In some cases, a green card under VAWA, known as the Violence Against Women Act program, is the best option for a victim of domestic violence. However, due to the VAWA 2021 rules, seeking temporary relief through U Visa deferred action along with a U Visa work permit may be the better option in some cases, and the only option in yet other cases.
The VAWA vs U Visa debate does not extend to all matters involving domestic abuse. Deferred action under VAWA, for instance, does not preclude following U Visa 2021 regulations to obtain permanent residence.
Although it is true the VAWA self petition process leads much faster to a VAWA based green card interview than the slow-moving U Visa processing time for winning legal residency, the latter approach can help immigration domestic violence crime victims in cases when there is no spousal, husband-wife relationship between the abuser and the abused win the right to live legally in the United States.
