Supreme Court Grants Cities Power to Enforce Outdoor Homeless Sleeping Bans

The Supreme Court has ruled 6-3 allowing cities to enforce bans on homeless people sleeping outside, even if shelter space is lacking. This decision overturns a Ninth Circuit ruling and grants cities greater control over managing homeless encampments. Critics argue this criminalizes homelessness, but proponents assert it's necessary to maintain public safety and order. The ruling is seen as a victory for cities like Seattle and Los Angeles, where homelessness has surged. Advocates for the homeless worry this will worsen the crisis, but supporters believe it will deter drug use and other illegal activities prevalent in encampments. This decision underscores the need for cities to find balanced solutions that address both public safety and the needs of the homeless population.

We have to appreciate the ironies in this case. Blue cities mayors and governors are applauding this 6-3 decision thanks to conservative judges while the three DEI appointees were fuming. Why we got here was because the 9th circus made a terrible ruling in the Idaho case. Years later, the 9th circus issued a memo to their SF employees to work from home because the federal courthouse is unsafe due to all the drug addicts camping outside their front door. At the same time, the blue cities and states use the 9th circus decision as an excuse for not doing their job until the APEC summit proved drug addict removal can magically be done when their Chinese overlord comes for a visit with no negative impact to budgets.

Just think how much less it would cost taxpayers, and how fewer homeless would be living rough on the streets if there were 3 choices 1. The men’s or women’s homeless dormitory or family apartment with drug testing required, inspections, curfew, and requirements to keep themselves, their areas clean, and contribute to the work of cleaning, cooking, and maintaining the house. And be polite and civil to each other and staff. 2. Leave 3. Jail. If we the tax payers are paying for their housing, we have every right to ensure its safety, pleasantness, cleanliness, efficiency, and make the rules. What they have allowed and funded more of isn’t being kind, it’s incredibly cruel, and harmful to not only the homeless, but everyone living there.

As you noted, the issue isn't the necessity of a place to sleep and that shouldn't be how they are ticketed or arrested for. It should be for creating a public health hazard, for illegal drug sales and use, prostitution, etc. If cities use the real issues for clearing these places they will have no problems in court. Gov. Little in Idaho has already won that. It's a "lifestyle" issue and that issue involves a lot of criminality. Don't allow the criminality.

Also, a sidewalk is built and maintained for the public to use as a sidewalk, if people are camping on it, the public that pays for it can’t use it as a sidewalk. Same for public parks. It’s a park for the public to use as a park, not someone’s private tent space.

I think its a good ruling because it gives cities the ability to deal with the encampments through legal laws without constantly being hassled by the courts. I think some laws are too inhumane, targeting people who need to rest outside since they have no other options, it should be dealt with through changing the laws. It shouldn't be dealt with through the courts. To ReasonableNews, homelessness is partly structural. and not all the fault of those homeless. They're not all drug addicts. There's not enough shelters period, all spots are occupied, newly homeless want shelter over being outside because its dangerous. Many really got lost in the cracks, been outside/homeless too long, and don't know how to rejoin society, lacking basic skill to get jobs, and even getting jobs, lacking a way to even afford to live on income. This is from experience.

In this Subject of homelessness, NOT ALL HOMELESS PEOPLE ARE THE SAME WITH THE SAME LIFE PROBLEMS. There are so many variables to being homeless or becoming homeless. Especially in these hard times. You know, the homeless brought this on themselves by not policing the encampments and letting things get trashed. At some point it becomes a health issue where the city has to do a clean up. Had the supreme court not ruled this way, what would stop the homeless setting up camps in everyone's yards or government buildings? Our local city finally moved the homeless off a very popular bike trail that we use all the time. So nice now.

Slowly we will get back to people being housed in facilities that are able to push humans to get actual treatment or mental health services.....and then the abusive actions will start from poor management and poor financing. It does make a certain bit of sense though...the idea that if they had easy access to clean needles, they wouldn't need to share them and spread blood-borne diseases, which is a public health good offsetting the cost. I was for it at one time. The problem with that whole line of thinking is the assumption that people who inject drugs are rational, responsible people, and that they would properly dispose of or return the needles when done. That's not what we see in the real world, instead we just get more bio-hazards among their typical litter.

I’m ok with this as homeless problems have to be addressed. Have they figured a solution or thought this all the way through? If you arrest them and jail then they are housed. It just needs to be done cheap or it will be a burden to tax payers. I don’t believe spending billions on houses is the answer as it will breed laziness

intresting never knew that citys were not sweeping were i live my city has many city ordancens and local city laws one of wich makes homlessness styraight up illigal regardless of what it is you go to jail for it or get heafty fines. its also illigal to live with anyone your not directly related to i knew someone who as kicked out of a freinds house cus the police showed up due to a neighboring incident and they grabbed everyone id and when they asked them if they were related and they said no the cop dragged them out and said you cant be in somone else's house unless your family. initaly i thought itw as bogus tell i looked up the city ordences and local laws and yea it was written right in there

You sure like to talk about majorities and how most are REALLY like so. Yet you never cite percentages or sources. Go there at midnight? Try living it for a few months. You have to sleep. Run your sweeps all you want, those men will still be sleeping somewhere. You need to cope with that reality. If you dont have shelter, or your "shelter" is so nightmarish that no one will go, sweeps exist only to harass and solve nothing.

There must be provided to the homeless, some legal place to be destitute, you just can make living itself illegal.

Poor farms. But activists and modern homeless hate these because they can't lay about, do drugs, drink, and behave badly. It's almost like all of this is a war on responsibility.

@@kellybrandon1179 Yep. You think they would be flocking there, but they aren't. There's a reason that they set up their campsites in the city and not way out in the woods. It's because of access to all the free stuff. They could panhandle all day long by a mountain stream and get nothing....they have to go to the cities for the bleeding hearts and stupid politicians to support them the way they want to be supported.
