Another POSESSIVE property owner loses the argument so they search around for reasons to stop public photography. THE latest thing is to pretend that roads next to their property are private so the drone flyer is not on public land. HOW desperate are they to stop A LEGAL ACTIVITY.

The Legal term is the Public Highway. It is public highway until there is a clearly defined barrier that prevents vehicles or clearly defined signs that are clearly understood by those walking. This is case law used every day by the police. Dr Riachrd Darwood VS Camden Council. court of appeal, The Highest law in our land.

Private road generally means un-adopted by the council, this does not mean private with no access to the public.

So if its a private road does that mean if you had your car on it a and broke traffic laws like no insurance, mot or with zero speed limit. The cops wouldnt do you for anything cause if they did, it would mean its open to the public would it not

1:20 There is no such thing as public land. There is publicly maintained land which will be privately owned. Ideally a drone pilot should stand on that kind of land. However they can stand on private land to fly a drone if it's safer and it's not interfering with the owner or anyone else. So standing a few feet past some imaginary line on the grass verge is not going to interfere with any activity by standing there. Plus it's safer than being on the road. So a grass verge on some minor road with very little traffic is better than on the pavement next to a busy road. But a car park is not a good place to stand since cars can be travelling around it. However, being in an empty carpark of a business with no barriers outside of working hours will be fine, so long as you are near the boundary. It's all about the pilot making a determination as to what's safe.

Interestingly. I’ve just had a call from Avon and Somerset police warning me. If I revisit and fly my drone over this site I could be committing an offence under section 68 of blah blah blah, the manager of the site reckons he has to stop operations if I fly the drone over.. the goons that followed my car on the first visit, obviously took a photo of the numberplate and they’ve tracked me that way.. I do plan on revisiting the area soon anyway, as I need to get footage of the meat factory next door for another KZfaq channel, so I’ll see if I get any bother from the refinery next door then.. All a bit extra from the police for a private firm hey 🧐
