Can I Work While Waiting for a Decision in My Social Security Disability Case?

In order to win disability benefits from Social Security, you have to prove that your medical issues prevent you from working. So how is it even possible that you could consider working, even part time.
The answer, as I discuss in this video, has to do with how Social Security defines work, or more accurately, how it defines "substantial gainful activity." (SGA)
Part time work below a certain threshold is NOT considered "substantial" by SSA, so earning below this limit does not disqualify you from pursuing benefits. Does NOT disqualify you!
In 2024, your work is considered "substantial" if you are earning $1,550 per month (gross earnings) or more.
So on-going earnings below this threshold are not an issue unless the disability judge thinks that you are intentionally suppressing your income so that you can qualify for benefits.
The SGA amount changes every year and the table of SGA limits is at www.ssa.gov/oact/cola/sga.html.
If you exceed the SGA limits a few times while your case is pending, you are NOT automatically disqualified either since you can argue that your over SGA earnings are an "unsuccessful work attempt.
Ideally, an applicant for Social Security disability benefits will not work at all since ongoing work activity could raise concerns or suspicions in the judge's mind.
But the reality of long wait times (two to three years in many disability cases) means that disabled claimants MUST try to return to work. The best solution in these cases is to work at BELOW the SGA levels and to submit evidence that the work you are doing represents you maximum earnings capacity.

My husband took a part time job while waiting. He is scheduled for 23 hours and make x an hour. However, he has never gone over the 1550. One month it was $800, one $1200 and the highest was 1400. He went from a carpenter to a clerk at a hardware store. He was up front and honest with social security even sent his pay stubs. Yesterday, he was denied based on their belief that he will average 1590. They took his hours scheduled (but not written in stone), multiplied by pay and then by 52 weeks and divided by 12. They stated he averaged 1590. So, this is frustrating because they are assuming a disabled person will have perfect attendance at said job, no holiday off, no doctor's appointment, no hours reduced - which happens often. He also received a letter saying he could earn up to 1550 and now they come up with some pie in the sky average.

I was glad to hear you mention about number of Hours Worked because I come across people who think they don't Ask about Number of Hours and they do. I have had SSA Representatives Ask me 3 different times about number of Hours Worked. I have heard the number of Hours Worked in a Week is a Maximum of 20, but as I said I have met people who insist they only Worry about the Money. I have been on SSI for almost 5 years total. I wish I hafmd known before I could have Worked a little while trying to Apply for Disability. My very special Kitty I had at the time would still be Alive if I had. He was my Service Kitty what I Called my Pain Alert Kitty.

I’m conflicted on this. I’m 63 nurse workings after a cervical fusion, fractured pelvis, and recently broke my shoulder and wrist and working because I need money, yet everyone tells me apply for ssd. I listen to the penalties,why risk it vs struggling to work.? Too bad you didn’t live near me.

I've had a migraine for almost a year... Next month will be a year. No medicine/treatment has helped. My husband has been trying to get on disability for 8 years. I feel like I have no choice but to work 4, 9 hour days a week.

Hi.. i have a question i worked at my last two jobs witch they both sent me home during work due to how I was walking so i filled social security a month later in 2017.. i been two different doctors due two one doctor really wasn't doing to much treatment but they found out i have a fracture in my Left ankle which is to late to fix and a tire in my ankle which i need surgery but my insurance changed so i have to wait on that, i did x-ray i have back problems and i have a mental health psychotic witch i been seeing for 2 years diagnosed me with depression, anxiety, PTSD .. im taking strong pills like (quetiapine) for one.. ALJ judge denied me witch my attorney was shocked so she appealed it Oct 2023 to the appeal council im still waiting.. but my question is how you feel about why i didn't get approved

This guy is good. I'm in reconsideration going on for a year now. I just had a DVT and PE and on blood thinners and thats a new developmet that happened. Origionally my disability has been palpitations of various sorts and afib and a couple of anxiety disorders and I'm on zanax and prozac and now blood thinners. I got my fingers crossed. But I'm 591/2 so if I'm denied I will be about 62 before I see a judge the way things have been going. So I don't expect reconsideration will be approved but I'm hoping but I figure turning 62 will be when I start getting money. Anyone have any informed opinions or experience?
