The plaintiff says he hired the defendant to install nine new windows in his house, and he put down a 50% deposit. A year later, the job still wasn’t done. He’s suing for his money back. The defendant claims the windows were delivered in December, but it was too cold to install them.

This judge is good. The defendant thought he could get one over her not happening. She caught him shifting the blame. Good decision judge!!

That defendant should be ashamed of himself. Legit tried to steal that guys 2 grand. It's a shame that she couldn't order him to pay more. Plaintiff did everything right. Defendant broke his own contract, did 0% of the work, then kept the guy's money anyways. Too bad they can't press charges on that stuff because they have no reason not to do it over and over to other people. It's straight up theft.

depends on the size of the windows. As someone who built windows for the past 8 years, windows get sent back all the time for various reasons and do get trashed, however he will try and salvage as much as he can but if it is such an odd size, the whole thing will be thrown out.

I live in Canada. We had new windows installed two Februarys ago. It was minus 20 degrees Celsius outside. Winter doesn’t shut down an entire industry unless you are looking for excuses to not do your job.

The defendant fired his installer, when it was never his fault, perhaps we will be seeing that case when the ex employee sue him for unfair dismissal and defamation... ha ha ha

Defendant breached his own contract and tried to blame the Plaintiff...The case was pretty much cut and dry when JM read that statement of start date of 60 days......

I'm sorry but it drives me insane in cases like this Harvey always says at the end make sure you write "time is of the essence" when half the time, like this time, it doesn't apply to the case at all. The defendant went way over his contracted time to do the project, so writing that wouldn't have made any difference! I swear he doesn't pay attention to a lot of these cases, he just gets a general idea of what it's about and picks one of the 3 lines he always says to what he thinks matches best with the case.

The defendant is clearly out of gas here because he changed the arrangements of the agreement. The plantiff didn't get what he payed for. I believe this was one of the rare times I agree with the ruling.
