That looks like a publicly accessible road to me. Literally anyone can go through. The laws you cited pertain to the inside the facility. Just because it a prison doesn’t mean the whole place is secure. A lot of prisons’ parking lots are open to the public.

I'm not sure a sign on the side of a road with no gate, no private road sign, is sufficient. There's a McDonald's sign next to the road on the way into town from my house, I doubt any reasonable person would assume the road is privately owned by a corporate entity from mere existence of a non-traffic sign.

Aren't private roads, which the prison guard is claiming, aren't they supposed to be marked with some sort of "private road" sign? The road even has what looks like a legal speed limit sign of 35 MPH. As far as he knows he is on the side of a public roadway on the public right of way to the side. There is even another sign at the 10:00 minute mark stating "No use of tobacco products beyond this point." I would say that is the point that the prison is claiming it is private property. Even the Google Maps street view goes to just past the tobacco products sign. It really looks to me like he was on public property or at the least property that appears to be public.

I wanna take a moment to talk about the part where he warned the guard about qualified immunity. It don't work for a jail/prison guard but, for reference when dealing with the police. Make sure to get it on film, ask the cop to look up specified case law. If the cop refuses to look it up, they can't use the excuse later in court that they didn't know they were violating your rights. That is how they get qualified immunity by claiming ignorance of the law. But, getting them on camera not looking up the law when presented takes away that "immunity." Then the individual cop can be held liable.

The Google Maps car went part of the way down that road. If the jail does not want the public on that road, I would hope they would make sure that is marked as private access road or that they would put a guardhouse at the road to ask people what businesss they have there with a sign that states only authorized visitors beyond this point. This situation was preventable.

And even if there are policies in place that restrict access via scheduling appointments. Those limitations are time place and manner. Even if he doesnt have an appointment he has a right to be anywhere the public would be allowed via appoinment. Excluding restricted access areas (via due notice or reasonable restriction). How are you supposed to connect with a custodian of records in person if the roads and parking lots are all "restricted access"? There is a lot more to this story. The officer tried to file a restraining order against the auditor and failed. The auditor took a no contest plea bargain due to bad advice from his lawyer.

The citation of laws pertinent to the incident is interesting, but the regulation says the Corrections Department gets to approve Cameras before they are brought INTO the facility, not TO the facility. The legality lies in interpreting what the rules and laws specifically say. There must be a difference between the Public Road and Public Parking Lot even in the documents citing "Access to the Facilities/Inmates." There are Fences, walls, and doors that control access to the building and inmates. This differentiates them from the Roads and Parking Lots. As with other Military Bases, they can set up a Guard House at the road if they want to restrict access and they can post signs if they want to restrict photography. The road was publicly accessible and I saw no designation that showed that the property was not Public.

Bueno did not investigate whether anyone asked Drew for his ID before filing charges for failure to ID. Malicious prosecution..... Bueno did not investigate Drew at all and within 40 seconds he cuffed and stuffed drew without asking him a question, totally believing everyone else and did not order Drew to leave and give him a chance to leave. Bueno did not even attempt to discuss the situation with drew and refused to even talk to him. Bueno did torture Drew by rolling up the windows and redirecting the flow of air away from drew toward himself. the sweat is in the video! the car had custom air ducting to blow onto the driver. See Drew's videos. The charges were dismissed with advice from Drews lawyer. The state offered to dismiss the charges if Drew pled no contest.. thats the state's fault.. stating dismissed is dismissed is dismissed. How you get there does not matter, if there is no conviction, then it is appropriate to go ahead with a civil rights lawsuit. that was Drews strategy and saved himself 30K in lawyers and court charges to take this to a long extended trial. usually the state will not dismiss all the charges for this reason alone. they must get at least a minor sort of conviction. but they goofed big time on this one. no contest means not admitting to the charge but letting the court decide without having a trial.. the court decided to dismiss the charges. Depositions in the subsequent future of this issue showed that the public is invited to the auto maintenance garages on the grounds for the inmates to service cars that the public brings in. the public IS invited. if the public is invited , so is the press. And finally, Drew went back there and filmed and everyone was cordial and no subsequent arrest was made. you can't arrest someone once and not arrest him a second time for the same so called offense. they knew they were wrong to arrest the 1st time. Bottom line is Drew was never ordered out by the poilce, and then given a chance to leave.. even if the order might have been unlawful. which might be another lawsuit in itself. And you didn't even mention the frivolous retraining order that Bueno tried ( and failed) to get a judge to sign trying to silence Drew on his activities on his lawsuit. and that warden is no longer on the job there.. I wonder why?

No Deputy Bueno did not have probable cause to arrest the auditor. For one there are no clear written rules signs or trespassing signs or signs delimiting secure or special zones vs public zones. You see these signs for instance at military installations. Only qualified people with military IDs are allowed in and park. Second the fact that any of the public may pass or drive down that state road leading to and then enter the public parking lot, makes this road and parking lot access publicly filmable. Bueno gets a c-. The auditor was sort of confused about his own position, citing the wrong case law but his spirit of the law was correct. If Nevada wants to make prison roads and parking lots "special access zones" then pass laws to that effect.

Ata goes on and on about how government can limit filming on public property, yet fails to clarify how this public street is different then any other public street. Maybe he needs to look up the GIS survey to make his point. Without the clarification that the photographer was on DOC property then the street appears to be a traditional public forum. Based on the case cited, the street meets the 3 requirements for a traditional public forum. Public roadway accessible to anyone to use for traveling. I get that they may want to restrict filming of secure areas. Are they going to arrest everyone driving a tesla, or some other vehicle with a dash cam? If not, they cannot restrict access to a guy with a camera. Prison guards are not the brightest law enforcement. They typically barely made it out of high school. Being an affirmative action warden really doesn't look all that impressive.

Although America is a police state it somehow manages to not teach it's officers on basic civilian rights which often leads to lawsuits something incredibly common in North America society. This then leads to tax payers money, potential job loss, and an entertaining KZfaq video. Rinse and repeat.

Here is my question, normally the public accessway and parking lot to a correctional facility are usually just that, public access correct? So if this one is different and pre-authorization is needed, how would the average person know that? Shouldn't there be some sort of signage making that clear? And secondly how is it allowed that this facility can basically make everything restricted without pre-authorization, assuming there is some sort of traditional public access and entryway? Lastly it was pretty shtty for the cop to make no attempt to resolve or deescalate, literally just listened to the other officers and arrested the guy.
