My first thought - while running on very little sleep and watching my mind go to strange places - is imagining your hands as puppets as you speak. Then I wonder if Carlsen wants to erase all traces of the system from the internet and used a copyright claim to force the video to be taken down. I would expect copyright notices on anything he and other people involved have any control over if I am right and if he can find all of the KZfaq channels and other accounts sharing info. ...and if you said this already, sorry. Short term memory is kinda shot at the moment too.

The 10-14 days is the time the claimant legally has to respond to a counter DMCA-notice, which you filed. If they don't respond by escalating it (by means of lawsuit), it will be o for the website provider, KZfaq, to upload it again without legal action to them.

Unfortunately, copyright disputes are mostly handled by the person claiming copyright. In many instances, if you fight a copyright claim, the only person who can say "oh, you're right, this is fair use" is the person who filed the copyright claim in the first place.

Man, I was thinking about making a video on the whole RetroVGS disaster and out of the whole bunch it was Carlsen I wanted to go easy on. I read an interview with him about the whole thing and he seemed like an OK guy who jumped ship as soon as he understood what was happening. This however is a huge dick move and makes him look real bad.

In the Retrogamingmagazine article, Carlsen claimed Kennedy put him up to this video (Kennedy had previously claimed it was 100% Carlsen's idea). Calrsen could have just owned up to it and stuck with _that_ story, but instead something in his mind values IP and legal action. At the very least, as a human being he could have simply contacted you first.

This is late, but this is how the KZfaq DMCA process is supposed to work. Someone claims your video, then if you counter-claim, the person who claims has 10-14 days to file in court, but if they don't, the video goes back up. That's not unusual at all. That's the default KZfaq process.

That sucks. I'm not really too surprised though, since that video does make Carlsen look very bad, especially to people that are unfamiliar with the VGS saga. Hope you get to put the video back up and the strike is removed.

That is pure horse shit that this is even a possible outcome on KZfaq. I have a hard time believing that it is in fact possible to criticize the actions of another person and then receive a copyright strike. It's scummy and goes against free speech.

You should have seen this coming, though. This really has been a dumpster fire of a situation and it has painted the people involved in a very negative light, as you stated. By simply re-uploading the video in its entirety, you left yourself open to this. You could have avoided it by editing in some commentary, which would have broken up the video and put you safely in the fair use category. Yes, you would probably still be dealing with this since Carlsen wants to scrub himself clean, but you would have easily won in an actual legal dispute if you had taken the time to prepare the whole thing in a more fair use friendly package.
