The problem with the death penalty is not the legal justification, the state's authority to kill, or some sort of injustice. the problem with the death penalty is that it's administered by the state and the state is garbage.
Let's talk a bit about Richard Glossip and why his story is so critical to death penalty discussions.

I use to think the death penalty was a good thing but stopped that thinking since knowing that you can’t trust the government to do anything right. I don’t trust them period

Thomas Sowell makes a pretty good argument in his book Knowledge and Decisions. The threat of the death penalty can be an effective deterrent, but it has to be done properly and efficiently. Our justice system needs massive reform to achieve that.

I’m a life imprisonment guy, but the prisons need to be like the Count of Monte Cristo. Get rid of these soft “prisons” with tv, internet, conjugal visits, etc.

Ironic given Dumas’ inspiration for The Count of Monte Cristo genuinely being based on a real man who was framed, life destroyed, and wrongly imprisoned for life. At least Dantes escaped and got revenge on his illegal perpetrators and received redemption. Unlike our corrupted system and individuals who prove again and again to either be utterly incompetent and/or malicious and do not cherish the fragility of life

Everyone who was waiting on pins and needles during the Rittenhouse trial should be against the death penalty; how many called that unjust and corrupt cannot see that it happens to people everyday in this country?

If a prosecutor fails to disclose evidence and a person is later released, they should go on trial and face serving the same amount of time that person was in for.

More like they don't get a trial and automatically serve at least double the time. Hell, life. That is a ridiculous level of criminal behavior and most likely malevolence and it's absurd there is no check on this kind of thing in our society. It's the sort of thing that should have people outright rebelling against the system until it's put into place.

Of course not but until the actual problem is solved are you willing to let the government be able to execute potentially innocent people? And the other issue is if it’ll ever be fixed because humans are fundamentally flawed and corruptable beings.

Death Penalty isn’t the problem. The problem is corrupt DA’s, judges, and the methods used for death penalty. Firing squad / hanging should be the only forms of execution allowed.

I’m with you Nick. I’m for it if we know beyond a reasonable doubt the person did it but I don’t trust the state to get it right or perform their duties ethically.

A compromise: Dual citizenship is treason as a politician/official (yada yada Logan, Hatch), officials are eligible for death penalty, elected officials can plead for 5 years manual labor in regimented/indentured manner.

I am fundamentally opposed to the death penalty for one simple reason: our courts aren't perfect. There are already way too many people who get wrongfully incarcerated, and I do not like the idea of those people potentially getting the death penalty. If you are alive, at least you have a chance to get out later if whatever verdict you have is overturned. If you're dead, that chance is gone. The government also faces no accountability for wrongfully incarcerating and/or executing citizens, and as such I will never agree with a death penalty.

Law student from Europe here, the idea that there is a way for the government to legally kill people is just insane. We are post socialist country, lot of people were executed in the 50s for political reasons. Their guilt was also proven 'beyond any reasonable doubt'. Once there is a way, it's not about if there will he a slip, but when. It's better to 1000 people serving life sentence than to execute one innocent person. Death penalty is connected ho high emotions. And the law should not be based on emotions.

@@ElysV135 The idea that the death penalty is connected to high emotions is asinine. Sometimes it is, and sometimes prosecutors get overzealous. But there couldn't be a less emotional verdict than death. A life for a life is the perfect example of "justice." If your argument is that you do not believe the State is responsible enough to trust with that decision, then that is understandable. But there is no question that is morally sound.

@@troyboy811 Here in Europe our criminal law is built on some principles. One of them is principle of humanity. The law has evolved, we no longer seek 'eye for an eye'. That is a natural emotional reaction - to seek vengence. Criminal law should not be about vengence. You can't undo death penalty. Also by death penalty you are not only punishing the perpetrator, but also his family. That should not be the case. Families should not suffer. Two wrongs do not make something right. By committing a crime perpetrator denied his humanity, but that does not mean society should do the same.

I like the idea of jail/prison when proven beyond a reasonable doubt, and execution when incontrovertibly and absolutely proven. I do not trust any government though.

Big reason I'm against the death penalty. Due process is an eternal right. The state will always make mistakes, or just be garbage. There are vindictive people that will lie. All these factors have to weigh in. It's always easy for dudes to say, "Death Penalty for all ______"... Until, they're the one being denied due process because the state is garbage and/or someone lied.

@@humvee2800 we shouldn't wage war. If we held the leaders who start the wars accountable for the innocent lives lost, then we would see a lot less wars. If someone is a threat to society then they should be in jail and not released until it is determined they are no longer a threat.

There is always a cost in innocent lives to every policy. So then, you either have to accept that innocent people are a currency to spend, or that the government should be abolished. Now, I don't believe in abolishing all government as a new one will just take the old ones place, and like a hydra be even worse still, so...

If we are to have the death penalty, we must have a minimum standard of evidence and not be 100% reliant on the jury. At least have non-circumstantial concrete evidence be a MUST.

Yeah I'm with you in concept but in practice even that's messy. Someone killed your girlfriend after you left her house that night? Well your DNA was found inside her and under her fingernails. That's concrete physical evidence. Or a family of 4 was brutally attacked but one of the victims survived and picked you out of a lineup. They are 100% sure it was you and gave very convincing testimony in court, pointing right at you and saying "I watched him kill my brother". But they were mistaken and your Defense attorney's attempt to illustrate that just came off as you sending your lawyer to victimize your victim yet again. So as much as I'd love to have a world where the truly guilty are taken out behind the courthouse after the verdict and save the expense and burden of paying for their appeals and food/shelter/medicine, a lot of times it seems we are stuck with having to warehouse scumbags forever and only occasionally get small "victories" when we manage to free an innocent person after forcing them to live in the scumbag warehouse for a decade or more.

I'm in favor of doing away with the death penalty if we bring back corporal punishment with the understanding that is neither cruel nor unusual. You wouldn't have to create ludicrous prison sentences or accept prison as crimina community college if a bunch of sentences included repeated horse-whipping. As a taking, the state can be forced to compensate you for any sentence - time, fines, or corporal punishment - in proportion to make you whole. But there's no adequate compensation for a wrongful execution.

The trouble with getting rid of the death penalty is that life sentences are just very slow death sentences. Without the execution as a motivating factor, the convicted person can just languish as courts blow off appeals. In this case, the new information might have never come to light, and the guy might have just rotted in prison.

I think there needs to be substantial reform to the death penalty system. Situations like this should be statutorily designated for automatic dismissal. After that, I’ll still support the death penalty.

Firing squad is the way to go, multiple large caliber wounds creates an immediate drop in blood pressure to the point where you're unconcious within a couple seconds, better than drowning for 20 minutes in air. If we as a society decide that the death penalty is something we should do then I think it's required to find the people to do a firing squad, dressing it up as medicine is a pretense that hides what's actually happening and beyond that it creates a disturbing and horrific death, botched (which means death is more than 10 minutes, and 9 minutes of suffocating in air does not sound pleasant to me) a third of the time. As Nick mentioned, the chemicals they use are injected quickly in such a large volume and are caustic so they literally do burn through your flesh while you're paralyzed in agony and then get pumped around your body and they still aren't dilute enough to not cause damage so it is burning from the inside, if the vein collapses under the heavy pressure and caustic agent then the chemical is pumped deep into tissue and you have no pain relief as it burns through soft tissue and you're stuck with a melting bicep while they try to find another vein (I know they don't inject into the bicep but that's where the drug goes immediately and then the burst happens either at injection site or shortly downstream towards the heart through the vein which is the area the bicep is in if injected in the typical place opposite elbow. That causes immediate muscle death and if you look up Rhabdo from people at the gym they go from working out to collapsing in incredible amounts of pain as their kidneys are ripped up by dead muscle tissue, happens so fast so there's no way you're dead before that happens either on a botched or even 'succesful' injection. Edit: It's possible that the electric chair might have actually been better than lethal injection when it killed in one shot, I mean yes you burn and are on fire but all your nerves are firing so there's no discernable sensations just one massive whole body trigger and then you're dead. When they were introducing lethal injection, before world war 2 they were looking at and I think experimenting with gas chambers but that got the kaibosh quite quick, to be honest though, 100% nitrogen is probably a pretty good way to go, it's the way people do suicide and you can find videos in compression chambers of people going hypoxic and trying to do toddler shape puzzles and they can't and then they get giddy where they can't even put their own mask on, a couple minutes of that and they're dead but there's no way anybody would ever even float the idea of gassing due to obvious reasons

AWESOME car, lousy audio. It's not only the means, though. It's also the gov't. We currently have hundreds of ppl incarcerated for "insurrection" or varieties thereof and/or still awaiting trial after over two years, some who under this could possibly face the death penalty under yours or others' ideas. Would you be OK with that? I'm not. Our DOJ is out of control. Many state AG's are, too. How long before they'd start executing prisoners for more menial crimes? Especially, if they were white males? I'm just asking questions.

Yeah, Philip Nitschke's Exit International has that "Sarco pod" (short for Sarcophagus) that looks like one of the cryosleep pods from 'Alien.' It uses nitrogen gas, and supposedly causes a painless (and apparently even 'euphoric') death within 30 seconds. They plan on using it at those assisted-suicide clinics in Switzerland, which currently predominantly use pentobarbital (either injected or swallowed) to cause a painless death. I even wrote a paper in law school this semester on why we should replace lethal injection with the nitrogen gas method.

End absolute immunity for judges and prosecutors and a lot of this goes away. I bet prosecutors won't "forget" about exculpatory evidence very often if that can lead them to bankruptcy, or make them uninsurable/unhirable.

My problems with the death penalty; 1) Outsourcing the punishment to the state. If the defendant is found guilty and sentenced to death then it is the duty of the jury to pull the trigger. And I mean 12 jurors, 12 guns, 12 bullets. Spare not their feelings. They told a man to die and now they fallow through with it. 2) Legal protections for the state against false convictions. If the state convicts someone, hands out a death sentence and later after the sentence is fulfilled is it found out to be a wrongful conviction; there should be penalties in the *billions* for it, paid out to the victim of the state's family. Executing an innocent civilian *should bankrupt* a state. Because a country that can kill the citizenry with impunity and never face punishment is a country that can commit democide.

Absolutley love 1! Idk about 2. The state doesn't "make money" to dish out to the family. You are putting that burden on the tax payers. Why even address such grievances with money? If a prosecutor willfully goes after an innocent person, give them the same punishment or worse. A life for a life in the case of death. I suppose I could live with suggestion the first. And believe me, in some cases I would pull that trigger myself. There's some really horrible people in this world, and they can't be allowed to F it up for the rest of us without consequences.

Even if he just used cheap 99 Cent Store ear-phone/mic plug-ins for these recordings it would be 100x better. I stopped 1min on this, just like the other one. 1. I want more videos of you doing day talks in your car. 2. Please get a mic that boosts your voice above the car. 3. I recognize the state as having the ability to, and likely the right to end the life of the citizenry that has violated the rights of the citizens, but I still think the death penalty should be avoided. Just throw them into labor somewhere, and if new evidence ever points them actually being innocent, then bill the state ridiculous amounts of money for a bad charge. This money would ideally come from the prosecutors, judges, and jury members.

The problem I see, DAs and assist DAs need to show they have won judgments to show how good of a lawyer they are. Till that stigma is gone, prosecutors are going to prosecutor the shit out of people for fame.

That's exactly how I am. If the system actually worked as intended, it would have been fine and dandy. However, the system does not work. Innocent people are getting killed via corrupt officials. So, a hard no to that.

The Ricky Jackson case was the one that changed my mind on this same topic a while back. Human error (whether intentional or not) makes me balk at the death penalty now.

I forget the name but there was a guy who lost his whole family in a fire, then was convicted of the arson and put to death. Then a few years after his death the entire science they used to put him away (and many others) was found to be 100% hocus pocus, with absolutely no basis in any science.

I think prosecutors should face the death penalty when they knowingly withhold exculpatory evidence as well as those appellate judges

1. There should be a threshold of evidence for giving someone the death penalty like cameras, multiple witnesses, fingerprints, and DNA. 2. They should have to make the death penalty the only punishment on the table so that if the jury decides the defendant is innocent they walk free. 3. There should be someone completely disconnected from the justice system who has the ability to access all evidence (which may have been restricted during the official trial by the court) and is required to do a validation of the reasonableness of the conviction.

On your third point, it should be multiple people. Kind of like a second jury. A lot harder to bribe or intimidate a few independent people than one.

Hey, is there any way you can touch on these LGBT+ bills that Florida has passed? I think many people are confused by them and/or have been mislead about them. Some people are claiming bill 1580 gives medical providers the right to refuse emergency care to trans people, but I saw one guy talk about how emergency care refusal is one of the few things that cannot be refused... Would greatly appreciate it. Am gonna check your Rumble to see if you've touched on it there... EDIT: Also, if you could touch on these abortion "ban" bills, would be amazing! I'm trying to read through all these but as a layman it's not easy... I'm not sure what parts I should focus on....

I'm not a big fan of the death penalty, but I don't like the idea of taking it off the table completely. That said, I have ZERO faith in the court system as it stands to come to the right conclusions regarding who lives and who dies. I don't believe getting rid of the death penalty for "humanitarian" reasons makes any sense... but a moratorium while the courts get their act together has some appeal. As for a preferred method of execution... I actually just had this conversation with my father the other week. Dad likes the idea of lethal injection, thinking he'd just doze off and not wake up... whereas I think about what it would be like to be paralyzed, but still conscious. Guillotine would be my first pick, but that's not an option here. Our only choices are lethal injection or hanging, since they got rid of the electric chair some years ago... and I don't much care for EITHER of those methods.

I worked criminal defense for over a decade as a forensic behavioral specialist in a death penalty state. I worked on eight DP cases in a primary role and on several more in a secondary role. I functioned as the Mitigation Specialist in one of them. I can say with no reservations whatsoever that the state cannot be trusted to make life or death decisions. One of the single biggest mistakes we make is having prosecutors as elected officials. The moment you combine politics and the law you will start getting skewed outcomes. Now having said that, there are some people you simply cannot keep around. Timothy McVeigh is a good example. That guy had to go, and I don't have an problem with that. But in general, life without parole should be the maximum penalty. Redemption is possible, even for cold-blooded killers.
