The plaintiff says she was looking for office space for her chiropractic business and she gave the defendant a deposit. He’s refusing to return it, so she’s suing. The defendant insists the plaintiff knew full well that the deposit was non-refundable because she signed a contract.

He's 100% correct..tenant is responsible to read the lease. She should've asked to discuss the entire lease if that's what she wanted. The best thing she could've done is have lawyer look at it before signing. She's dumb and so r u

Always ask for a copy of the lease before putting a deposit down. If they refuse, then it's most likely because the lease will be more in their favor and may even have terms that are illegal.

"There's no way to discuss every little thing." - Well, that is the reason you make a prewritten template lease with all details, except for who will lease it. This template you send/share before any deposits are made, so that it can be negotiated and both parties know everything before any agreements is made and money for deposit made.

I am glad the plaintiff won. If there is anything that should be paramount in a lease is the amount of the deposit and whether or not it is refundable. You don't have to be a lawyer to know this. Too much ambiguity will have people losing lawsuits right and left.

I can understand paying for your water usage, but not for repairing things like plumbing. Tenants do not own the property, so they should not be responsible for major repairs. They have no ownership interest in it.

He absolutely wrote "nonrefundable" AFTER the fact! You can tell bc it's Hand Written and off to the side! Plus, he's a liar and a scammer. The fact this "judge" told him how to legally get away with scamming more ppl is absolutely disgusting.

The defendant didn't disclose all the necessary information to the plantiff beforehand which to me is the reason he lost this case.

Defendant is a conman. And I am not sure why JM is saying that she's not buying that he added - nonrefundable - when she just said that it's assumed that it's non-refundable. If the guy didn't add it after the fact, why wasn't it typed up in the lease to begin with? Answer - He's a conman - because it's assumed to be nonrefundable! He wrote it in because he never disclosed the fact that he was going to stick on taxes, water bill, repairs, etc

The plaintiff acknowledged seeing it written but still proceeded to deal with him. That in itself is consent. She didn't back out because of the deposit she backed out because she was responsible for everything. If it was based on the deposit alone I don't think she would have gotten it back because she knew he put it here and carried on with the lease. It didn't sound like she objected after she saw it

Maybe I didn't verbalize myself properly? My point - He's a conman and writing non-refundable proves that he was planning on keeping her deposit, knowing that she was going to back out after a lawyer told her that it wasn't a fair deal because he didn't disclose all of the information about her responsibility towards expenses other than rent.

This is standard for commercial rentals that lawyer wasn’t a commercial re lawyer and she doesn’t know what the hell is going on

I think it's fair. To the defendants point, he can't text everything on the lease. Text messages is not the best way to do business IMO. She should be able to have the lease quickly (2 full business days) vetted before signing the lease/sublease. If it were me, I would simply present a smaller, consolidated version on "an application" document and/or better yet, include the entire sub-lease on that document to be totally safe and avoid confusion. Then he can collect the $250 until she or a more qualified person can provide their opinion on the document. I've read many contracts. In most cases, you really just need common sense. This one was very straight forward. On the application document that she signs with the application fee, it should state... "I HAVE BEEN GIVEN TIME TO READ THIS (ALL 6 PAGES) IN ITS ENTIRITY INCLUDING ALL THE TERMS OF THE SUBLEASE WHICH I MAY OR MAY NOT CHOSE TO SIGN WITHIN TWO BUSINESS DAYS (DAY 1 STARTS TOMORROW.) I HERBY AGREE THAT WE HAVE A MEETING OF THE MINDS. I UNDERSTAND THAT THIS $250 APPLICATION FEE IS 100% NON-REFUNDABLE UNDER ANY CIRCUMSTANCES." Had he done very simple step, he would have won. I believe that her lawyer made her paranoid but he wanted to justify his/her fee. It's a commercial space. She likely would have been fine. Most leases are not great and many make you commit for 10 years! The increases were also likely less than the rate of inflation. This lease really didn't look too bad to me. The landlord looks like a decent guy to- not shady. Just a businessman and probably an honest one. I got a good vibe from this gentleman.

If one thing should have stemmed from the pandemic and masking, is the issue over the rights customers have in business establishments, as opposed to those of the owner. It astounded me in videos I watched, how some members of the public assumed they could dictate to the owner of a business, or their employees, how the issue was going to be handled. Did not take long for them to get a quick lesson regarding the issue!

I believe him when he says he did tell her in advance that it was a sublease, I think she was excited and didnt fully realize what a sublease was until her lawyer explained it to her, I think she should have shown her copy compared to his and if she signed the same one I don't think she should have got a refund on the deposit.

If the defendant is sub-letting it, he should have to provide a copy of his own lease to the judge so that we can see if he is doing something fraudulent to the plaintiff, with the price he is asking, for repairs that he should be responsible for etc.. and also does he even have the right to sub-let? But the bit I really didn't like was when the judge called the plaintiff a liar by saying that 'no way did he write 'non refundable' AFTER she had signed it', then promptly awarded her the deposit back. At 2:51 if it was typed in the contract then so be it, but to be handwritten, then that is totally believable that it was written afterwards, because for it to be handwritten means that sometimes he leaves it blank because the deposit IS refundable, (yeah right!)...

I work in commercial property. Yes, in storefront building/property the tenant is responsible for all repairs. When we write up a lease it's clear the tenant will be held responsible for all items listed in the lease... The only items that the company is responsible for are the structure and the roof of the building. That's why the rent for an office building space at $45sq feet compare to a storefront at $30sq feet, that's normal.

Go to one that has a kinesiology degree! Huge difference! My husband was waiting for surgery for a degenerative discs problem 5 discs were out of place and resting on his spinal column. The kinesiology, Dr Teresa Pigott, Oakland County, Michigan. Was actually able to make him comfortable (he had to go every few days) until they could operate. He would walk in bent over and walk out straight and with a smile!
