Ive been homeless before when I was 17 years old. This happened when the adults I lived with who were drug addicts, didnt pay rent even though I contributed for eight months. They also stole my hidden money of $20 that I set aside for myself to get around on public transport to look for work. I left the home without money and a bag of clothes. I made it by going to services to support me until I got on my feet again. Be proactive, be honest and stop being a victim. Shit happens.

Eviction case was frustrating. Didn't seem like the complainant was going after damages or unpaid rent, and STILL couldn't evict them! Also, it was telling, when he mentioned legal aid and hedged on moving out at the end of the month, they have no intention of leaving on their own, and are just stalling for time. And they are doing this while claiming to not pay rent because the place is in poor condition. Just another example of the courts letting freeloader tenants abuse landlords.

The server my first divorce attorney used sucked azz. My ex had a precise work and day off schedule that never changed in 16 yrs. Server charged for every attempt. I told the attorney I will serve him. No no don't do that. For other reasons I fired first attorney and hired a competent one who's server had 99% success rate. First attempt was successfull

I sure hope the landlord did not pay that attorney. He should have prepped her for this. Those people are pukes and the judge did a horrible thing here. This makes me furious.

Judge Middleton is continually soft on tenants and I can no longer watch those cases in his court. You can't pay me to be a landlord.

I love when attorneys and parties both say “I don’t mean to interrupt you judge” as they clearly interrupt the judge. Depending on the statement or the context, some judges may disregard chastising the person for their “outburst” but I always find that comical lol

I'm laughing about the kool-aid bar code trick, I thought of that 15-20 years ago when self check out became a thing, first began to see them, to extrapolate, my idea was to fold it small, exposing just the bar code pressed into your palm, a sleight of hand so to speak, never did it but I consider the idea a real been there done that kind of thing, move on or stop, kids today, so dumb....

So the fake process server defendant’s charges are awful. Made me sick when I looked them up. I had to pick my chin up off the ground. Capital one is the least of his concerns. 😩

I work in healthcare security and have been summonsed many times. The first time, I think I caught the process server off guard by how nice and polite I was. I told her next time to just call me and I'll meet her in town rather than her having to drive most of the way across the county to get to my house.

31:44 well. It’s simple. If he is gonna spend 3 days trying to stay in this place, she’s gonna spend those 3 days getting her chit together to justify the eviction for court. Then it’ll be 10 days. Then it hits their record. Then they’ll never be able to rent a place again. I’ll bet he fights her on it after speaking with legal aid. He’s too foolish to know better

Some process servers are the worst. I got a voicemail from another Kent Harris. I thought to myself, if another Kent Harris is calling me, this can't be good! I called him up and he said he got a subpoena to show up in Federal Court on a Civil matter. I asked him what the subpoena said and he read it to me. I replied "Yep, that is my subpoena you were served with." I drove by his office a couple of hours later and he was happy to give me the subpoena!

I worked at a pediatric dental office in an upscale area, and some of the wildest kiddos (=coloring on the walls and tables) belonged to rich people who refused to control them. Those with modest means, in general, were more thoughtful.

In landlord tenant proceedings the pleadings are jurisdictional. If you don’t follow the rules the court cannot evict someone. It’s a thing I exploited many times as a legal aide attorney.

exactly. and for good reason. i’ve defended more than a few tenants with sloppy landlords/slumlords. I don’t feel any sympathy for a landlord not doing what they’re supposed to do procedurally. also, since when would it ever be enough to say the tenant is “killing the vibe” of the neighborhood to terminate a tenancy? goofy ass take from mike.

Maybe someone can help me understand….if the tenants haven’t paid rent since September, and it’s now April, why does the damages matter?

Because they're not being evicted for not paying the rent, they're being evicted for breach of the tenancy agreement, which will include a term like "Do not cause a nuisance to other residents". The landlord will be able to bring a separate action to recover the unpaid rent and any damage to the trailer after they're evicted, but this action is just to get them out.

It’s really disturbing to hear how common process servers seem to lie about personally serving someone with an action. The fact that you can be defaulted into a judgement of eviction or significant monetary damages based on not appearing for something you had no idea existed just shouldn’t ever happen. I hope that person gets a significant sanction from Judge Middleton.

because he’s sloppier than her. she never filed for an eviction *due to nonpayment* - just eviction due to some other lease violations (vague allegation of property damage). there are specific procedures you absolutely have to follow to do that. she didn’t do it. she then had months to either amend or refile, but sat on it. she had a lawyer who could have also amended or refiled, but also sat on it.

she didn’t file to evict them for nonpayment of rent. that’s on the landlord. too bad so sad. she could have amended her action months ago to make it include nonpayment but she didn’t. that’s on her and I don’t feel remotely sorry for her.

That seems so childish, not your opinion, the law in general. I dont claim to know the first thing about all the legalities. But I do like to feel that I know a thing or two about commonsense. Imagine it with another type of property. Like I loan you my spare car for a few months and when it's time to return it, I'm shit out of luck cause you just want to keep it and have no respect for the fact that I worked hard and earned it. That's when the law fails and people are forced to take other actions that may seem mean and illegal .. but sometimes the law forces your hand to do certain things. And I'm sure there are people that don't agree with that either😆 I guess that's the great thing about everyone being able to share there opinions, as long as you don't act on them

@@brayjill but that’s not at all the same. primarily, the right to have shelter is a necessity, having a car is not (even if it’s extremely burdensome to get around without one). that’s why the law around tenant rights is the way it is, and has requirements beyond straight contract law. this is also something landlords *know* before they start lamdlording. regardless, your comparison is not an appropriate one. for one, there is typically no court process necessary to repo a car. by the terms of most financing contracts, you don’t have the sole property interest in the car. the finance company effectively owns it (i’m being overly simplistic, but that’s the crux of it) and automatically has a right to repo it if the car owner defaults. conversely, landlord/tenant law forbids a similar situation with eviction, and you can’t contract around it. you *have to* go through the courts to recoup rental property unless the tenant voluntarily agrees to leave. more importantly, I didn’t say the landlord has no recourse for nonpayment. they absolutely do. they just need to comply with the procedural requirements. there are distinctions between eviction proceedings for nonpayment of rent and eviction proceedings for other lease violations. this landlord did not even remotely come close to complying with those procedures. if they wanted to proceed on the nonpayment basis, which would have been an easier route, they could have included that in their filing. they could have amended this one or just re-filed. instead, they let this case set for 4-5 months without doing that. instead, they proceeded in other lease violations. they can’t just tack on the nonpayment issue when it’s time for the evidentiary hearing. they also need to plead their lease violation with particularity and come to court with sufficient proof of violation. they failed to do that as well. I don’t feel sorry for landlords. they are aware that they have certain duties as landlords that may feel lopsided compared to tenant obligations. i’m glad those obligations exist and are appropriately enforced.

The property manager appears to have an issue with the family. But has not provided any proof of damages, no dates or times, no witnesses. If I'm the judge, I'm saying, pay up to what you owe the property owner and move out at the end of the month. Done.

if i’m the judge, i’m dismissing the case outright and saying they can refile correctly if they want to use the court to get these people out. then if tenant moves out by the end of the month anyway, it’s effectively moot. also, he can’t do anything about nonpayment of rent since that was never even before the court.
