DAY 1: Defendant Shanda Vander Ark began exhibiting signs of a panic attack in court as text messages between her and her son, Paul, were read aloud. WARNING: Testimony may be disturbing for some viewers.
Vander Ark, 43, is facing first-degree murder and child abuse charges for the death of her 15-year-old son, Timothy Ferguson, who police found dead and severely malnourished inside the family’s home. Timothy’s older brother Paul, 20, had also been charged days after his mom’s arrest. Together, Vander Ark and her son Paul are accused of a sinister pattern of abuse that may have lasted for years.

What an unbelievably nasty evil woman!! No wonder her older son is scared of her. Poor little Timothy. It is unbearably sad and tragic, to think how he suffered so much. Hopefully the court will lock the vile woman away for the rest of her life. I think maybe the son is also a victim of fear and mind control, but who knows. Listen how she threatens him. I wonder what will happen to him. And who is going to take care of the younger boy? Certainly no one in this lousy family stepped forward to care for Timothy. I hope “Little Man” has a chance to grow and thrive, far away from his mother.

Narcissists always involve the other children in the abuse/torture of the scapegoat. This is the case in every family I've ever seen where there is a controlling, abusive narcissist (and not even where the abuse was this extreme).

The surest way to get an appeal. Panic attacks are a real phycological condition and if she is refused the care based on how you feel about it shows bias and a lack of care to be competent to stand trial.. Not wise.

@@guywebster8018while I agree with you that they still need to render aid just in case it’s real. She couldn’t just spam fake panic attacks over and over to halt the trail. Lol It’s like that guy that ran over a bunch of people at a parade. He became so disruptive in trail that they ended up putting him in another room where he heard everything through a headset. Stunts like this only piss off the jury.

As someone who has and has been diagnosed with panic disorder I know what a panic attack looks and feels like and this isn't a panic attack this is just a way for her to get sympathy and hold up proceedings she wasn't having a panic attack while abusing her son

I've unfortunately had too many panic attacks in my time & this could be real. HOWEVER, I fully believe that it was because she knew how damning this evidence was & was panicking at the thought that she will spend the rest of her life in prison. It definitely wasn't out of remorse.

Hearing this makes me wish this state had capital punishment even if only so that she would have the fear of death for what she has done. That said we have to remember that it is best people like this have a good defense not only because sometimes innocent people are accused, but because you want to ensure a convicted defendant can not make a claim that they had ineffective counsel and drag everyone back into court. I cannot imagine she will get less than a life sentence; so I want her to have a great defense and no hope whatsoever of appeal. I feel sorry for the lawyer tbh; but he is actually performing a service that allows for her to spend the rest of her life in prison. I am sure he knows this too.

Rape - should be death penalty. Abuse, torture of child - should be death penalty. The ONE job government is supposed to do for us they are failing at - protect the law abiding citizens and the innocent. Our society is failing.

Often if you go to trial it can be annoying for the prosecutor so they will offer another plea to avoid the trial. Typically it's a better plea than the one you are offered prior to trial

Narcisssts... Borderlines... Histrionics... Antisocial... Sadistics... All are quite capable of doing this to their own children, but especially the narcissists who chose a scapegoat child as their whipping boy, and anything that goes wrong gets blamed on the family scapegoat. Plus, the narcissist will gaslight all the other children/family members to believe the scapegoat is the problem child, as well, so it tears apart siblings and pits sibling against sibling. This is standard, narcissistic abuse and it happens every single day, only most scapegoats survive it until they can run away.

My cats are very particular with their food. Some days I open a can of food and they do not touched. They also eat dry food. Many times I wanted to not buy the can food, but I have no courage. They will eat one day, then maybe none in the next. Food flavor is kind of difficult to figured out with both of my cats. But like I said, because I do get bored with my food, maybe my cats do as well. I could not denied food for a kid, ever.

I was gutted and in disbelief hearing about this case a couple of days ago. Now watching the trial, I'm horrified. That woman is twisted beyond belief and if her attorney thinks people are going to buy her, "I don't remember any of this" B.S. she is in complete denial, and she shows ZERO remorse as well. I truly hope she gets everything she deserves coming to her. That poor boy and what he suffered, omg. This story is traumatizing!🤬

They're trying to prevent her from successfully appealing. They *have* to take her mindset into account. If not, her and her lawyer will appeal and say "they made me sit through a panic attack, and in doing so they violated my right to effectively assist in my own defense." Literally no one "cares more" about her versus the victim. Set your emotions aside and actually think.

She's a narcissist. Plenty of mothers out there is the world with this same disorder and they beat, abuse, berate their own kids. The worst of them starve their children physically, but all of them starve their children emotionally. They don't like to leave evidence of their abuse that can be photographed, which is why the emotional abuse is the first choice.

The sick thing is that I thought it was normal until I started therapy for some issues I had. In another video from court her lawyer mentioned -more or less- thar Evil Woman had custody when Tim was younger....and after divorce from 1st husband, Evil Woman did NOT have custody. Not until her ex illegally/not through the proper system sent Tim back to her. I really wish it was asked why she was not allowed custody after the divorce. That is usually a telling issue. EVIL.

This could be the reason she did not seek custody, nor apply for disability benefits or take him to a doctor for prescriptions. She never loved him or did anything to nourish his development and growth. There was no enrollment in school. I contend that any prying eyes on her son would have saved him and prevented his death. Her efforts of withholding food led to his being weak, skin and bones appearance, and desperate attempts to get food. The refrigerator was locked, but he somehow got and ate frozen, uncooked food. She may not have locked the freezer. If that food was all I had, like my sister after a power outage lasting days, I would’ve eaten frozen food. If I am not allowed warm baths, I might turn off the water heater. I might rise before my brother and look for food. Thus she used restraints, zip ties, motion detectors ( which are useless unless they are alarmed.) She certainly takes advantage of precise legalese-type definitions. He was thin because HE refused food. Maybe it’s because she special-ordered hot sauce from Jamaica? That’s because he liked hot sauce ( she tried it!) Nooo, SHE has a weak stomach. On bread? When she has brownies? She bears a strong resemblance to a nurse in “One Flew Over the Cuckoo’s Nest.”

The entire purpose of DCS is “family reunification”-and it often flies in the face of what is actually best for the abused and/or neglected children. This is NOT the fault of DCS workers. It **is** the fault of the broken system designed to protect parents and caregivers. Children have absolutely NO RIGHTS in this country. I know because I am a foster parent. The nightmares that children are forced to endure and endure and endure again because the system ***requires*** that family reunification is valued over the safety of the children is appalling and it is common. Kids who have been in DCS custody multiple times before they’re even 3 years old but continually returned to their abusers is not uncommon. If this maniac had not actually murdered her child and DCS took him into custody, it is likely she would eventually have gotten him back in her care, because the system is designed to protect her rights as a parent and not the child. The child has no rights. None. Google it.

@@shoosh222 Yes, that is usually actually what brings on the physical symptoms where people feel they are going to have a heart attack Most people will start breathing faster than usual to a point where they feel they can't breathe. In treatment, in CBT treatment, you need to first taper off the benzos - you are taught that the feeling of panic will rise to its peak and then fall again. The thing is also to take control of breathing - so if you are rapidly breathing you need to learn how to bring it down. Close your eyes or drop them and focus on breathing counting in your head a slow 1,2,3 while breathing in and the same on breathing out. It takes a little practice but the key thing is it is the over breathing that starts making you feel what you feel in a panic attack. Does that help?

My daughter is 10 and she is physically disabled as well as non verbal, she so small that still fits in a crib... it just takes one sound for all of us as a family to run to her side.... I have been dealing with depression for years and have my bad days but even in those bad days it just takes one smile from her to lighten me up and just appreciate the gift that God has given me...I'm not willing to change anything even if i go back.... Its sad to see how a mother can become so stone hearted to creat so much pain for not only one but all of her children to some degree and make life miserable for everyone....sad just sad.😥

the day he died...they both left him in a cold tub with ice from about 2pm (by brother, who left for work when mom got home at 6pm or so) until after 11pm that day.... this teen was austic, nonverbal, and unable to physically move - which I'm sure starvation and abuse worsened. Imagine being forced to stand in extremely uncomfortable poses for many, many hours each day (the "chair"), and to remain in extremely uncomfortable positions in a cold tub (wouldn't allow him to rest his head on the side or even his shoulder), and the fear imbedded that if you move - you are being watched at all times and will be further punished. The mother even tried to get her son to put hot sauce (not a common table one, super hot uncommon one) onto his genitals. It is worse than even starvation... my understanding is starvation, in addition to what you said on the inside (including leading to organ failure), also causes extreme soreness and pains in your muscles (as they "eat away") and at the bones... so that combined with torture posiitions for hours on end... imagine the physical aches and pains? Unbearable torture! No one is pointing that out because it is not obvious for some. The constant anxiety and terror, combined with internal pain and anguish, and external pain and aches...

It is trials like this where every kid who has been abused has an epiphany. Where they say it was not just me, it was not my fault, there are truly evil parents out there. They seemed to have a very enmesched relationship causing emotional incest, which is abuse, but Paul had opportunities to get help & chose not to, because I think he enjoyed control over his younger brother - especially because their mom was so hateful & emotionally distant. I grew up in abuse & parental enmeschment, but never treated my siblings this way - if anything I overcared & thought I had to be the Mom. Paul just reminds me of a Nazi running a concentration camp- "Well, I just followed Hitler's orders" He should have gotten a murder conviction

i think its so important to remember that Timothy did not go quiet into that good night. He STRUGGLED against his abusers. He snuck food when they starved him, he found ways of outsmarting the motion detectors they put on his door and on his body. He was smart. He was determined to live.

The Audacity to defend them selves???I have the GOOD LUCK of caring for 2 most beautiful and handsome special needs children and I can never understand how any sane human being can be so mean and cruel.

So the son, Paul, is on stand now and.....while I hate to say it because, in a heartbreaking way, he is also a victim....he will NOT survive prison! There are too many men in prison for life with nothing to lose who have sons and children at home, that can't reconcile this type of treatment upon a child....even thwarted by instruction of an evil beyond all evils mother! He WILL die in prison at the hands of other inmates unless he is kept solitary at all times. So sad. I pray the mother gets the death penalty! ...and if the death penalty has been abolished in said state wherein this case is being held.....then I'd like to think that this case is a prime situation for...... bringing back.....the death penalty! I believe, that sometimes it IS necessary....to take a life for a life!

The problem is that you almost ALWAYS have at least one or two “holdouts” that absolutely will not convict with a death penalty involved - so they rarely get it anyway!

@@charrielyn1231 so true, religous zelots often pretend to be DP qualified, deliberately come onto jury in DP case to 'save a soul'. Burgos-aviles trial literaly made me mad.

Wow, a complete monster. And to do this to the other child. She’s so obsessed with him taking food. She has multiple issues. She sounds like she wanted to be a prison guard, not a mom. I hope she suffers the consequences. Maybe don’t feed her in prison and see how he suffered hunger for a while.
