The plaintiff says he hired the defendant’s company to inspect a house he was purchasing. The defendant gave the plaintiff a report saying everything in the house was up to code. But that wasn’t true. A plumber told him he had a big problem and needed to replace all the pipes. Now the plaintiff is suing the defendant for the cost of the new pipes and installation. The defendant argues that he runs a reputable company and thinks a rogue plumber ripped the plaintiff off and is passing the blame onto him.

I feel sorry for the plaintiff because that inspector did fail to go the extra mile and do the job properly. Which is why the inspector has a contract that basically says I cannot be held accountable for virtually everything, but if I do F up I am only going to pay a max of $320. What an immoral contract, but still legal, and the plaintiff signed it. The worst, however, is the seller of the house. If the water pipe is a length of glorified garden hose, I would hate to think whatever other sub-standard things are hidden in that house. Plumbing can just get things wet, but substandard electrical wiring can burn a house down.

That's an irrigation flex pipe cpvc fitting. That should never be used for standing pressure. All standing pressure should be rigid schedule 40 or better.

I feel really bad for the plaintiff, the defendant tried to say in the beginning that those particular pipes weren't visible basically implying that they didn't go under the crawl space but then as the judge kept talking to him he shows pictures that show the exact opposite their inspectors did go under the house whether it was with a extended camera or they actually crawled under there they should have seen those pipes, had the plaintiff called them back out and given them a chance to rectify the problem and they still couldn't rectify the problem he would have gotten his money back, that's why even though it might take a couple of minutes or longer to read an extremely long contract you need to read everything that you're signing! After watching these judge shows for many many years I am extremely cautious when signing anything and thoroughly read everything before signing, the plaintiff seems like somebody who would have read the entire contract I'm wondering if maybe he just forgot.

I agree. But the problem is that NO home inspection, no matter how thorough, is going to catch EVERY little potential problem in a home; the point is to make the prospective buyer aware of the MAJOR issues. If every home buyer can come after their inspector for the TOTAL cost of repair for EVERYTHING an inspector missed or didn't emphasize the severity of MONTHS later (instead of notifying the inspection company within 10 days and giving them a chance to cure it, as the contract stipulates) can you imagine the precedent that would set? There would be no home inspectors anymore (or it would cost > $10K to get an inspection!) Furthermore, the measure of the plaintiff's damages ISN'T the cost of repair; it's the amount he would've negotiated off the purchase price if he had that information in the inspector's report (which could be NOTHING, depending on the seller and any other offers). In any event, it isn't quantifiable.

I like Judge Millian but she gets things so wrong, pretty often. Judge Judy is so much more thorough - where I find Judge Milian is more interested in going thru litigants cell phones and being nosey.

Idk about this one. My inspector noted about a possible plumbing issue. My inspector tested everything. He was very thorough.

The plaintiff is expecting too much of an inspection. It's an inspection, not a warranty. No inspection company is going to contract for you to hold them liable for things they don't catch. You are only ever going to be able to get them for gross negligence. This was not that.

I have had a similar problem with a building inspection. When I talked with the inspector during the inspection, he didn't seem to know basic building methods. In his report I already knew of of obvious problems he missed, some of them could be clearly seen in his photo's? Many of these so called inspections are a scam and contracts that have so many total liability avoidance clauses should not be legal. Ordinary people cannot be expected to read long detailed legalize contracts and courts should know this. It is not really a contract if I say I will do something in the first page and then pages later say I wont.

I disagree with the judge. That contract sounded so sketchy, and if I paid someone to inspect my house - I don’t care how many things they got right - if they cost me $3500 for something they missed - they should pay it. 100% period.

If you don't agree with the terms of the contract, then go on to a different supplier whose contract you're okay with, rather than signing the contract. You don't get to disagree with the contract, later, as this guy is trying to do. When you say "I disagree with the judge", you're saying the judge should ignore the contract, which generally requires some form of deceit. Absent that, the judge follows the law, which in this case, is the contract.

@@newsflash7609 I take it you’re not familiar with the court of law. The judge can find exemption with whatever they so please, and she has voided contracts hundreds of times on this show - so consistency in the courtroom is mandatory

CPVC is not needed for the water line to the house. CPVC is for pipes INSIDE the house and for HOT water.

People in Florida need to find out what company this is and definitely not.use them. I find it interesting that the owner didn't want to use his company's name! It would have been free advertising for him, just not the kind of advertising he wanted.. This company definitely failed to do their job correctly!

Audience member immediately to the right side of the plaintiff has to be a professional audience member or a staff member filling in an empty seat. I've seen him in over 39 episodes in the background. I hope he gets paid well :)

I've always believed they must hire actors to fill the seats. That guy in particular is a regular! As a aside, I love your channel! I've wanted to start knitting left-handed for a while but figuring out the increases and decrease and how to mirror everything was a little beyond me. I think everyone AND the judge are missing the main point, it clearly states in the report that there was a leak under the bathroom, it doesn't matter what sort of plastic piping was leaking, the leak already existed, so the buyer knew then that there was a problem and he bought as is and so he had to repair a leak he knew about, end of case...

I agree! He’s a jerk and his company dropped the ball but the contract saved his bacon. The inspection company clearly missed a major problem but the contract was written so as to absolve them of any fault short of intentionally burning the house down. I feel badly for the plaintiff. Morally, he’s right but legally he loses.

I love Judge Marilyn but sometimes she annoys me. I don’t get why she was rushing the plaintiff and getting irritated with him when he’s clearly older, nervous, and it’s not filmed live and can be edited. She gets hostile with the wrong people a lot of the time

The judge is WRONG. The water was leaking....what is homeowners to do? Fix it now or wait until the inspection company comes back out? That inspection company is useless.

I don't think that was the case here at all, the defendants inspectors truly did miss seeing those pipes, those particular pipes that they missed should not be used under that type of pressure, so rather than just having him fix those particular pipes they suggested he replaced all the plumbing which cost him more money than was needed I think he just wants the money that he put out for no reason because of their mistake, unfortunately he signed a contract that says he has to give them notice within 10 days to come back and rectify the problem had he done that and they still couldn't rectify the problem it would be a slam dunk and he would get his money back, I truly feel bad for the plaintiff he was screwed.

Judges do that though. My daughter went to court a few days ago, custody hearing, and the judge was getting pissed at my daughter's ex husband. Judges are humans too and it's hard to hide your emotions 24/7. And no you can not always tell a person's breeding. That's a ridiculous comment.

Only way I can see this guy (plaintiff) getting this over the top upset about this is more than likely because he's going to rent the place out, typically there's extremely strict codes they have to go by with a rental house, sometimes crazy unrealistic codes. He probably can't rent the place out with that kind of piping & is looking to recoup money for the repair he had to do in order to get the place up to code. He's old, he's probably the landlord & couldn't get the place up to code, period end of story.

most new homes are built with cheap materials, might be uneventful for the first few years but that's about all you'll get out of it before the problems start. Just big gigantic tinderboxes, that's all they are anymore, any fireman will tell you this.
