Right it doesn’t make any sense I feel like she should be held accountable she’s 21 years old she knew what she was doing or not doing and now her parents want to sue because they feel like they’re blaming somebody for her death she’s the only one to blame accountability is tough it sucks when you learned at the age of 21 because your parents never taught you

There is now. All the charged lemonade machines are behind the counter and the employees get it for you warning you about the real amount of caffeine. Apparently it's the equivalent to 3.5 cans of red bull. For a large. Which is shocking when you were in there 4 days ago and it was only "about as much caffeine as our dark roast coffee. They put a warning sign right in front of it today.

If the girl was susceptible to illness from caffeine, she shouldn’t have been drinking anything “charged” There are people who’ve been seriously injured by medications who CAN’T sue.

I mean most regular or first time consumers will not think of lemonade as a caffeinated drink. "Charged" could mean a multitude of things, charged with "vitamins, antioxidants, probiotics, sugar, etc". We might be aware of it due to hindsight of this news but it's likely Panera will settle with the family despite having some indications of it being caffeinated.

It says right on the container that holds the drink how much caffeine is in it. Charged can not mean a lot of different things if you open your eyes and read it.

Do people who consume caffeinated beverages actually read the labels on them? Is a layperson supposed to know how many mg of the stuff causes whatever stimulative effect? Yea, the girl bears some responsibility for her actions, but just the same, restaurants need to decide if they're selling beverages or drugs. These "lemonades" supposedly contain way more caffeine than most energy drinks like Redbull and Monster do. If you want a highly caffeinated beverage, you should have to explicitly seek one out, the same way as you would with alcohol. It doesn't help that Panera still sells a regular lemonade and that it wouldn't be hard for an inattentive employee to serve the wrong one, esspecially at the drive thru.

@scarpfish not everyone read the labels/ingredients but a person with heart conditions mostly do but for some reason she took a gamble in life & lost & now the parents want payback.

"charged" is not specific enough, because "jolt" cola also uses a suggestive name, but gives a detailed warning with the exact caffeine content. also, look at the hot coffee lawsuit, where the elderly lady who burned her self almost died and only wanted her medical expenses paid: she won because it was hotter than usual, but there was no warning, which set a precedent. this drink has way more caffeine than you would expect, so should also have a clear warning.

I saw this video on Snapchat where I couldn’t see any comments but I had a feeling that other people felt the way that I did when I heard that they were suing I laughed not on purpose but I laughed because of course they are they have to hold somebody else accountable when in reality it’s them and their daughter that needs to be held accountable because she knew that she shouldn’t of been drinking caffeine and she went ahead and did it anyway so now they want to find somebody to blame when I’m reality is their daughter or them teaching their daughter not to do things like that that didn’t happen so now they want to be angry and upset that somebody when they’re the ones to blame sorry

🤣🤣🤣🤣🤣🤣🤣🤣🤣This sounds about as ridiculous as I think they are that’s so funny this is hilarious it’s not funny but it is funny because they’re just looking for somebody to blame for their daughters death knowing that she had a heart condition and she was 21 years old making her own decisions in life so yeah this sarcasm is hilarious is exactly what I was looking for all the McDonald’s I ever ate… The Burger King the Carl’s a Junior the Starbucks the Chinese food the Mexican food I hope all the places get sued when I pass away because they must’ve had something to do with my death they must be held accountable🤣🤣🤣🤣🤣🤣

Exactly she’s 21 years old she should be held accountable her parents just want to find somebody else to blame because they’re mad that she died which is understandable but they should be mad at their self and their daughter because accountability is tough…And when you learn it in this way it’s even harder so I think they really blame their selves but they can’t do that so they’re suing Panera which is dumb because they’re going to lose there’s no way that it’s their fault that they’re 21-year-old who knew that she shouldn’t be consuming caffeine and did it anyway is going to win this lawsuit

I could see how this was an innocent mistake. Panera should have prominent signs indicating the lemonade has high concentrations of caffeine.

Lemonade is a all-natural energizer from the citrus. Caffeine added and called “charged” instead is like a fakeout. It’s not redbull. It’s a generic additivee that’s sold fountain drink style. Very sad story. My sympathy to the Katz family 🙏💕

Sorry for the family's loss, but PANERA ISN'T CULPABLE! 99.99999% of the population isnt going to die due to caffeine consumption and its the responsibility of those who might die, to know what they're ingesting. Sad, but no check deserved.

The label on the machine clearly states it contains caffeine. The flavor labels attached to the front of each flavor clearly states how much caffeine is in it. No case.

The lawsuit her Parents should be ashamed of Their selves trying to blame someone for their daughters mistakes she needs to be held accountable not Panera bread she knew that she wasn’t supposed to be drinking a lot of caffeine as a 21 year old I think you’re old enough to make decisions and she made a decision that wasn’t good sorry parents but you don’t have anyone to blame but your daughter you cannot blame Panera for selling a drink that your daughter wasn’t supposed to be drinking at the age of 21 years old I can see if she was under age and they sold it to her but she wasn’t so sorry that she died I was unfortunate but pick somebody else to blame

My deepest sympathy for her parents. I also have a heart condition and I can't drink caffeine either. It's my responsibility to be aware of the ingredients in my food and drinks. Even my 4 year old nephew will tell you he is allergic to peanuts and ask if there's nuts in the food if you offer him something. Whatever happened to personal responsibility?

Guaranteed she got the "you know what". She was a student so I am sure they were mandated to get it in order to attend class. Did she have this heart problem before she got "you know what" or did she end up with it as a result of "you know what?" As someone who worked at Panera for several years where I live, you can ask to see the ingredients in anything listed on their menu. Being that this is advertised as "CHARGED LEMONADE" she should have asked a manager to show her how much caffeine was in that drink. They have a binder with all ingredients for everything on the menu including drinks. I am sorry for her passing but I think she was careless regarding how serious her heart issues were to not double check before ordering. Young people don't always use their heads at times so I don't think Panera should be held liable for her mistake. Shame on these parents for using their daughter's passing to get money. Maybe instead of taking Panera to court they could settle with them to either take the drink off the menu or make sure the cashier lets the customer know that this drink is not for people with heart risks. Maybe have Panera give the customer a paper with all ingredients listed and have the customer sign it to show they read it taking it back to the responsibility of the customer so no one can sue Panera. ACCOUNTABILITY is on the customer to ask and to let the cashier know they have such a risk. It should not be on the company because they didn't know the customer's health risks. I am not heartless but tired that we have become a society where blame is put on people who didn't do anything wrong. Panera didn't poison her through something they cooked but rather simply filled an order that the customer placed. It is up to any customer to ASK what is in the food or drink order before ordering.

Actually, per volume it has about the same amount. We're talking a drink 3 times the size of a 12oz can of redbull so that statement is incredibly misleading.

Death is always tragic and I get placing blame is part of the grieving process.... but it was her responsibility alone to know what she's putting into her body. Suing because ignorance got a person killed is embarrassing and trivializes actual negligence. There's no way she didn't know that she was drinking an energy drink. "Charged" lemonade. C'mon. And the lawyer makes it seem she thought she was just drinking lemonade.

At some point consumers have to take responsibility for their choices. It’s “charged” lemonade. The serving size is almost a quart (4 cups). Of course it’s loaded with caffeine and sugar. Knowing she couldn’t have caffeine she could have opted for milk, water or something that specifically states it’s caffeine free. She made a mistake.

Yeah, a mistake shouldn't have killed her. I could have made that mistake because when I order lemonade there is never caffeine in it so I wouldn't have bothered to read the fine print because of my vision loss. The family had every right to sue that restaurant
