Blair has been under fire since controversy with LegalEagle and plagiarism, as well as with former sad milk members like Wonderstruck, OzMedia, the Click, and One Topic, and controversies with Tommy C, Nicholas DeOrio, and Cruel World Happy Mind. After this, iilluminaughtii sent cease and desists to some former sad milk members, as well as threatening to foreclose on Oz Media's home. Now though, she's involved in multiple lawsuits and is suing former associates as well as being sued. However, her most recent documents lacked any specific details, and now Oz Media and his team have filed a motion to dismiss her entire legal case.

Hey so this is the second youtuber Ive seen talk about Mistplay and I believe its just a scam app. There has been heaps of reviews about this app banning people before they had the chance to redeem for unspecified reasons apart from the general "broke TOS" or refusing to pay them in general by giving them false redemption codes. It is just sounding like a general "Play for pay" scam you hear with survey sites and casino sites/ mobile apps.

Yeah I knew that just in the fact she didn’t file any lawsuit against the click despite his long thread and KZfaq video which had one of the worst allegations of her character (at the time at least) She can’t slapp him because the click a KZfaqr just as big and foreign national. Meaning a suit against him will hurt her more than him. Same reason why she also isn’t going against one topic, if he wasn’t Canadian she totally would have tried it

I'm an attorney. I'm trying to figure out who wrote that complaint. The last two times I saw complaints this bad, the plaintiffs were not represented by counsel. And both cases went to the defendant: one was dismissed and the other the plaintiff lost on merit. Did the attorneys have client control issues so bad that they let her write the complaint? (Which is plausible). Or do they know they have nothing, told her they have nothing, and then when she insisted, decided to throw what they had on a summons and complaint? Or are they all using the legal system to perpetuate harassment (which they are also doing badly)? And if it's the last one, is the CO bar is going to get involved?

I wouldn't be surprised if she paid one of her employees to write this up. But it's more likely that some lawyer saw it and just knew they could charge her from wasting her own time and money on this case.

There are lawyers and there are lawyers. The lawyer I am most in contact with is a self-defense attorney in Philly. But I've known a bunch of lawyers, and for every lawyer like mine (civil rights barracuda), there are a dozen, um, er, persons who passed the Bar. A ridiculous number of them can handle a real estate contract, but wouldn't know criminal law or tort law from a surface-mount voltage regulator. They can make necessary edits to an Adams boilerplate contract from Staples, but they get that odd, puzzled look anytime you ask them about anything more involved. Technically, they've gone to law school and passed the Bar. But do you know what they call the lawyer who graduated 511th in a class of 511? _Counselor_

As someone who works in the legal field (not a lawyer, just in the field), I've read a lot of these kinds of documents. If this weren't so serious and another attempt from Blair at tormenting poor Oz, I'd be laughing because his lawyer is rolling his eyes in every line. This is the legal equivalent of "Bitch, are you kidding me?".

Worst of all, this is a SLAPP lawsuit, a Strategic Lawsuit Against Public Participation. In Colorado, there are anti-SLAPP laws, and most judges really do not like people abusing the legal system against someone for simply sharing the truth.

I suspect the good lawyers told Blair that they need evidence and she couldn't provide it so they refused to take her case. As a result, she had to find one that wasn't concerned with facts or perhaps she can no longer afford a good lawyer. In either case, Blair failed to justify wasting her lawyer's time. She made herself look even worse in the process.

Something that you missed is that dismissal doesn't necessarily mean that she can refile and try again. If a judge dismisses it _with prejudice,_ that means the complainants are barred from trying again in the future. Considering the weakness of the case and the actions of both the complainant and her lawyers, the judge could very well dismiss with prejudice to both protect the defendant from a frivolous case and an abuse of due process, and to send a message that such actions will not be permitted. There is also the remote possibility that, depending on this and her other cases, she could also be nailed with the designation of a vexatious litigant, which prevents a person from starting legal action without direct court approval. In other words, instead of serving someone, ahe would be serving the court to ask them for permission to serve the person she wants to sue.

The way this legal document is worded, sounds like Blair wrote a discord vent post and handed it in to her lawyers, and they went through and edited it a little to make it sound professional instead of "nyeehhh he said mean things online I don't like and and people made mean comments on the video!!1!". I could actually hear her video voice hearing some of the document read out.

They can be a pain to read if you aren’t used to it but you get such good information out of it and, for the most part, it is very easy to find what you are looking for

TBH, I think this is a case of Blair screaming at them PUT THIS IN THERE! Rather than the lawyer drafting the filing. Lawyers are legal advisors that have knowledge of law, they can only suggest actions can't enforce them.

Part of me wonders if she's either: A) dragging this case out as long as possible to exhaust their funds for lawyer fees since the threat of suing didn't work Or B) being as vague as possible in her statements to avoid committing perjury. She won't give a concrete number of loss because if she is proven wrong in court it will look bad on her. This way she can claim she suffered a loss because of Oz but not be held fully accountable for it...

I don't know about lawsuits, but I know in probate court a very common tactic is to hold up all parties with just legal nonsense until the money runs out and to be the last person standing. Lawyers cost money, alot of money. And while Blaire was successful on youtube with her bad credit and reckless spending, if she has any squirrel away in investments or being held somewhere, she could feesably outlast the funds raised for Oz with the go-fund-me. So this could just be a stalling tactic to waste Oz's time and money till he has nothing to fight back with. Or to continue fighting when this gets resolved.

I am curious about something, and though it may not be your niche, perhaps you know of a KZfaqr to point me in the direction of. I love lighthouses, maritime mysteries, shipwrecks and ghost ships, and was wondering about the lighthouses in Ireland. Most of the lighthouses here in the States are automated, I'm curious to know if the same goes for Ireleand or if you still have dedicated lighthouse keepers.

I remember writing my own legal documents to represent my self, and even I wrote a better and more detailed series of documents. Blair clearly did NOT expect push-back, or for there to be an actual legal fight. She was banking on her usual - that her victims wouldn't have community support around them when she tried to bully them into silence. Edit: Further, I hope the court dismisses Blaire's claim with prejudice.

I believe this 100%. I don't believe anything she says and many people have claimed that she makes things up 24/7. I think she was hoping that they would fold and was going to financially push them out. She heard the whole "you can sue for anything in America!" but didn't realize she did actually have to have standing by like... proving her words. The fact that her IMMEDIATE reaction was I'M GOING TO SUE (as she had been threatening other youtubers prior to saying she was going to seek legal action) just shows that she has no idea what she's doing but she has enough ego to think she actually can do things.

I recently learned that the Dickens novel Bleak House was inspired by a real lawsuit. It had veen going for over 50 years by the time Dickens wrote the novel, but ultimately went on for 115. It only stopped because the entire estate was spent on legal fees. While it won't take that long (in part because the case was a probate one) I think that iiluminaughtii's going to end in a similar way, especially since we know that Blair failed to pay her taxes.

It’s interesting she isn’t going after HBomberguy, considering he posted an entire video exposing her for plagiarism (so much for being “a respected documentarian”). Not saying she has a legal right to, I would argue she doesn’t, but she also doesn’t have a case against Oz. This whole legal battle is entirely personal, baseless, and I hope the courts see this and promptly throw it out.

She either got the cheapest (for a reason) lawyers in town, or the only ones who'd even take her case (again - for a reason). The whole "I don't remember" line from the second amended complaint sounds to me like setting herself up to commit perjury without committing perjury, by getting someone else to do it for her. I'd move to dismiss WITH PREJUDICE.

They (Blair and her team) wouldn't be able to come up with precise evidence on time - they'll hand it in late, as what they did with the previous response. If I were the Judge, I would've dismissed it. Sure, I would have given her and the team ONE chance, but that's only one. In my opinion, they are being too lenient. I dunno, those are my thoughts. So glad to see someone still covering this topic (alongside MadCatster)!!

A motion to dismiss is standard in every civil case. Every lawyer would try to file one, regardless of if they have the merits to make the argument or not. It’s not necessarily noteworthy that one has been filed, but it will be worth a follow up when the motion to dismiss gets decided on.

It's absolutely possible that she's intentionally tanking this trial to both drag it out as long as possible, but also so she can file a second one and continue to drain everyone of money. Because that's probably what this is really about. She just wants to hurt them. She knows she doesn't have the evidence to actually win or prove anything, she knows she can't actually win. But she doesn't NEED evidence to drag this case out and absolutely financially and emotionally wreck Oz and the other defendants; the case itself is doing that for her. She doesn't need to win to hurt them. Shes using the very case itself as a weapon. Which is a depressingly common thing that happens. The side that has more money just has to drag their feet and let the other side run out of money to fight and be forced to give up. In this instance, Blair still wins no matter what. With the added bonus of bankrupting her 'enemies' too. She's not trying to win. She's just trying to ruin their lives even more than she already has.

Funny how Blair only goes after people she considers easy targets. OT and Click were very outspoken about all the shit she put them through, but they both live abroad and have larger platforms than Oz or Wonder, so she knows better than to start anything. Hopefully her case gets thrown out.

Ok, prediction time. She will be able to send in just enough to keep dragging this on for a few more weeks. Then it'll just break down for her case, and it'll be a resounding victory for the others. Then she'll be gone from the internet, or at least youtube for a few years, like 2 or 3. Then she'll be back with a "Behind the scenes" video where she talks about how she was ina dark place, and took bad legal advice from people she thought she could trust etc. She has now gone through therapy and is doing so much better. Most of this while talking with a breaking voice.
