colors or is that still considered trademark? Ex. i use colorways all the timeZ but i would stay away from using names like "Lakers" and really stay away from using the word lakers printed i purple and yellow hahahahaa as for your dba i cant answer that for you. thats something you have to figure out for yourself if its time to do that. i dont know how your business is structured. what i can suggest is using proof of concept. meaning prove to yourself that your idea is profitable and worth moving forward with. i got a video explaining this on my channel.

Some brand owners have claimed color as partnof their Trademark and has garnered brand recognition based on the color, like Tiffany Blue...so stay away from colors as well to be on the safe side. Also, using similar words with the team colors could also get you in trouble, so beware.

Ive been stung a few times on etsy and am now on my last warning. What pisses me off is, if I search the same key words as the items Ive had removed for infringements, there are pages and pages and pages and pages of items on there, blatantly ripping off trademarks. All I had was brand names in the title as keywords, not logo usage on the tees. Seems there are rules for some and different rules for others. What can you do huh? I have to be careful. I not have removed all brand names from my listings and will hopefully lay low and be left alone. I didnt even realise that using a name in a listing is trademark infringement.

yeah thats crazy. but you gotta operate at your own risk. gotta remember that these big company's TM their logos and names for a reason. its like if TM'd your name, you did it to protect whats yours and if somebody was makin money off your TM you would want to shut it down asap. be careful out there!

footnote, the concept of using a platform that can arbitrarily shut you down for whatever reasons, makes me nervous. for instance, what if i create an ORIGINAL ( non-trademarked) 👕 shirt with a controversial, (BUT LEGAL) political statement. will etsy ( or some other platform shut me down?)

I've been asked a million times to recreate NFL logo's...it is a hard no...but there is always another decorator out there that will. When the Vikings were in the playoffs...(I know rare) I created Viking SKOL type shirts and did a FREE giveaway. From what I understand as long as I did not sell them I was in the clear. I ran a promotional giveaway with them...got my name out there doing it and in the end, it drove in new customers for things that are legal.

create it on the laptop. you can use any laptop or computer. i use adobe software to create all my designs. photoshop and illustrator

I print for the NBA legitimately and you can’t make copies period. I can’t believe how many people print and sell copyrighted merchandise my advice is just don’t do it. These companies pay people to troll social media sites to look for people who are selling copyrighted material. Great Video Big B

thats right. the temptation is what gets everybody caught up. The mind state of "ohh i can make that logo on my cutter" and then its the "oh i can slang this on the low, i wont get caught up or the police got bigger things to worry about" hahaha Nick is living proof that it dont matter how big or small your operation is, these company's are out to fight for their TM's

I saw a well know KZfaqr during one of his lives using copyrighted material he basically said you can use the images under fair use and that is completely untrue so now you have newbies listening to that garbage and then they get all caught up the best thing is to just don’t do it. As for your friend I’m thinking if it went down like he said they are mighty close to entrapment i think he’ll be ok just don’t do it again

Its a civil matter and not a criminal...nick was just pressured into talking and got scared. If it was a crime then he would have been arrested...the DA could not find nothing to charge him with and has too much going on to mess with a small time operation like nic

yeah thats a tricky situation when you do that! cuz the photographer who shot the pic could own rights to the image and the person in the photograph. So you can face 2 different lawsuits. i seen it happen many times before. always ends in the copyright owners favor.

This is a civil offense, not a criminal offense, that is why nothing happened. You can get sued. That is the only thing that will happen. Tell them to see you in court.

Oh wow, thanks for the info. Would you happen to know if you purchased officially licensed items but put them in something else and explain that the sticker/paper was purchased from a company that was licensed to sale it, is that ok? I made my boyfriend a cup and put a NFL team on it but I got the sticker from a collegiate shop and I got some Disney paper from Joann's and I want to put it on a cup.

i honestly cant answer this because i am not an attorney. So i cant give legal advice. my opinion on your situation is, if you bought the nfl team sticker from a licensed dealer you should be ok. im guessing its like buying a sticker from a store and slappin it on your car. as for the disney paper from joanns it would be the same thing. but this is just my opinion. for better clarification i would seek legal advice. this is just my opinion

yeah that "i got bought it off Etsy" defense is not going to fly in court. but the DA should toss out the case because the private investigator was a punk beeyatch for asking dude to make 40 more. He's obviously no big threat, just a dude making some shirts to support his fam. He should get off with a warning. and everyone in these comments need to see this video as a warning too. Don't reproduce other people's sh$t!! (unless you have lawyer money)

you have to operate at your own risk. i cant tell you how to run your business but if you decided to use pictures that you didnt take of famous people. you can be sued by the photographer that took the picture and be sued by the person in the picture. i've seen people get sued for 1,000 and i've seen people get sued for 100,000+ like i said you have to operate at your own risk. if somebody took your photo put it on a shirt and made $4million off of your face. wouldnt you want a piece of that $4mil?

Appreciate the insight man! I've always wondered if you can take parts of a logo but alter or add design to it to make it your own. Or what about like if you created a piece of artwork of Michael Jordan but didn't use the Bulls logo and left the 23, I wonder if you could get away with it because of artist interpretation. Crazy story though, I thought most just get slapped with a cease and desist just to start and if you keep going they go this far.

The LA on this hat isnt a TM'd logo. so in this case, wouldnt get in trouble. Big difference between this LA and the dodgers LA logo. but you have to operate at your own risk. im not an attorney so i cant give legal advice on what can get you in trouble. i would suggest speaking with a trademark lawyer for better clarification.

any heat press will work. i use this press because of the build quality and slide out drawer. its easier to lay the shirt down and place the transfer down when your not working directly under the heat

from what ive seen... they get hit double. the photographer who shot the pic and the artists estate can go after whoever is using that persons face. i've seen it happen a few times before. pretty crazy and alot of money involved too.

Legally, reproducing another person's Intellectual Property, which could be a Trademark or Copyright, is against the law. Often people make one for themself and someone likes it and before you know it, you're in business. It's best to not even make one for yourself. Now using the Disney paper from JoAnn's requires you to check the fine print. Moreso than not, it is licensed for personal use, upon purchase. But check the Terms of Use or in the product description.

If i put a picture of you on a shirt and lets say i made like 10 Million off that shirt. wouldnt you want a piece of that money? since it is your face on the shirt. you gotta operate at your own risk in this business, if you feel like you could get in trouble for doin somethin like that, theres a big chance you might run into trouble. or seek real legal advice from an attorney. just to be safe

yes they do have copyrights. if you didnt take the photo. you are infringing on that photographers image. im a photographer by day and i can tell you that, people get sued DAILY for taking images and printing them. and if you are selling those images.... Game Over!!! i've personally seen somebody take an image and made prints but only sold 4 of those prints. and got sued for $110k from the photographer. in every digital image there is something called metadata. that has all the info on when the photo was shot, on what camera with what lens, if the gps is on it'll say where it was shot and who shot that photograph. thats where the copyright lives. not just on the watermark. its embedded in the photo.

If its a copy paste with a small change it is still infringement. You can create your own inspired by the logo and you'll be fine. As long as you are the artist creating the image then that is your intellectual property. You just cant straight up trace someone elses work.

This basically boils down to intent. If it even SEEMS like your intention was to copy or bootleg the Raiders logo, then it won't matter that you changed it slightly. You will still get a cease and desist or just be flat out sued. Their logo, their team name, even their colors used in conjunction with each other are all trademarked and copyrighted on some level. Using any element of that can be infringement. The only way to get away with this is if you change the logo to be an obvious parody or satirical commentary, and you were in no way trying to pass it off as Raiders merch and no reasonable person could possibly think it was Raiders merch. An example of this would be the Caucasians logo parody that designer Brian Kirby made of the Cleveland Indians Chief Wahoo mascot (which itself is now being stolen and sold on places like Etsy). Even though that was obviously an original artistic parody and protected under the first amendment, Kirby still had vague threats of legal action for infringement and for "damaging" the reputation of the Cleveland Indians. Luckily he was never sued, but the only reason is probably because it was so high profile, obviously a parody, and the intent was clearly parody. The most important thing to keep in mind is, even if you think you aren't doing anything illegal or you know you could win in a lawsuit, you still have to have all of the time, energy, and tens, if not hundreds, of thousands of dollars it would take to fight a billionaire industry like the NFL. Whether or not you win, your business and finances could be destroyed. It's simple risk vs gain. You could gain a few dollars, but you're risking a fortune, your livelihood, and your reputation. It's not worth it. Read Fright Rags story about the legal action Universal brought against them in the early days for using the Frankenstein image.

I've seen cases prosecuted and won based on likelihood of confusion. I would suggest that you not just tweak one or two things because if the average consumer could make the connection to the brand that you are drawing your inspiration from then you could be sued.

Entrapment will usually refer to a buyer, like a john being solicited in a prostitution sting. They can argue that they didn't think of or pursue the criminal activity, they were passive and the criminal activity came to them and was pushed onto them. Now if Nick were making all original shirts and they approached him asking, "Hey! Can you make me some LA Lakers shirts?", or if they implied that they held the trademark and were outsourcing production to him, then that could be entrapment. But in this case he had already created these shirts, offered them up for sale, sold a few, and committed the crime. They were just buying the illegal goods that he was already making and selling for the purposes of proving that he was already engaged in this, so that wouldn't constitute entrapment.

Did you get a warning? I got an email from etsy about 3 of my listings that they deactivated. I went ahead and deactivated the rest of my listings with that design by myself so it wouldn't happen again. I wasn't sure if it was something like 3 strikes and you're out
