What’s worse is that there are absolutely people in prison throughout MA because of the corruption that multiple different agencies are known for. I had missed the live broadcast of one of the pre-trial hearings in this case. When I searched to watch the replay, among the results was a headline for Sean Ellis. Sean Ellis was wrongfully convicted of a crime (I’m drawing a blank on what specific crime) and spent 22 years in jail. He maintained his innocence the entire time and stood his ground that he was convicted due to corrupt law enforcement. In 2021 he finally proved what he had said all along. 2 Boston police officers have been convicted and are in prison and I believe the third was recently charged and is on the path to trial. I may have some of the specifics wrong, I haven’t been able to research it thoroughly, but the fact is he was wrongfully convicted due to 3 corrupt Boston police officers. Sadly, I’m sure there are a number of people in the same boat.

Lally said today that Katie McLaughlin claimed that Karen said "I hit him I hit him" AND that 2 other firefighters/paramedics (Nuttall and Flematti) said the same thing. What he failed to point out is that Katie testified that she (KATIE) TOLD the other 2 firefighters/paramedics IN THE AMBULANCE that she had heard Karen say this. Nuttall and Flematti may have thought they had heard it from KAREN but they actually heard it from KATIE. Nobody wrote this down so they have had to rely on memory, which often fails. And apparently, according to the Defense, we will hear from another witness in the days to come that Karen actually put it in the form of a question as in "DID I hit him? COULD I have hit him?"

I forgot about that! I remember the one guy doing compressions couldn't answer when he heard Karen say it. On the video, it doesn't seem as if he interacted with Karen. Katie said an Officer heard her say it too. What I don't understand is, in that situation wouldn't they have taken that as on scene confession and taken her in for questioning to get clarification? None of the officer's said they heard KR say she "hit him", Katie said KR said it to the other woman, could Jen have said "did you hit him" first causing KR to question that? There's a lot of particular semantics being used by these witnesses, none of them seem to be able to answer directly. It's very odd.

I have been so confused by Katie M being so adamant that Karen made this statement in the presence of an officer who we now know is Officer Saref AND Officer Saref “supposedly said, “ You did what? You hit him? I need to go get Sgt Goode.” BUT- BOTH Sgt Goode and Officer Saref both stated they didn’t hear this comment and neither took any action or talked to Karen about it. Why did the defense not mention this in front of the jury??

They don’t necessarily hold onto them indefinitely, but even if you disable the cloud, destroy all backups, factory reset and destroy your phone, it is still possible for investigators to get your phone logs. great question/topic.... but occupants/premises liability requires, like any negligence claim, the usual four components of: duty, breach, causation, damages. Simply having a dead body on your lawn does not fit this requirement. One would have to show the duty of care was breached, and address causation and then, of course, damages. Now, you make a good point, because if this case ends up in a guilty verdict, you are absolutely correct that civil lawyers will be looking at culpability. Great post :)

👨‍⚖️ ~ Suggestion: Peter, please talk about the way the lawyer can help you and the way lawyer HURTS the Justin system if you have the goal of finding the truth. For instance, cutting the witness have done prep through his own lawyer by getting the Question preparation from the prosecutor to the witnesses lawyer, and then from the lawyer to the witness? And if that happens, can’t the witness say they haven’t done preparation with the prosecutor at all? And you’re not allowed to ask them about anything that’s attorney-client privilege, right? Or even if you are allowed to ask if they’ve done prep with anybody including the lawyer but you just are not able to ask about any details, that’s still partly shields the jury for knowing the full truth. But would the defense lawyer even think about asking all those questions to the witness to figure out if it has been done through a personal attorney intermediate. And I also think about how attorneys clean up their clients for things like Family Court and how to answer questions during depositions and everything else. This is what you do so I think you’re biased. My view is There should be some way to have an attorney protect someone’s rights without showing them how to be better at fooling the judge and jury. Because plenty of lawyers are going to want to win and they’re going to do things and ethically. But let us say the lawyer is ethical, they’re still going to point out how when their client answers questions a certain way it’s gonna come off to the judge and jury. I’m not saying that could never be good, but it gets them to then rephrase their answer or change how they act (like in the case of Family Court) which is like putting on a mask and obscuring who they really are in real life. If a judge/jury needs to make the best decision based on who they actually are, the teaching them how to be someone else is not actually best to find out the real facts.

When all these people backed out of the driveway their headlights would have made a pass across the ENTIRE lawn as the car went from the an angle to straighten out in the road, slowly. Nobody saw in the bright lights a large body, excessive blood lost, a hat, shoe or 47 red pieces of taillights??

Ms Albert said that Brian Higgins arrived after she and her parents arrived. Brian Albert said he arrived first. She also said that her mother or father was showing Brian Higgins photos in the 'family room'. Her father said that he showed Brian Higgins the photos upstairs in his son's bedroom.

why is there no information about the neighbours? Did they talk to the neighbours? There is a dog with propensity to bark loudly, there are numerous vehicles coming and going, there are police there at unusual hours. Anyone got info on this? Did they just not hear anything?

The resident opposite is also a cop. His ring camera wasn’t working that night, which is remarkable.

A court order was to preserve his phone was left at the front desk of canton pd for Higgins. When he received it he called Detective proctor & was extremely angry. ( apparently this is in Proctor’s case notes) Proctor informed him that it wasn’t the State asking for it that it was the defense. Higgins got rid of the phone anyway.
