This judge presided over the murder trial of a man who killed his autistic son and reported him missing. This judge is very calm and level headed. Like him a lot.

First, Mike I love you and your channel! Secondly, it is absolutely DISGRACEFUL of this prosecutor to essentially BULLY this man's mother and aunt. I am still watching and I'm wondering why(that I am aware)the inmate's statement has not been challenged for his honesty. Again, I am still watching. But shame on that man. The kid, from what I am hearing, has not tried to deny this at all. I'm sorry, just shaking my head over here.

The person who said the prosecutor is upset about this being a homosexual ‘relationship’ is 100% right. If they had not been the same gender, he wouldn’t have tortured his family that way. I also think the prosecutor is lucky that he didn’t have to try this case in front of a jury. Because I hate when people use a position of power to garnet sexual favor from someone but his mother and aunt would have made me feel much more lenient toward the defendant.

@@LawTalkWithMike and I would submit that the evidence of my assertion is that the prosecutor neglected to even mention the single greatest aggravating factor (IMO). The judge is the one who told us the victim was on suicide watch so he wasn’t even just vulnerable because of the power imbalance but also because of his mental state.

@@jenniferbrinks6552 omg, you're right! To me, this forgotten detail SHOWS he's not even upset on the victim's behalf. To me, the fact that inmate was on suicide watch was THE most important factor aggravating factor (besides the power difference inherent to prisoner-guard relationship). It wasn't a case of the prosecutor feeling deep empathy for the victim. Very unprofessional and rather disturbing.

Big harm, big foul... The defendant has already pled guilty and is taking whatever lumps the state has doled out. I can't for the life of me figure out why the prosecutor felt the need to torture the mother and aunt with those questions. Did he think they were going to say 'you're right; he shouldn't be in a diversion program??' So unnecessary... Thanks, Mike - this was heavy, but very interesting...

I put the blame on the defense attorney. If momma and auntie are led to believe that all their 28 year old baby boy did was steal a little kiss, and he let them give their statements based on that belief, that's on the defendant and his lawyer. I don't mind the prosecutor setting them straight.

@@TeddMaxfield I respect that we have differing opinions on the subject, so please don’t take this as a personal attack. I don’t feel like setting mom and auntie straight in open court had any purpose other than trying to sour their relationship with Jackson. We don’t know for absolute certainty who’s version of events are true, just that Jackson took a plea that kept him out of prison. He plead guilty to his own version of events, which satisfied the courts finding of guilt

I don't get why no one is stopping the prosecuting attorney during his bizarre meltdown there. Wouldn't some of this easily fall under asked and answered or something to the effect? He's already asked her opinion about the ethical/legal/moral standing of the behavior. I'm glad you spoke up about it because it was really weirding me out.

Watching Mom sob, broke my heart and I found myself wishing he would get diversion for her sake. I can't imagine her pain, shame, and guilt. I hate what the attorney did to her. But after listening to the judge, I totally changed my mind about the diversion. Especially if inmate was on suicide watch. The judge proved there was a classy way to handle it. As did you Mike. I appreciate your thoughts.

When my husband started his career as a CO (Corrections Officer) 30+ years ago, an officer had been charged and convicted for having relations with inmates, it was still going through the court system at the time. He was quite a bit older than the officer in this case, and while I have great empathy for his mama and aunty, it isn't just the issue between the inmate and officer it has wider implications within the facility. The offending officers are now vulernable to blackmail, which puts all the officers lives at risk. I believe that the officer may have felt he couldn't be his authentic self at that point, the entire incident is truly sad and unfortunate. BTW, officers here are not allowed to have their cellphones at work.

I agree with you Mike. Most of the questions posed to the mother should not have been asked. I was surprised that nobody, including the judge, objected to that line of questioning.

Whether you dislike the Prosecutor or not, the bottom line is he makes a Justifiable case of Risk. There is NO crime for being unethical specific to this case, other then the Corrections Officer actions of violating a higher code of conduct and trust. I don't agree with Prosecution tactics, but I understand he has a job to do as a representative of the People. BTW, I agree the Judge should grant Judical Diversion. But, does this mean everyone who is the same as this Correctiions Officer should be granted the same? 🙁☹😕😞😟😒😯😌

This prosecutor is obviously against homosexuality and LGBTQ rights and is holding his personal ideals and morality against this defendant. It is just seeping out of him. Absolutely disgusting what he just put the aunt and wife through.

Anyone being harsh and or unsympathetic by questioning the family members of this Defendant does not mean he is outright against anyone's rights. Everyone does NOT agrees with LGBT🏳️‍🌈 🏳🏳️‍🌈💯❤👍🇺🇸 justifiable cause and fight and doing so does not all the the time reflect racism or bigotry. This was a very graphic case that represents certain truths that was admitted to...i.e., the inmate was on SUICIDE WATCH!!!!!!!!!!! and it occurred more then once and probably would have continued if he wasn't caught. Lets stop letting our feelings unbalance TRUTH & OBJECTIVITY.

Being a prison guard can be such a bad job that it’s very hard to find quality people that want the job. The same is happening for the police.

Darrell Brooks trial is craziness. His objections are ridiculous! He keeps saying the grounds are hearsay when he obviously doesn't know what that word means.

The guard and the prisoner...what a case! In the end when the judge made his decision and laid out the facts, every thing became clear. I was absolutely on board with the judges decision. There were so many facts that were left out until the judge spoke. Before that everyone tip-toed among the tulips around the real implications of the case.

@@lorame4787 There's always two sides, but once the judge said that the prisoner was on suicide watch and the guard would give him things and then ask "what do I get in return", the whole dynamics of who had the power and whether it was consensual or not became too gray to determine if the prisoner felt he had to cooperate or was actually having a consensual relationship. It came down to who had the power. The guard did.

Work in one of these institutions with these people. I did. I had a fellow officer get played by an inmate. She lost her job, her self respect, her pension. This job has one of the highest suicide rates of any job.

Too many people lack empathy for this victim and I'm guessing it's cuz he was an inmate. Do we even know if he was guilty of whatever he was in there for? It was a jail, idk the case but unless sentence this victim was innocent (until proven guilty) idk its sad. Consensual or not it was a severe crime

I would certainly argue that an inmate of a correctional facility has the potential to be a vulnerable adult, should a predatory person be allowed to be in position of power.

To me, the fact that the Judge highlighted the power dynamic at play is outstanding. Sexual coercion is almost NEVER about sex. It's always about power and the abuse of that power. I'm also glad the judge explicitly refused to distinguish between victims based on gender. There are sexual offenders who are probably very worthy candidates for diversion and treatment instead of punishment. This guy ain't one of them.

Ok. The CO stepped way over the line. He was fired. He pled guilty of the charges. Leave his family alone, the DA and defense attorney are bringing more suffering to these family members, enough. Let the judge sentence him so the family can try heal and move on. Hearing his mother cry is heart wrenching.!!!

What the hell was the purpose of having his Aunt and especially his Mother testify? The guy is not a juvenile. This was the most cruel and despicable exhibition I've ever seen. That prosecutor should be ordered to have a psychological examination. I bet he tortured small animals when he was young. Just disgusting.

They were character witnesses. Character witnesses are often brought in by the defense - especially when it comes to diversion.

It depends on what they're there for. Some inmates use it as a way to get closer to officers or to get away from someone bullying them in the pods/cell areas. Some have holds put on them. "Suicide" watch isn't always used for inmates who are suicidal. I was cooking breakfast and I'm only halfway through this video, but I'm just speaking generally. It might not apply to this case, but not all of the suicide watch inmates are suicidal.

Wow clicked on this not knowing that Judge Wolfe would ever make one of these. He is a judge in 5 counties in Middle TN one of which I live in. He is a very nice guy in real life. I have actually sat on a murder trial he was a judge of. He has had some pretty sad cases over the past 2 years. One was an officer that was married to a good friend of mine. Was ambushed by a meth head and shot 13 times and killed. Another was a father that killed his autistic son that was my youngest sons friend. My son also has autism and it’s sad they have never found his body. Very good Judge.

He should get the book thrown at him. Even if consensual, the power dynamic of jailor to the jailed causes consent issues. Not only that, he provided cell phone to the inmate to look at porn. The inmate could have used this cellphone to contact/harass his victims, or other crimes. He also cheated on his partner to do so. Being in his late 20's, working for a police department, he is to be held a higher standard than the common folk. He absolutely knew this was wrong and did it anyway. He deserves to suffer consequences for his actions for the rest of his life. Sex crimes need to be taken as seriously as murder.

They can be absolutely vicious. I went through a trial and it was more traumatic than the event. If I ever get put through anything again I will take it to the chin.

That prosecutor is horrible. My heart aches for this family. Berating his family is not helping. The prosecutor is punishing his family. Breaks my heart. That judge was awesome.

"yes we expect a little better conduct" wtf?! The Aunt and mother did not need to be on the stand, simple written statements about previous good behaviour would have sufficed. That was torturous to witness the repeated line of questioning they were subjected to and frankly unprofessional. I'm surprised that the Judge allowed it to continue. I am glad that the Judge was at least logical, professional and well researched in the legislation. Definitely awful conduct from the attorneys 😬

Any human regardless of status is capable of a lapse of judgement and taken over by animal instinct But having empathy does not exempt the need for prosecution. The empathy can come in during sentencing. In this case the victim may have manipulated the defendents and have a macavalian personality. Crimes need prosecuting to uphold law and order.

This hit close to home when watching this one. We had one here local that received 42 months in prison with five years of community control and is now a Tier III registered sex offender. The "victim" tried to hang themself after finding out about the indictment. That person has since been sentenced to 15 years for the crime they committed. The "abuser" is just now trying to get their life back together and get a job but it has been hard for them and comments are being made where they are currently a temp employee. I have a hard time with the terms abuser and victim in this because even though the position of power was abused, the victim was very good at convincing this person that they were going to be together once out of jail. This person deserved the jail time and the community control but I just can't wrap my head around the registered offender stuff. I keep going back and forth on my thoughts about that.

When someone admits guilt in order to achieve some special treatment in a Plea Bargain, yet not only continuously refuses to admit the totality of their Crime, but down plays their role-& in this case actually lied to his Mother swearing he didn't do anything more than kiss-& avoids testifying on his own behalf where he could be subjected to questions demanding the Truth or face Perjury; it is impossible for me to believe the person realizes & accepts the inappropriateness of their behavior to the extent where they are assured to not reoffend. Instances where a person 'takes advantage' of a subordinate in a solitary lapse of judgment shows a lack of character & maybe it could be enough of a wake up call for them to reevaluate their moral & ethical applications in real life; but when that behavior is an ongoing & frequent event, that would indicate a serious defect in the person &, IMO, the likelihood of them behaving in the same manner any time they find themselves in a Power Position is extremely high! Anytime a similar non-voluntary dynamic exists (such as LEO, CO, Teachers, etc) there should never be an equivocation of their guilt. As to the Prosecutor's questioning of Mother & Aunt: yes, it seemed highly offensive; but I can't help wondering if he was going for the Perry Mason moment where Jackson felt so shameful of what he was subjecting to his family all b/c he didn't have the courage to defend himself & consequently he would jump up & scream that he'll take the stand! Probably no, but more likely just an act of retaliation at Jackson's cowardice & to drill home the the family that Jackson lied to them & they need to take positive steps to keep him on the straight (so to speak) & narrow.

I watch judge Wolfe a lot. He runs a tight ship and doesn’t put up with anything in his courtroom. He’s always stern but fair. If I ever get the wild urge to do a crime I’ll go to his county in Tennessee I think. Lol

I'll never understand how the "goes to church" is still proposed as a legal argument. There's plenty of people that grow up religious that go on to commit crimes. There's plenty of non-religious people that go on to make huge, productive strides in society. No disrespect to the religious, but that doesn't excuse bad behavior. Religious doesn't always mean law-abiding, and non-religious doesn't always mean hedonistic. 🤷‍♂️

Regarding the “Hard-R-Assessment” resulting in a Moderate due to a high score of aggression, it does make sense. Offenses like these are usually due to high impulsivity, or in other words, a volatile state of readiness. Anger is linked in the brain with a high “state of readiness”. We, as humans when angry are just about ready to do anything to alleviate whatever is causing the anger or aggression. See if you realize this next time someone or something makes you angry. It’s fascinating.
