Plaintiffs that are public figures (like Blair) have a higher burden of proof in defamation cases. They must prove what's called "actual malice", which means that the Defendant knew that the statements were false, or had "careless disregard" for their truth. That's what it means. An example is from Dominion Voting v Fox News

It’s bizarre because in Blair’s attempt to take these people down she’s just made them more prevalent. The Click recently surpassed her channel, Wonder is back to making quality content, and Oz has the support of so many he got 3x his initial funding goal. Not to mention she’s boosted a ton of commentary channel discovery. Would’ve never found you, Markie, Madcatster, etc. if it weren’t for her stubbornness to be terrible

Oh, it's more than that. The Click has created plushies that had Makeship campaigns far, far, far more successful than Illuminaughtie's plushy campaign. I think it's no coincidence that she attacked The Click right after one of his plushies went off the charts. The Click is a plushie-machine. He keeps coming up with great ideas for plushies. Mango the Landshark was so popular that, after the Makeship campaign ended, some counterfeiter in China started manufacturing cheap knockoffs to meet the unfulfilled demand. Makeship's business model wasn't in keeping a stock of plushies … until The Click released the ESD, the Emotional Support Demon. That campaign was so insane, that counterfeiting was inevitable. So to prevent theft of their intellectual property, Makeship _changed its business model_ and is working with The Click to ensure that there will always be some authentic ESD around for sale. What creativity has Blair shown? What she's shown is Dark, Abusive, Controlling, Vindictive Behavior. Honestly, I hope this suit gets back to the lawyer she went after, and he takes on this case for Wonder and Oz pro-bono.

It's also possible that she had significantly less control over them, and click is around the same size as her before the fall. She'd have to compete with someone who's equally as powerful in another country when she had significantly less control over them. Even someone as delusional as her sees that isn't going to work.

I may just be taking a legal business ethics class and just read the contracts chapter buuuuuuut, a contract is not valid if the employer asks the employee to do something illegal. So like if she is saying that there was a breach of contract because the screenshots of her asking to find information for her to essentially defame or blackmail someone else.... thats like not protected under a contract. Cuz its illegal. Even if its a "company secret" its an illegal one.

@@philospher77 95% of all legal takes online tend to be people trying to use semantic wordplay to intimidate other people into silence. and none of that 95% ever holds up in court; which is why they only use it to intimidate and not actually take them to court unless they're a colossal moron, like the dudes who took the Jimquisition to court and argued that Commander Sterling's use of their game was not "Fair use" because it was being "Unfair to (them)".

If I had to wager a guess, this is what's called a SLAPP suit- a Strategic Lawsuit Against Public Participation. It's meant to be a court case designed to deliberately shut them up, to "chill" others' speech and prevent others from speaking out. If deemed so, whether or not this gets thrown out by the judge, then Oz and the rest could countersue under Colorado's Anti-SLAPP provisions.

In the US people who sue a lot over nothing can be deemed a vexatious litigant and need to get the court's approval if they ever want to sue anyone again. If a single lawyer is doing that, they can be disbarred. So yeah, even if she doesn't stop throwing a tantrum there is a way to put her into time out.

The fact that there's truth in the statements makes this a lost cause. It's VERY difficult to win a defamation case in the states. It has to be 100% false PLUS said to harm the person. There's not a state she'd win in.

There's another cause of action called "false light publication" which is similar to defamation but it easier to win. But lots of states don't recognize it. It requires that the statement, though true, portrays a person in a misleading or false light. Also, defamation does not always require proof damages, because in some cases, depending on the contents of the statement, damages are presumed. This is called defamation per se.

"To prove prima facie defamation, a plaintiff must show four things: 1) a false statement purporting to be fact; 2) publication or communication of that statement to a third person; 3) fault amounting to at least negligence; and 4) damages, or some harm caused to the reputation of the person or entity who is the subject of the statement." (source: Cornel Law School website) Number 4 is damages or harm, no damage or harm no foul in the US at least.

@@kevinz.9785 yes those are the elements, but under defamation per quod the plaintiff has to prove their damages, and under defamation per se, they generally do not. Under defamation per se, damages are presumed. The allegation needs to be "per se defamatory," which includes allegations of crimes, sexual misconduct, business misconduct, or immoral conduct.

EDIT: Obviously I think Blair caused her own damages, she will have a hard time proving the damages arise solely from the trio.

The burden just shifts to the defendants to show there was no damage, or that if there were damages, they were not caused by the defendants. It would be interesting to see how that plays out. I don't think this lawsuit is going anywhere based on the information available to us, but I guess you never know.

One of the crazy things is Blair is suing Oz for things he has not done yet, a video yet to be released. Just to be clear, you can't sue someone for something that they may do in the future. Unfortunately, it is having the desired effect of silencing Oz from not uploading it.

In my non-expert opinion if any lawyer(s) actually drafted up these silly suits, they seem to maybe be a scumbag who will take a client's money, even if there's little to no chance of willing. Tbh I doubt more and more every day Blair's got even a lawyer. EVERY LAWYER IN THE WORLD knows the responsibility of presenting the burden of proof for the accusations lies with the plaintiff, not the defendants. There's no judge in the US who's gonna take that seriously. I do think Blair's redacting those legal aberrations herself after playing Ace Attorney

I'm actually curious now if she is commiting fraud. Leasing a BMW for an "employee" (since they were working for her) is considered a business expense and therefore a tax deduction on a corporate tax return, but if she was collecting payments from them... I don't think that's legal.

"Darkly Unremarkable" is the best description I've seen of Blair. And this lawsuit simply supports that description. Darkly Unremarkable she is. And, the sad thing is, _none_ of this would be happening to her if she hadn't _intentionally_ tried to _slander_ The Click, which in turn brought One Topic into it. And having _both_ of those channels' viewership suddenly looking at your behavior to see if your claims are true or not? Yeah you better be Ms.PristineClean if you try something like that. You wanna know why I think Illuminaughty even attacked Click in the first place? 3 words: Emotional Support Demon. The Click released a plushy that was so popular, it broke all records at Makeship. It's so popular, that Chinese knockoffs have caused Makeship to rethink not producing it regularly. Now, Blair had her own plushy campaign at Makeship at the time, but being the Malignant Narcissist that she obviously is, Blair sees success as a zero-sum game. So she probably saw The Click's success as "stealing" from her own. Narcissists are fairly entitled, and think that _they_ deserve success that other people get, again as part of that zero-sum mentality. So she was probably stewing with rage at The Click for his success, and so went and waged the stupid baseless attack we all know about.

Voila Mango the Landshark and ESD [Emotional Support Demon] and soon, Cerberus-Duck. But back on topic: The ESD broke all records on Makeship: fastest to reach full-funding, most $$ raised in an hour, most plushies ordered of any Makeship plushie, most money raised of any Makeship plushie … it was _so_ insane, that _during the first day of release_ Makeship was reaching out to The Click _thanking him._ Now Mango the Landshark, the previous plushie Click released, has actually spawned Chinese-knockoffs on Ali-express, simply due to demand for them. Forseeing what was gonna happen with the ESD, Makeship _changed its business model_ to producing and storing a certain number of ESD for sale, to undercut any market for knockoffs and theft of their and The Click's intellectual property. This was not Makeship's original business model. Makeship would get the plans for a plushie from someone [KZfaq creator or otherwise], create a prototype, then run a campaign on their website. If they get a minimum number of orders by the end of the campaign-date, they will manufacture them, but only as many as have been ordered. They don't stock merch. Not, that is, until Mango the Landshark started getting counterfeited and the Emotional Support Demon went off the charts. Now, why am I posting all of this? Because it shows that some dude in Sweden has such a talent for creating ideas for plushies that he's broken records and changed a company's direction. _And that will make Blair _*_fume_*_ should she_ or her minions _ever see this._ Blair has nothing … nothing except being Darkly Unremarkable. And I'll leave it there.

Hey! I do some side-gig work as an acoustic design engineer. Your audio sounds fine, but if you don't want to feel "enclosed" in acoustic foam, you can definitely remove some of those panels you have... you have a ton! You'll find more value in installing base traps in the corners especially where 3 walls meet, like the ceiling corner probably right above you! You'll also benefit from foam of different sizes, which is a fun way to break up your background. There's lots of videos on youtube about how you can even make your own. Have fun!

So in regards to her money situation, I saw when reviewing my homeowners insurance renewal a few weeks ago that it has built in coverage for cyber stuff, including loss from defamatory acts. She may be using her insurance policy to do all of this legal nonsense, which would theoretically mean she’s not out much money to take these people to court. Anyway, thought that portion of my insurance was interesting and wanted to share.

I've seen this go down minus the funds for multiple lawsuits, loss of control/complete inability to admit to admit to wrong doing/perceived abandonment/self victimization/miscellaneous other, it's like throwing lighter fuel on a pile of dynamite (and weirdly it also at one point involved Colorado) It was catastrophic. I'm really interested about what happens when she runs out of funds for legal action or that route is exhausted for legal reasons

I got tied to a horrible person like Blair when i was in my early 20s. A bunch of us dumped her finally and thankfully still talked to each other and realized we were pitted against each other. Now theyre my best friends. I hope something positive comes from this for all of them. I hope one day we see a countersue for slander and/or her being arrested for extortion

25:50 to explain to anyone outside the US, when a company "buys your debt" it's not a good thing, it's never a good thing because the customers for debt brokers are agencies known as "debt collector centers" these debt collector agencies buy someones debt for the sole purpose of harassing someone with calls and threatening to garnish their wages, i know about these because of a school loan that had been bought by these agencies, long after the loan was dismissed by a judge due to the school for said loan being forcibly shutdown by the feds, i was a student to said school anyway, TL;DR when an agency buys your debt, that means you've long defaulted on whatever you were paying, and given who we're talking about my money is on Blair intentionally defaulting on everything because "taxation and credit payback is theft"

For the "knowing they were false or recklessly disregarding whether they were true or false when published": This is standard wording as far as I know. It covers the two cases: 1. The statements are false and the person publishing it knew that they are, but published anyways. 2. The statements are false and the person publishing it did not know whether they are true or false, but was reckless by not checking before publishing. As far as I know these are the two prerequisites for defamation.

There’s a bit in Madcaster’s video that people seem to miss - that when Illuminaughti is trying to get Felix the Kitkat to dig up dirt on the Click this happens before he is actually on her official payroll. In the lawsuit she has when he started has an employee noted but the messages happen well before this when he wasn’t under contract. So therefore it’s very questionable whether she can include this in her suit. Also I don’t know if it’s just me but Blair actually gets her tax bill lawsuit then deciding to foreclose on Oz’s house seems a little too coincidental it’s almost as if she expected to bully Oz into unknowingly pay off her debt. As if she’s still trying to financially abuse him but like I said that could just be my suspicious mind.

I used to sell debt portfolios and it's truly a racket. I don't know what state this is but most of the time once the debt is sold it's hard to collect on although these companies will use some pretty shady tactics to make you think they can. I'm in Virginia and I do know in my state once the debt is sold to another collection company they can't sue you for it. The reason being the purchaser of the debt does not get all the records they basically get a spreadsheet with the info but no actual paperwork from that debt. No signed paperwork or bills just basic info. Unless Blair's debt was taken over by a lawyer or its taxes it can't be collected once it's sold.

The defendants should check at a local law clinic to see if the state has an antislapp statute. Those laws can be used to easily dismiss and strike down lawsuits by prominent figures against private citizens if its obvious the claims are frivolous or intended to bankrupt to silence someone

Legal editor here. The thing with defamation suits is they are hard to win because you have to prove, beyond a shadow of a doubt, that they 1. Causes you fiscal harm 2. Were said with Malice & intent to harm 3. ALL statements in the defamation piece were false ... in the USA at least.

“Published or caused to be published” wouldn’t be uncommon to state in this type of case. It’s an element of the tort of defamation, and the element is “Publish, or cause to publish defamatory statements,” so that’s why it’s being stated like that, just legal procedure nothing else. Same with the statement about actual malice that sounded weird, that’s just a legal formality to say.

Letting your taxes get that out of control makes no sense considering that those taxes were due before any of this stuff went down. True, there are people who just don't pay attention to their bills, but I guarantee that she was made aware of this bill multiple times before she was sued for it. Curious as to what kind of tax it was though, since I'm only aware of property taxes and Federal taxes, neither of which to my knowledge is a type of debt that can be bought by a third party.

That happens in England... I had a company fiddling my mobile bill and because it was obvious I didn't owe it I refunded the bill and they sold it... Then that company sold it when I showed them I had proof of fraud and it KEPT GOING... FOR YEARS but nobody could force me to pay as it was all fraudulent 😳

In the United States, defamation requires that: 1) the statements must be false, 2) the person making the statements knew they were false, and 3) the person making the statements made them with a reckless disregard for the truth. Public figures face a higher burden than proving a "reckless disregard for the truth." They must prove the statements were made with "actual malice." Illuminaughtii may not fall in the public figure category, but if she does not dispute the truth of what was stated then her lawsuits can (and should) be dismissed with summary judgement. Colorado has a decent anti-SLAPP law, so she could also be on the hook for paying for everyone's legal bills.
