Many immigrants fall in love with U.S. citizens and rush forward without thinking about the green card through marriage process. They overlook that the entry and residence history can affect the immigrant's chance of winning permanent residence status.
There are essentially three options - three different processes - for immigrant would-be spouses of U.S. citizens to win and get a marriage green card. They all depend on the dates and duration of the immigrant's entries to, exits from, and residence in the United States.

In essence, the three options are:
Getting a marriage green card through adjustment of status at a local USCIS office in the United States, (b) getting a marriage green card through consular processing via an interview in the immigrant's home country, or (c) getting a marriage green card through fiance visa process, beginning at an embassy abroad.
Often, as an immigration green card attorney, couples visit my office after their application has been denied, or they have received a request for evidence that asks for proof that they do, in fact, qualify for the marriage based green card process in the United States.
They simply filed a marriage petition and an I-485 application on their own, or with the help of a paralegal, notario, or legal assistant who did not understand the qualification requirements. Or they took a very simplistic look at the K-1 process, and assumed it was a "k1 visa or just get married" type of decision, with no thought that other legal questions needed to be answered before moving forward.
Other couples, however, take their time to figure the best green card marriage process before they get married. They understand that their ultimate goal, living together in the United States, is too important to risk an error that might prevent such an outcome.
Some search the internet and discover the many quirks between a fiance visa vs marriage visa, that perhaps the immigrant should return home and begin the K-1 visa process at that time. Others discover, based on their lengthy period of residing in the United States, that they need to closely consider consular processing for green card, and worry about the need to also file an I-160 hardship waiver.
In other words, they grasp that the process for green card after marriage is not as simple as it appears. This presentation is geared for all couple pondering the best steps for green card after marriage.
But this video is likely most helpful for unmarried couples in the pre-marriage stage, after the love bug has struck, but before the couple has tied the knot.
