When Social Security sends you a denial notice - either for your original application or your first appeal you have only 60 days to appeal. If you miss the 60 day deadline, your case will be dismissed!
Or will it?!
In this video, I walk you through the steps you need to take to request a “good cause” EXCEPTION to the 60 day deadline.
Whether you missed the deadline by just a day or two, or by several months, you may be able to keep your case alive by filing a request for good cause for a late filing.
You have to have a reason for missing the deadline - and I give you examples of explanations that have worked for me - but as long as you are not too late, the odds are in your favor.
So, if you missed that 60 day deadline, don’t assume the worse. Follow the directions I provide in this video and avoid dismissal of your disability claim.

I missed my date for the last hearing which was the Federal case. Now Im being told I dont qualify for Disability. Im in need of help. I had a Represenative from SSDC helping me. Right befor the hearing with the Judge she told me that all the things I had been through the past year she had been helping me would not help that the Judge wouldnt even look at it. I need some help. I called a laywer here in NC and they said that I missed my date. So I missed it. If you can help me I would be very greatful

What if the Agency Allsup won't file an appeal I went back to the doctor and had to take a nerve test it is a factor for me having COPD will I have a right to file and see if disability would consider this factor.

I'm in Tennessee I'm waiting on a hearing well today I got a letter from OHO that ask for more medical treatment information to give the ALJ for review for a bench decision is that normal and if I had new doctor's and their addresses and my last three jobs just need your opinion but I have to send it by a code scan they said don't send the original paperwork

Got a question and maybe you might be able to make a video on this. What if you know your disabled enough to not be able to hold down a job say in my case I have a lot of damage to my spine that puts me into extreme pain but not all the time but the pain can last for days to weeks at a time and I would miss a lot of work because of it and a lot of time I have lost jobs and haven’t gotten jobs because of it my doctor has me on a permanent 20 pound restriction. But it still doesn’t help manage pain levels because jest moving itself can set it off and I’m afraid to ask my doctor to put me out of work completely but have mentioned that I was thinking of filling for disability. Would there still be a way to get disability with out the doctors putting you out of work ? My personal issues is I have a lot of herniated disc torn discs spinal stenosis in a few spots arthritis throughout the body I now have rods in my spine i’ve had to have shoulder surgeries one was at work injury. And I’ve also had to have knee surgery. With those issues is it possible to file and get on disability with out the doctors saying to file? I know I had talked to one lawyer a few years ago and wen he asked me about the doctors I said I didn’t talk with them about it directly but I didn’t see them having an issue with helping me file things on there end. But all he would say is talk to all your doctors first. But I have an issue with speaking for my self while seeing my doctors and get too uncomfortable to even bring up the possibility of asking whether or not I should be working. I don’t know what I should do or what I can do my biggest problem is I have my kids to take care of and as much as I want to force myself to work I know it’s only making things worse the more I move. So I was wondering would there be a case and if so how could I file for it and would having a lawyer be my best option to move forward. Even if the one lawyer would not take my case then. Because at this point in my life I can barely do anything with out putting myself into pain. Any way let me know what you think. I know normally you want people to message you on you website but I really don’t want to waste your time if there’s nothing that can be done. Thank you

You're your own worst enemy. You should be telling the doctor's so they are documenting your inability to do things. You should file for disability and point out that doctor's won't give you pain meds anymore. I know if I overdo it when I take pain meds then I overdo it and pinch a nerve or something that makes me not even be able to do anything when taking pain meds. Anyway your doctor's can help you and you cannot be working at all if you want to get on disability. After you get on disability if you are eligible for a able account to save for your retirement then you have to put 100% of any salary into the able account for retirement and you are limited to how much you can work and even if they threaten you trying to get you to keep working then you can't. But you really can't be working at all because a judge looks at if you can hold up for a hour then you can rest and hold up for another hour and so on.

Russell, my experience has been that in back pain cases you need an MRI that shows significant damage in your spine, treatment that follows a standard pattern (start with rest, then physical therapy, then epidurals, then discussion of surgery or pain management). I will also tell you that a 20 lb. lifting restriction is not consistent with severe damage to the back - I would expect to see a 5 to 10 lb. restriction.

@@ssdattorney ok thanks for this message I appreciate it. I also went through everything you mentioned and stopped short of getting my next surgery because it was to expensive at the time. My pain management doctor didn’t want me on a lesser Weight restriction but at that time I refused because of the job I had. it definitely would have ended sooner then it did. in the end that job found a way to let me go a few months after being put on restrictions. So I probably should have jest went with what the doctor was going to put me on.and while I was out of work there was other issues in my home. so I wound up not pushing to go on disability and I decided to try and find a job that has the least amount of lifting and moving. And that is a convenient store near my house which unfortunately pay significantly less. But that is what it is. But hopefully I can push my self through because it’s already hard to stand there at the register. And I’ve only been there 3 days and the pain is increasing day by day again. Any way sorry I went into a bit of a ramble. Thank you for messaging me back take care and have a wonderful week
