As explained in Part 1, most immigrants think because they have never married their partner, they are ineligible to file for permanent residence. That is generally true.
But it is wrong in many other situations. It’s a mistake that those who help immigrants - notarios, legal assistants, and even lawyers - often make.
By overlooking the legal validity of an immigrant’s common law relationship, past as well as present, they miss a golden opportunity to help clients win permanent residence (even in a state that does not recognize common law marriages).

Proving that a common law relationship is valid, in and of itself, is difficult, making the task of winning legal residency for non-spouse family members even more strenuous. Yet, it can be done.
In particular, step-parents, step-children, abused spouses and children, as well as naturalization applicants are among those most likely to benefit through such marriages.
Even if the immigrant spouse and other immigrant relatives live in a state where common law marriages are not recognized, they can possibly achieve permanent residence success.
But as discussed before, the government is likely to suspect a fraudulent application In these types of cases, so you must be sure that you strongly meet the four main requirements of a legitimate common law marriage.

My girlfriend and i have been living together in Canada for 6 years. In Canada we are considered commow-law partners. Her parents are in the states and have filed for an F2B petition for her which is approved now. She’s waiting to become current and get an interview. Does our relationship status in Canada impact her eligibility for F2B visa?
