US Appellate Judge Frank Easterbrook reversed an injunction on enforcement of the Illinois Assault Weapons Ban putting the law into effect. What was a legal purchase yesterday became illegal today.
Aren't judges supposed to protect our rights? Tell me what you think.

Ban Assault weapons like New Jersey. New Jersey is one of the states with the least gun violence in the nation. No reason for weapons of war made to kill people to be available to the public. America already had 185 mass shootings. Trampling the rights of citizens? Regulate guns not uteruses.

185 mass shootings is a bogus statistic with no useful legitimacy. It is not the propagandized "mass shootings" we think of, and most often is accounting for domestic or gang violence. The places that "track" these are motivated to keep the definition as broad as possible to inflate stats, and the overwhelming majority of them are done with handguns.

but it can still be changed =/ infringed. Laws are rules - rules are defined. IF the consensus is for a change and change is done within rules set up for it to be done transparently - it is up to the people, correct?

@@mikehannigan848 but you forgo that all there is are interpretations of what amendments "mean" - ergo - how are they to be applied in real life. That is not infringing - that is called law-making; as I mentioned previously - in light of text of 2nd amendment, notion that having access to weapons is a right is also extrapolated from interpretation - local militias can be armed - there is no text stating that all individuals have a right to have guns at all times, nor that it is not a privilege.

hey the same side that wants to grab the guns, seems to be fine with assisted suicide maybe they can get them certified as medical equipment to assist with that... i could see how a slug administered with high velocity cures all their ailments forever, or 2, in the back of the head, just like those soviet suicides. even if it doesn't fly, i want to see someone argue in court on how many grains and velocity is required to ensure a clean deletion.

What pisses me off about certain judges is their irrationality. My brother was pulling himself over with high blood sugar from type one diabetes, but until he got himself to the side of the road he was a danger to other drivers. He remembers the police being right there when he stopped the car, and the cop telling him he almost hit the police vehicle. He remembers agreeing to blow the blood alcohol thing, all as he told them his blood sugar was high and he needed medical attention. He remembers them telling him they would get him medical help, but he would have to be handcuffed and transported in the back of the police vehicle. The next thing he remembers is waking up in the emergency room, hearing the police arguing with the doctor who was refusing to provide a blood alcohol level _because_ if you give a drunk insulin, he's a drunk with low blood sugar, but if you give a diabetic insulin, he doesn't seem drunk any more because he isn't drunk. But the police wanted it anyway and they weren't pleased. They then took him back to the jail for "observation." They released him to our aged, terminally ill mother in the middle of the night, telling him they weren't charging him with anything. Weeks later he got notice that he was charged with drunk driving and had to appear in court with a lawyer. He went to a former high school classmate who turned our to be useless but agreed to take $7,000 to pretend to represent him. The lawyer refused to review the hospital records because the judge assigned to the case doesn't consider medical information, she only takes the testimony of police. Mind you, our other brother is retired law enforcement. He's the youngest. We aren't anti-cop, only anti-bad cop, and there are some truly bad, lying sobs on our local police force. But this judge favors the bad cops even over the good ones. When he got to court was the first my diabetic brother found out that he blew ridiculously high on the breath thing at the jail, _before_ he got medical treatment. His endocrinologist _appeared_ at the hearing to testify, but the judge wouldn't _let_ him. She's a stinking "tough on crime" wacko who goes after disabled and challenged people who suffer medical emergencies, and the cops and lawyers enable her. This disease is going to eventually kill my brother, and his health is declining anyway, as it's become harder for him to control his sugar levels. He uses an insulin pump, and he's tried a few different ones, but they all malfunction in one way or another. He's still working because he's had so much sickness that he basically has to work, and now with this false drunk driving expense he's even further in the hole. He won't get justice because the system here is corrupted to the core.

This was written about the boob judge.. So it was no small matter when Albert W. Alschuler, himself a highly respected law professor, wrote in a law review, “Judge Easterbrook persistently presents wildly inaccurate, made-up statements as unquestionable statements of fact,” adding, “The truth is not in him.”

I had the fortune to meet one of the appellate judges in Chicago when I was a kid. He was born in 1905 and was a far different breed than the purely political animals we see today. I worry about the world we will leave to our children and grandchildren.

The problem is I don't expect this to get any better in the near future. Most lawyers and law students have been raised in academic indoctrination for the past couple of decades. Gonna be a while before this kind of BS is rooted out, and even then we've gotta put our foots down as American citizens and start holding these judges accountable for rulings that effect law abiding citizens while these judges enjoy their cozy lives in ivory towers

That's really optimistic to assume it ever will be rooted out (trust me, I hope to God you're right that it is)...but people who value individual rights and hate authoritarianism aren't doing the things that the commies spent decades doing to get where we are. We don't have a grass roots, long march through the institutions that would be necessary to change the tide.

The supreme courts inaction on important issues is the main thing I find frustrating about judges. In a more general sense I feel like they hold jury's hostage to the point where the judge might as well declare they are the finder of fact and not the jury. It is controversial, but if judges are going to play activist they have no right having a problem with jury nullification being explained.

If a Judge becomes Active, he is no longer being fair, unbias, and upholding the law Equally. If a Judge has become an 'Activist', it should be IMMEDIATELY and HEAVILY Investigated. And if found true, should immediately be Disbarred, lose all powers, rights, and privileges of working in governmental sector, banned from ever working in, or for anyone in, government ever again, and get thrown in jail for 20 years immediately with no chance of parole, bail, pleading down, or settlement to get out of the crime. Judges should be held to the HIGHEST POSSIBLE STANDARD that exist, and punish HARSHLY and BRUTALLY in the most EVIL and LIFE DESTROYING ways possible to FORCE them to live up to those high standards OR ELSE.

Colorado just barely missed having just about every semi-automatic firearm in the state declared illegal, fortunately the politician pushing it is better at annoying and alienating just about everyone around her including her own party that she couldn't get it pushed through. Sadly other gun control laws made it through and of course our twisted pretzel of a Governor signed them. Not really surprised at this out of a judge in Illinois. I'll never live there but occasionally have to travel through the place and I try to never spend any money there while passing through. Fortunately I already transported all of my 'assault weapons' through there to their final storage locations some years ago so there's no chance a random traffic stop will get them seized from my legal possession.

That, despite GVR'ing Miller v. Bonta back to Judge Benitez's court to rule in light of Bruen, the 9th will STILL stay the ruling, and then rule against freedom in spite of Bruen. This is the fucked up game we play in California. A right delayed is a right denied.

What pisses me off is that more legislatures don't haul judges before them for a please explain, and impeach them, or force them through a recall. If they are going to use spurious legal theory or deliberately misreading/applying law they have written, or blatantly bad judgements, the judges should face appropriate sanctions given the judiciary seems unwilling to actually patrol its own. Or in the case of higher federal courts, and even the supreme court, if the state is involved and really unhappy with the decision (eg judge throws moot, laches, or any other bullshit), statement that they don't see the ruling as valid and the judge is risking unity of the union by not doing their job, it will be reheard or action in the legislature and from representatives will force them to rehear it. Too often people just throw their hands up and go "independent judiciary, can't do shit john", no, there are three branches and two of them have the ability to hold each other, and the third to account.

I grew up in a nice city in Illinois through the 80s and 90s. Besides the humid summers, I consider it an idealic childhood. I left for college, and shortly thereafter I started hearing about how Chicago has gradually been ruining my city. My parents moved from the state after they lost hope for the politics. It's a shame.

Antonin Scalia was a big fan of Easterbrook. Scalia was asked if he could choose his replacement on the bench who would he pick. With almost no hesitation he said. Frank Easterbrook.

Far too many of the judges in America seem more crooked that the criminals they do or most recently do not put behind bars…. Yes, that is what PISSES ME OFF! Its all about the money, and power, not about right and wrong.

Whoever keeps picking judges for confirmation is a big part of the problem. Per Barnes, it's the Federalist Society, or is one of the orgs that our corrupt politicians turn to for names. Like that affirmative hire Katanji Brown who thinks child porn is less porn-like if shared electronically and can't define what a woman is, while being a woman. Barnes has some great observs on the entire subject of our court system and the two of you should do a collab on it.

Kind of glad Easterbrook pulled this tomfoolery. Now it will get appealed to SCOTUS and it will be a nationwide reversal of all "AWB" and high cap mag bans. Packing 10 round mags at the range is really fucking annoying and I'd also like to change my muzzle attachment which is pinned because NJ is stupid.
