FYI: Qualified Immunity was created by the Supreme Court to shied police who were breaking the law. There is no other western democracy that has qualified immunity. In fact, the United States has only had qualified immunity for about 60 years. Abolishing Qualified Immunity would increase police accountability and, without writing an essay on the subject, would be a good thing for the profession of policing and society.

RE: The two guys in the parking lot, the cop clearly wants the complainant to say that he feared for his physical safety. He should just ask him outright, "Did you fear for your physical safety?" I would do a quick canvas for security cameras. My initial thought is that when all is said and done, both parties are getting arrested.

I don't know the whole story behind the video, But I would be willing to bet that the guy wouldn't have touched his gun if the cop wasn't trying to harass him. If he was threatening somebody with it or brandishing it you know doing something against the law. Then by all means to protect citizens from this guy please stop him but tell me what's the problem with open carrying a firearm? should everybody be harassed for it?

This all goes back to Terry vs Ohio. Officer safety is more important than constitutional rights. Oh and I forgot to mention the officer gets to decide when he feels in danger and just about anything goes.

We are actually big advocates against how Terry v Ohio is implemented. Actual reasonable suspicion should be established prior to an exertion of authority or qualified immunity shouldn't be allied to officer actions. In this instance, the suspect had, just prior to this incident, pulled said pepperball gun on another person and fled. Given that's all the officers knew prior to contact (bright yellow jacket, hat, and gun) this was pretty reasonable suspicion. Said individual then producing what was believed by the victim (not the cops) to be a real firearm, I think this was actually a best case scenario for the suspect in this instance. He was treated WAY better than Roger Fortson who was actually innocent of any wrong doing.

Though I actually believe all gun laws should be abolished, I do believe pulling a gun (or what looks like a gun) and threatening people without due curse should be illegal. The stopped individual did pull his pepper ball gun on someone prior to contact with the police and they were sent to detain him as part of that investigation. I am happy to see people taking a hardliner 2A stance, but I think it's unwise regardless to pull anything weapon looking on anyone if you value your safety

The call was not about simply carrying the gun, the call was about pointing said gun at people and threatening to shoot them. I believe they didn't stutter when they said "shall not be infringed", but I'll never excuse threats to anyone's safety, cop or not.

Or what about the one that had the cane for blind people in his pocket and was harassed by the cops because it was a weapon. There are hundreds and hundreds and hundreds and hundreds of videos out here of ignorant a$$ cops acting ignorant is hell. You guys are improperly trained on the escalating situations or not jumping to conclusions and on properly handling yourselves when somebody gets belligerent. You are conflating specific instances of police misconduct with this unrelated call in question. If these aforementioned incidents we would be calling for lawsuits and charges against the cops with actual legal teeth. In this specific call, the individual in question threatened people with the fake gun he produced to the officers and fled the scene prior to this bodycam. He wasn't guilty of having a gun, he was guilty of aggravated assault and or deadly conduct, hence he was very lucky both the victim wasn't actually exercising their God given right, and that police didn't use more force when presented with a person producing a weapon.

Same place as the phrase “expectation of privacy”: in case law. If you’re looking for the court case, it’s Terry v. Ohio. Since I know you won’t actually read it, here’s the relevant text from the decision: “We merely hold today that where a police officer observes unusual conduct which leads him reasonably to conclude in light of his experience that criminal activity may be afoot and that the persons with whom he is dealing may be armed and presently dangerous, where in the course of investigating this behavior he identifies himself as a policeman and makes reasonable inquiries, and where nothing in the initial stages of the encounter serves to dispel his reasonable fear for his own or others' safety, he is entitled for the protection of himself and others in the area to conduct a carefully limited search of the outer clothing of such persons in an attempt to discover weapons which might be used to assault him. [392 U.S. 1, 31] Such a search is a reasonable search under the Fourth Amendment, and any weapons seized may properly be introduced in evidence against the person from whom they were taken.” From Justice Black’s concurring opinion: “I would affirm this conviction for what I believe to be the same reasons the Court relies on. I would, however, make explicit what I think is implicit in affirmance on [392 U.S. 1, 34] the present facts. Officer McFadden's right to interrupt Terry's freedom of movement and invade his privacy arose only because circumstances warranted forcing an encounter with Terry in an effort to prevent or investigate a crime. Once that forced encounter was justified, however, the officer's right to take suitable measures for his own safety followed automatically.” From Justice Douglas’ dissent: “The infringement on personal liberty of any "seizure" of a person can only be "reasonable" under the Fourth Amendment if we require the police to possess "probable cause" before they seize him. Only that line draws a meaningful distinction between an officer's mere inkling and the presence of facts within the officer's personal knowledge which would convince a reasonable man that the person seized has committed, is committing, or is about to commit a particular crime. "In dealing with probable cause, . . . as the very name implies, we deal with probabilities. These are not technical; they are the factual and practical considerations of everyday life on which reasonable and prudent men, not legal technicians, act." Brinegar v. United States, 338 U.S. 160, 175 . To give the police greater power than a magistrate is to take a long step down the totalitarian path. Perhaps such a step is desirable to cope with modern forms of lawlessness. But if it is taken, it should be the deliberate choice of the people through a constitutional amendment.” In this particular case this guy fit the description of a man who threatened to shoot two people and pointed what looked like a gun, and he verbally admits to being involved in that confrontation (probable cause). Under the top standard a frisk is super reasonable before he admits, under the dissent it’s reasonable after so 🤷🏻‍♂️.

The RCMP is Canada's federal police force, so they take conduct of any federal issues such as organized crime, terrorism, security for the prime minister/parliament hill (Canada's "white house"), etc etc. Canadian provinces have the option to maintain their own provincial police force (think State Police), or they can contract with the RCMP, who will act as their provincial police service on the province's dime with some of the costs subsidized by the federal government. Several provinces do maintain their own provincial services, including Ontario, Quebec, and Newfoundland & Labrador. Cities/Municipalities within a province also have that option, they can maintain their own police service or contract with the provincial police service (whether that be a standalone provincial police force or the RCMP). Provincial and Municipal RCMP generally have a full complement of services just as any standalone Municipal or provincial force would, like patrol members and specialized resources like community policing, traffic, forensics, investigators, gang units, dogs, tactical units, etc etc. So as an RCMP member, you could be posted to anything from general duties (patrol) in a small city, all the way up to doing federal drug interdiction. It's a very diverse organization for sure 😂

If you're not locking the handcuffs, you're doing it wrong. Not locking the handcuffs can result in nerve damage and in some cases it's even led to amputations. It would be awesome if you guys could do a video that takes a deep dive into the subject of handcuffs. I don't think anyone has ever done an informative video on handcuffs.

NONE of this would’ve happened if they didn’t come in being hostile literally IMMEDIATELY. He had soooo much of a right to be terrified, even if they DIDNT END UP KILLING HIM. Almost anyone would be terrified by 10 guns pointed at them, not just someone going through a mental health episode. They literally pulled their guns out seconds after arriving, knowing damn well he couldn’t do ANYTHING to them with a knife when he’s 30 feet away in a car. In my opinion, none of this is justifiable.
