Different countries take different approaches to censorship. Some are hands off while others have a vice grip on what is allowed. Germany is somewhere in between, so today we're going to look at the history of German censorship of hip hop albums from the 1990s to the 2010s. The agency known as the BPjM indexes a piece of art and adds it to the JuSchG list of indexed media. This practice is slowly turning around though as more German citizens criticize this type of censorship and the banning of media has slowed down significantly since the late 2010s. Pretty interesting stuff, so let's talk about it.

Just to make it clear like I said in the video, I don't think all censorship is bad or that Germany is doing anything inherently wrong. I just find it interesting to look at hip hops history through different countries viewpoints. ❤ my German viewers

Censorship is always bad, but that’s not how democratic governments do things. They restrict access and hope that studios/artists self-censor

Hi it's me the one British person watching this, I think a video about this same topic but with the UK government's history of abusing government powers to ban drill rappers from preforming could be interesting, it's a serious topic of discussion over here as many people blame drill for rising knife crime and use that as an excuse for censorship

Hi squash, I wrote a large part of that article in the German wikipedia. Funny to see it again on KZfaq and in English LOL Anyway, I enjoyed your video a lot. The crazy thing to me is that once the BZKJ indexes an album you will have no chance at listening to it (legally), even if you are an adult. Apple Music, Amazon etc all remove indexed albums completely from their databases for German users. Fucked up if you ask me, especially since all of the best albums were indexed back in the day.

After Engberding stepped doen there was a huge reform, which helped a lot of media. This mostly affected video games since it had a lot to do with the USK (German MSRB), but the higher standards also contributed to a decrease in indexing overall. The two main changes were: #1 video games were now considered art and thus were under the protection of the constitution and thus were allowed to display national socialist symbols as long as the games weren’t endorsing or relativized it. #2 A USK label now meant that your game is unindexable. Rap culture didn’t get milder in Germany, maybe even more extreme, but the general shift means, that the index more and more retakes the position that was intended for it, even though in my opinion it shouldn’t exist at all, or at least List B, the advertisement ban and display ban should all be abolished, especially because the original „mein Kampf“ cannot legally be restricted, because it’s preconstitutional

I lived in (West) Germany between 1981-84 when my step father was stationed in Burbach(Siegerlandkaserne). What's funny about this is that German radio stations used to play Hip-Hop music uncensored. This wasn't a big deal because very few commercial Hip-Hop releases had foul language in them back then. When I came back to the States, They had what they called "No rap workday" on the radio. They essentially banned Hip-Hop music till after 9pm. So Germany was more progressive about playing Hip-Hop music than the U.S.

I don’t know much about Weimar or pre-Weimar law, but I can tell you how the modern German constitution is supposed to work: a lot of articles have a clause that allows the government to restrict these rights, but restrictions need legitimation, which can only be another constitutional right. So one right can only get restricted by another right.

In Germany harsh language or sex isn’t really a reason for censorship or other restrictions. References to National Socialism on the other hand… so Bushidos Album wasn‘t censored, because of a few swear words, but because of references to National Socialism.

A lot of what is banned is because of political extremism, you're right. But as I laid out in the video if you finish it, the origins of the BPjM organization were to combat Nazi or extremist views being expressed in art. However over time their authority and reasons for banning things expanded far beyond that to include: pornographic content, glorifying war, violent content, minors being depicted in a harmful way etc. which is all listed on their website and wikipedia page. As for Bushido's Electro Ghetto album, I even mentioned that there were references to Hitler and Nazism in his album, but the point of comparison was that it wasn't so different from other countries hip hop music at the time and contrasting how Germany deals with the situation because of their history. I'm not saying that it's good or bad, I'm only saying that it's interesting to read about because I enjoy looking at hip hops history in different countries.

@@afunnylookingsquash they still weren’t banned for using swear words, but for violence/endorsing violence (even though I don’t agree with the de-facto ban) „Ich mach dein Pausenhof zum Schlachthof, Panik bricht aus“ Probably wasn’t the smartest line to rap in 2004

@@afunnylookingsquash over the years I have created a rule of thumb: if it contains violence, Europe will be strict, if it contains nudity, profanities conflicts with religion the US will be strict. For example: Oppenheimer. The movie has a FSK 12 rating in Germany, while it has a R rating in the US On the other hand games like Half-Life had to be censored here to be legally sold

Basically the lines in here in germany are drawn very wide nowadays, so not everything lands on the Index. And well you can get all those albums online, you just can't buy them officially. Same goes for movies and stuff. The Agency is just indexing stuff that is really really heavy stuff which promotes basically radical extremist stuff nowadays. You should look at the punk band "Die Aerzte" and how they got indexed... and got around the index with another album even though songs on that album were already indexed by the agency. After i think 30 years some of the albums on the index got released again, because the times changed.

I think it's a great thing, rap music is a curse here in Europe, teenagers are obsessed about thug culture here, especially among the immigrant community, they all dress and act the same way here, all inspired by what they see in rap videos

The real reason they banned it is simply because rap fucking sucks. Germans have high standards. They even banned Bob Ross videos for being "devoid of artistic quality". But can you blame them? Bob Ross DID suck
