What are The TPS to Green Card 2021 possibilities? Is potential success a fact or pure fiction?
(Spoiler alert: For information on TPS paths to permanent residence, see: • TPS To Permanent Resid... )
Is there a possibility for Temporary Protected Status beneficiaries to still win permanent residence after the Supreme Court ruling in June?
Yes, winning a green card for TPS holders is still an option for many recipients, if they can meet the requirements for other immigration programs.
In short, their pathway to green cards has been clearer, though more difficult, with the High Court's recent decision.
The legal road map to move TPS holders to green card status will have a more immediate impact on immigrants who formerly had TPS Honduras, TPS Nepal, and Temporary Protected Status El Salvador grants, because those nations are still under review for re-designation of Temporary Protected Status.
However, even immigrants from countries with current grants, like TPS Haiti, TPS Syria, and TPS Somalia can benefit from pursuing these other options to legalize their status. Winning a TPS Visa is a reality.
Plus, for those from the newer two countries, TPS Venezuela and TPS Burma, it would be wise to look forward now, rather than wait until their time on the government's chopping board arrives.
Options for all TPS beneficiaries, past or present, include adjustment of status, cancellation of removal, asylum, violence against women act (VAWA), U Visas, and I-601 hardship waivers.
A problem exists with Immigration TPS News today because much of the reporting misleads potential green card candidates to think the sky is falling and permanent residence is beyond reach.
On the other hand, new stories regarding USCIS TPS Advance Parole policy are too optimistic and, hence, likewise misguided. Using advance parole to obtain a special travel document in hopes of qualifying for adjustment of status is a foolish, foolish move for most immigrants.
TPS adjustment of status is possible. But to get a green card, risky game-playing with an advance parole travel document should be avoided or one risks charges of immigration fraud.
