As explained in Part 1, most immigrants think because they have never married their partner, they are ineligible to file for permanent residence. That is generally true.

Proving that a common law relationship is valid, in and of itself, is difficult, making the task of winning legal residency for non-spouse family members even more strenuous. Yet, it can be done.
In particular, step-parents, step-children, abused spouses and children, as well as naturalization applicants are among those most likely to benefit through such marriages.
Even if the immigrant spouse and other immigrant relatives live in a state where common law marriages are not recognized, they can possibly achieve permanent residence success.
But as discussed before, the government is likely to suspect a fraudulent application In these types of cases, so you must be sure that you strongly meet the four main requirements of a legitimate common law marriage.
