Here is a quick breakdown of the laws surrounding magazines and some answers to specific questions you all might have after Judge Benitez's ruling earlier this year. My hope is to make this information as quick and concise as I can for you all. A lot has changed this year in regards to magazines. I will continue to update as further developments occur. But the whole point of a government was to organize the people. Instead of blaming one side or the other, both should work together to come to a middle ground. Some states have restrictive or dumb gun laws, but other states have incredibly weak gun laws and should really themselves up a little bit.

CRPA NRA-ILA FPC etc have sued and the cases are all tied up in court. Tales toms of money to fight these laws in coirt so make sure to donate to them to support these cases

California is a very sore loser. If they're losing a court case like to procrastinate it or have the court "stay the case" basically have the court case wait and wait and wait... which makes it very difficult to fight

I called 8 Sheriffs departments starting with Ventura because they illegally seized two mens constitutional week magazines. The departments tyrants all say we don’t know about any document sent out and we don’t know about or honor any of the supreme courts decision on the magazine week stay of judgement. They all play games when I called and each department gave a somewhat different denial of of being true!!! I asked what I do if I am driving into that county and want to make sure I am okay first... they kept hanging up on me. California is overtaken by the enemy from the socialist infiltration within

Yea I was born and raised here, then lived in Pa for a few years. Reluctantly moved back for work. It was hard to stomach moving back and having to deal with all these laws again!

@@ArmedScholar My impression, perhaps wrong, is that central California counties have been slow to adopt the Socialist Dream of disarming Citizens as represented by the majority party Governors, State Senate and Assembly. Still, it has to be a shock to leave, regain US Constitutional Rights, and then come back to Peoples Republik of Kaulifornia and lose them all over again. Thanks for your scholarship!

here in Canada we are restricted by law to 5 rounds rifle, or 10 rounds pistol.....with some overlap where you can legally use a pistol mag for .223 in your AR giving you 10 rounds legally. So my 20 round mags are pinned to 5. If you were to buy a Glock 17 it's mags would be pinned to 10. (3 gun looks really strange with 5 round mags) ...that aside, I am sure glad we do not have all the other assorted weirdness legislators come up with....although there are politicians up here who want to have an outright ban on the AR.

A few years ago we got a small catalog called Budk. In it I saw a WWI replica trench knife, with built in brass knuckles. I just thought it looked cool, but then noticed in small print, “no ship to CA”. Looking through more items some were marked restricted mostly to CA, NY, and a few other democrat controlled areas. I had no idea lawmakers have been removing items we could purchase for years...quietly and insidiously.

Glad to hear you participated in freedom week! We have a 15 round mag capacity ban here in Colorado which is why Magpul packed up and left. You can still buy standard 30+ mags here though. When you buy the mags they open up the package and remove the spring then put it all back in the package. Then you're buying "parts kits" and not mags lol. Good video as usual!

"Shall not be infringed", means just that. All carrying and ownership of arms restricted by any state is breaking the supreme law of the land. California is clearly committing a crime, not the citizens living in California. Stop giving the courts or the legislators the impression they can make illegal laws or affirm those illegal laws. Time to say no more. Stop being violated.

Duncan v. Becerra is currently in the 9th Circuit court of appeals and is the lawsuit that gave us "Freedom Week". The appellate oral arguments are scheduled to begin 4/2/2020. Seems like everyone is missing the fact that you cannot put one of these large cap mag in a mag locked rifle or it will be considered an AR. These can only be used in a featureless or registered AR.

Go featureless. Get a stock stop, get a fin grip, and a thread protector or muzzle device of your choosing. (Excluding flash hiders.)

I appreciate your videos. I’ve been told that you can only using standard capacity AR mags if the AR is featureless. If it’s fixed mag or mag locked then you aren’t allowed to use them. I’ve looked on the DOJ website but haven’t found anything about this. Do you know if it’s true?

Thanks for taking the time to present this info. I think you can clean it up by just presenting a timeline of what (PC)32310 a/b is, what happened from 3/29/2019 - 4/5/2019 (aka freedom week), and what CA citizens are allowed to do NOW in terms of of firearm magazines that hold more than 10 rounds. The bigger question that nobody seems to want to publicly answer is how does anyone discern WHEN a particular magazine was purchased? I think freedom week essentially opened the door for citizens to possess higher capacity magazines. Again, thanks for putting this out there.

Thanks for the feed back. Yea this one was a little harder to edit so that information would get conveyed correctly. As far as the question you posed, it has not been answered primarily because this is a new area of law and we don't have any court deaccessions or cases for that matter dealing with this. Therefore, this is a big grey area. My inclination would be that as part of the prosecutors meeting his or her burden of proof they would subpoena credit card documents, company records, etc., to determine when and from where you obtained the magazines. I think anyone would be in a bad spot if they don't have an express record demonstrating where and when the magazine was purchased. As we all know, most CA judges are not kind on these issues.

Thanks so much for the vid man. So helpful. The thing that gets me as a military member stationed, how would they know whether it was purchased during freedom week or not. I have the ability to buy extended mags from out of state from some vendors who are not as familiar with CA gun laws, but I do not want to take the chance of having to deal with legal violations. If I say I bought in freedom weekend wouldn't that theoretically be a good response?

Thanks for having the idea to make the video. There are a couple problems... at 1:20 you mention "possession" in regards to parts a) and b) which is incorrect, and central to this whole shindig. Parts c) and d) are the ban on possession that was enacted recently, not merely a discussion of penalties. Also, VERY IMPORTANT TO NOTE: when 32310 parts c) and d) were added, PC 32420 was repealed. This was the exemption to the importation ban for those in lawful possession who left the state with their magazines and came back in. Judge Benitez's ruling did not address this, and the stay on his decision regarding 32310 part a) means that it is a misdemeanor to leave the state with an LCM and return with it, regardless of whether you bought it during freedom week or you've had it since before 2000 when PC 32310 was originally written. (note: when Senate Bill 23 in 1999 was passed, 32310 and 32420 were sections 12020(a)(2) and 12020(b)(23) respectively, they renumbered everything a few years down the road.)

I am no law professor or licensed attorney, but I would add one caveat; when carrying large capacity mags and clips, not only should you carry the DOJ printout, but I would encourage you to also carry a copy of the actual receipt for the specific high cap mags & clips you purchased to... if stopped and questioned, you should be able to mitigate some of the risks of having them confiscated before you can show proof of your purchase. This is no guarantee from having them confiscated, but it is a vital barrier that may tilt the scales in your favor should you encounter such a problem by law enforcement. It is better to have your documents in hand rather than having your possession(s) taken from you and for you to later have to go out of your way to prove your rights to own them - of course, I merely mean that this advice goes for Californians, where we are at the most risk at risk of having our freedoms violated by these egregious laws.

In Canada we pin down our standard/large capacity magazines to the legal limit. Do u guys do that as well since passing that law or they r just gonna sell smaller capacity ones?

I'll be traveling to Texas from California by flight in February and will be bringing my firearm as i'm licensed to carry there as well. Am I able to take my standard capacity magazines with me to Texas, or will it be considered "importing" upon my flight back to CA?

Am I allowed to lawfully bring to California full capacity magazines that I purchased out of state? And, am I allowed to attach a full capacity mag on a featureless AR, regardless of when I purchased the full cap mag? Thanks.

I live in Las Vegas, but was stationed in san diego for 14 years in Navy. what has me curious is why arent all of these clearly unconstitutional gun restrictions challenged all the way to the supreme court by now? What are all the lawyers waiting for? I always carried guns while in san diego, but never got caught. Living in Las vegas is like paradise for gun owners. It is such a shame that californians have to put up with all that horse shit.

Yes if they were legally purchased during freedom week or were purchased before the 2000 ban and grandfathered in.

Can the micro stamping law be circumvented if the handgun is manufactured in California? I noticed it bans imports. Does it ban locally manufactured in state as well?

Not sure you answered this question, if I have a featureless AW type gun. Can Hi cap mag be used? The AWB law states 10 rounds.

I got a question, I’m hoping you can answer it. I’m active duty stationed in Pensacola, FL. I purchased a Springfield Hellcat and I have orders to move to California in December. My hellcat has a 13 and 11 round magazine, with current California law, can I get in trouble with law enforcement by having this gun/magazine? Thanks for your time

From what I understand you can't use them in maglocked firearms because a standard cap magazine is a feature itself. Is that correct?

Is it legal for a Ca citizen to use the “freedom week” possessed 30 round mag in an AR that is fully featured with fixed mag? I heard you can only use them in a featureless AR and not fixed mag.

See Penal Code12276.1 (a) Notwithstanding Section 12276, "assault weapon" shall also mean any of the following: 1. A semiautomatic, centerfire rifle that has the capacity to accept a detachable magazine and any one of the following: A. A pistol grip that protrudes conspicuously beneath the action of the weapon. B. A thumbhole stock. C. A folding or telescoping stock. D. A grenade launcher or flare launcher. E. A flash suppressor. F. A forward pistol grip. 2. A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds.
