The plaintiff leased her horse to the defendant for free in exchange for feeding and taking care of the horse. The plaintiff claims the defendant took terrible care of the horse and left him malnourished, so she rescued him. She’s suing for vet bills. The defendant argues she and her husband split up, so she wasn’t able to contact the plaintiff. She thinks her ex is behind the whole thing.

Or, buy something and take care of it yourself. Lady bought a horse, kept it somewhere else and had someone else care for it. Plus, if the horse was getting bad, she must not have seen it for a while. I blame the owner. How do you care for something that is 8 miles away, but you don't see it or take care of it?

But she agreed to take care of the horse knowing that and chose to use the horse as a tool to show how bad her ex husband is for not looking after the horse and abandoning the horse, even though she agreed to take care of the horse for him.

bad verdict . plaintiffs were upset that the defendants did not end up buying the horse so they came up with a BS story to get some money . its always about money with animal people but they pretend its only about loving animals . and its a shame that the judge believed their BS .

@@saramichele7366 the plaintiffs are supposedly horse lovers but they give their horses to people., who have no experience with horses , to keep for a year for free in the hopes they buy the horse . well i think the judge totally missed what was going on with these plaintiffs . they were mad that the defendants didnt buy the horse , not mad that the horse was not cared for properly . its always about money with animal people who sell animals , but they pretend its about loving animals .

@marleonetti7 I think you've got it all wrong. As a horse person, free leases are very common. It's essentially a trial period to make sure the horse works out. And the leaser pays all of the expenses for the horse during the lease. She hardly mentioned the fact that they didn't buy the horse. She was outraged at his condition. Rightfully so. They never did say what type of experience the defendant had with horses. So we can't really draw that determination. What we do know is that the defendant is guilty of animal cruelty via neglect.

I don't like the attitude of the defendant. I don't give a hoot who signed the contract. She had the horse in her care and she could have at least gone out and given it something to eat. And it was their daughter who was riding. That is plain cruelty. The judge should have made her paid the whole $1500.00.

Exactly! If my ex left me with a snake, an animal I have NO IDEA how to care for, I'd do everything in my power to get it back, not watch as it slowly dies and say "Nothing I can do. I didn't sign the contract, not my problem".

As someone who owned and competed horses most of my life, I'm absolutely horrified at the sight of that poor, neglected horse. It doesn't take an animal expert to see how emaciated that horse was! The defendant is awful. I'm also an animal control officer, and she should have gotten a summons for that neglect. Disgusting. I don't blame the husband for fighting for custody! If she treats animals like that, she shouldn't care for children! What an evil piece of garbage! 🤬

Even if she was following how her husband told her to feed the horse ect.She has eyeballs and one would think she would notice the horse loosing 400 lbs.She just didn’t care because it wasn’t her horse.And it was a free rental.That’s evil.

Horses aren’t the most difficult to take care of. I was helping take care of a horse and did all the feeding when I was 8 at my grandparents house. The internet is free, she could’ve figured it out.

The husband stopped by the end of August to tell her they didn't want the horse anymore (AND asked if she can come get him) , left the wife in September, and the plaintiff didn't go get the horse until mid January? The Plaintiff shares some blame in this. If someone has my animal, and they tell me they don't want it anymore, I'M GOING TO GET IT, and not 5 months later. Also, the defendant's husband shares just as much blame, as the defendent, in the condition of the horse, 1 because he knew he was the sole care taker of the horse, 2 he saw the deterration of the horse when he came to get his kid, and 3 he sent pictures to the Plaintiff to show the horse's condition, but didn't get a trailer to send the horse back, or even assist with feeding the horse. He was more concerned about winning a custody battle than keeping the horse alive. And there's alot to be said about that. If her divorce attorney is half decent they can spin that shit in her favor. Every last one of them failed that horse.

If they had never picked up the horse, the defendant would still have to care for it until they could return it and sue for damages or sell it as abandoned property. The only people responsible for not caring for the animal are the people who did not provide proper care while it was in their custody.

Exactly. At some point the plaintiffs husband or her should have seen the horse over the months. If they didn't have a registered trailer then they could hire someone to get the horse. A cheaper option might be paying the defendant to feed their "beloved" horse. @@deno9607

The defendant was despicable, her moral compass was way off. Why the plaintiffs didn't file criminal charges of animal abuse against the defendant and her husband is beyond my comprehension. I'm not a horse person, but everyone in my family has at least one horse, I have never seen anything like that. That poor animal suffered for a very long time. Sickening

When it comes to animals, I agree with Adrian. We are their voice. They depend on us. To treat an animal like crap just infuriates me. We found a kitten that had his tail set on fire by someone. Pisses me off when I think he was hurt. He's the sweetest baby.

Said defendant had pics of the hay and grain in the barn. That makes this 1000X worse. She's acting like her husband is the sociopath, but sounds like they're two peas in a pod to me. I owned and rescued horses for decades. Unless there's internal issues or they're a hard keeper, horses keep their weight pretty good. Quarterhorses are generally easy keepers. And seeing how fast he recovered, it was pure starvation. All she had to do was throw hay out and he would have been fine.

She assumed care for the horse upon the departure of her husband from the household , if she didn’t want that responsibility or was incapable of it then she should have had it resolved immediately. Not neglect the horse for months ! She’s evil and didn’t take any accountability & her husband is an ass but she is despicable look at how depleted that horses health was !

Ok, so she was doing what her husband was doing. Once she saw the horse was loosing weight, looking that way, how could she allow that? Cruelty! The defendant is an awful person. And, sounds as if the horse may have been an issue in the divorce. I knew of a divorce case in which the person let the house go into disrepair because that would be a bargaining chip but this is a living being! Disgusting!

If she didn’t want to take care of the horse anymore she should have gotten a police officer involved (like they do when you have to pick up your property from your ex) to get her husband to give her the plaintiff’s phone number to get the horse returned home.

The defendant may not have had the full knowledge on how to properly care for a horse, which I know is a lot. But she should have had no problem knowing how to give an animal some food!? At least make sure the horse has enough food and water each day until you get whatever her excuse was figured out!

My horse is a rescue. I've seen pictures of her from when she was first seized and she was even worse! A friend gave a pony away because it had some trouble with heaves. It was still a good weight and was doing fine with the supplements it was on. She explained everything to the new owner, who assured her it wouldn't be a problem. I'm not sure how long after that, found the pony BACK in the field. She had no notification that they were bringing it back. And it was skin and bones. Because the field was right on the road, she called AC and let them know of the situation. She didn't want to be reported for animal cruelty. I also had a pony with heaves. And while he could have used a bit more weight on him, he didn't look that bad. I lost him last year. He was at least 32.

Fortunately that horse was on lease, can you imagine what could have happened? The defendent probably was trying to save on grain and hay since they weren't planning on keeping thr horse. Or she was punishing her husband via the innocent horse.

I think everyone is somewhat to blame. Obviously the defendant and her ex husband are disgusting for how they treated this poor animal and deserve most of the blame but the fact that the plaintiffs only live 8 miles away and weren’t checking on their leased out horse is ridiculous. I would do a quick weekly or biweekly checkup especially if I lived so close.

That is clear neglect. Before you entrust a horse to anyone, do a background check on them. A horse is not a dog. When you starve a horse you can end up with metabolic damage and orthopedic or lameness that can not be fixed. Horses have to be sound to have quality of life. This judge is ignorant of horses and imposing her assumptions on the case is not law.

The defendant didn't take care of the horse at all because if she did she would know what he looked like before it left. "Idek if that's him" clear indication that you left it out there starving. As for the plaintiff when you give something away for free people usually don't take care of it.

The woman could have easily called any VET or any animal welfare facility to assist her to feed and look after the horse. Instead she decided its her husbands horse and she couldn't be bothered with the horse at all to the point the horse became severely underweight because of the divorce case to get back at her husband. She and her husband both need to be charged with animal cruelty. Her husband needs to be charged with abandoning the horse and the woman needs to be charged with animal abuse for neglecting to provide care. Both of them are disgusting human beings.

1. The plaintiff should have filed the case involving BOTH the defendant & her soon to be ex husband, he’s equally responsible, not the defendant alone. 2.The defendant shouldn’t be going to the mall! She should be going to the feed store to get hay & pellets! She disgusts me that she thinks her or her kids ‘NEED’ something from the mall which is a luxury compared to the NECESSITY of an animal who can’t feed itself- FOOD & is the second basic necessity to air to survive! 3. The PLAINTIFF’s should be partly RESPONSIBLE for the condition of the horse as well! She clearly stated she checked on the horse the first few weeks, then weekly & then couple of months. Everything was fine for the first year, THEN the soon to be ex, tells the plaintiff he wants to give the horse back & SHE gives the excuse that she doesn’t have a trailer! Who cares! Go RENT ONE FOR THE DAY & go get your horse! Him saying he wants it’s gone, means he wants no more responsibility for it! You are put on notice now! So the care can or would be lowered until there is no care- PERIOD! Once he says he doesn’t want it, it’s the PLAINTIFF’S issue again! 4. It’s a ‘free loan’? I’ve never heard of that ever. And the contract isn’t shown so we can read it to see where everyone failed the horse. The plaintiff didn’t provide HER NUMBER OR ADDRESS. And the defendant didn’t know it either in that year! That’s more on the plaintiff than the defendant b/c she was 8 miles down the road & KNEW where the horse was. And the defendant could have written or said to the lawyer, ‘tell my ex he has X days to provide me a number & address so the horse can go back or he needs to remove it in X days’. If he gave her a wrong number, then she should have called animal rescue or the police. That looks & sounds like he set up his ex (defendant) so she couldn’t get rid of the horse. And she more than likely thought he’d get in trouble b/c she wasn’t the one who signed the contact. 5. Both defendant & ex NEED to have animal cruelty charges filed against them. I always make sure my kids are fed, then my animals BEFORE I can eat myself. That’s MY responsibility! 6. Contracts (written) have to have names, numbers, addresses, terms (the agreement exactly & recourses if necessary) & signatures. 7. The plaintiff is WRONG about the horse has no value when she took it back! That’s the stupidest statement in this episode. She took it back b/c it’s her property & it was in need of immediate care (that’s concern of loss), she took great care to restore the horse to where he should be in care, weight & health (upgrading) & the horse as the judge said, wasn’t dead. So it still had value & he wasn’t worthless. But here I say AGAIN, it’s partly on the plaintiff as well, she was told 4 months before he didn’t want the horse. And after a few days, I would have contacted him to say ‘so are you giving the horse up or is he staying with you?’. That’s pushing her part of the blame until the defendant & ex. She needs to accept that herself. And she said extra meals ‘IF WE HAD TIME TO DO IT?!?! That’s no different than the if defendant said I didn’t have time to feed him today. Regardless of time, do it. Ultimately the defendant & ex are to blame, but so isn’t the plaintiff(‘s).

it is called a free lease and it happens all the time. The husband had the contract with the name and address you don’t have all of your facts correct. And we don’t really know the entire conversation of the husband to the plaintiff, but I would’ve gone and got my horse ASAP.
