The plaintiffs say they have a mold remediation company, and the defendant refuses to pay for a storage pod they rented for him when his basement needed work. They’re suing for what they’re owed. The defendant claims he was told the storage fees were much less than the bill he got, so he refuses to be gouged.

bad verdict . the pod was left there in the plaintiff's names and they did nothing to mitigate the charges for those xtra couple of months . i have a feeling the plaintiffs have a deal with the pod supplier to do this to people and they split the profits for the xtra months they leave pods with people . they keep it in their name to get the full commission , i think they are scammers .

When she said about the Pod being in the driveway "and I gotta look at it everyday," I giggled. I know everyone has different perspectives and preferences, but to me, you don't have to look at it. And if you happen to, you can choose to not acknowledge it. I would never survive an HOA😂

Why would the cost for everything not be spelled out on a work order? It should have been broken down so the defendant knew exactly what he was paying. And if his garage was bigger than the pod, why bother with it at all? Enough blame to go around on this one!

Defendant reminded me of my uncle, uncle cheapskates! Always wanted something for nothing or if you bought something and he asked how much , he would balk at price and say I could of got it under wholesale or he has a friend ect ect. If I did ask for his help it turns out oh I don’t have time ,I’m sick , the sob is not calling me back. He always had an angle and blamed everyone else when it didn’t work out.He lived to 94 and never filed but one income tax form and ran under the radar since after WW2. How he got away with it I’ll never know.

The POD should be part of the quote. The old guy should NOT EVEN BE INVOLVED. Once the job was done, the POD gets removed. The old guy is billed by this guy in blue and that's it. END OF STORY.

I have done mold remediation. They are usually insurance claims and the price of the storage is built into the estimate for the insurance company. And as for Harvey and the folks on the street, an environmental firm tests for mold contamination after the job so it is clean and clear, far cleaner than it was before the mold job.

Unless you live in a flood zone, and there is no insurance involved. The homeowner eats the cost. In that industry for 25+ years.

Pods might have cost $100 when he was a kid, When I priced them it was $400 a month. The selling point was "you can relax and take all month to move" Screw that I busted buns and got moved in 2 weeks and saved $400

I just rented one and it was close to $1000. Moving from NJ to NY. But, still I'm still in shock over it. If I had a van, I'd move everything myself.

The judge said she lives where a man can not mow a lawn without a shirt? There is no location in the USA that would tell me I have to wear a shirt on my own property. That is about unconstitutional as it gets. Next they tell you that you can’t be wearing whitey tighties under you shorts to mow the lawn. And you can not wear sandals if you want. Crazy.

The defendant looks like a character actor who worked on Barney Miller for a few episodes as a petty larcenist. I think his name was Larry Hankin. He was really wonderful on that sitcom.

WOW .... I've been watching JMM on a couple of her court cases. She has been pretty ruff on both parties. I've wondered if she's having a personal life problem. Because we all have bad days. I still like her and I believe she's a great Judge. I've seen grouchy old people. Now I'm up in my 70's.....I'm old but not old enough to be grouchy yet. I hope I never get that way. LOL

The contractor should of sorted this after the first month If it wasn't transferred out of his name by emptying the pod and having it removed.Im sure he learnt his lesson.

The company guy and gal are lying and lazy. As a Notary, they could have hired a Single mobile Notary to have come to the location and done both notarizations at once and been done with it in 15 minutes. They never told the old guy it was $225/mo They were shady and obviously tried to mark-up the fee for the Pod....that's why the old man balked at all the changing prices. I thought JM was gonna do Rough Justice and come up with a fakr split of some sort....but making the old guy eat the whole thing seems very unfair. She even balked at the idea that the so-called professional company would wait 3 months and "did Everything' to resolve this matter that was in "their" name. No way would that guy have agreed to pay $225/mo for a stupid Pod The business may because they are getting 1,000's to do a job, it's a biz expense...but no rational homeowner would agree to pay $225/mo for an unnecessary Pod ( especially with an open garage and now finished basement) now one might drag their feet if it's only $100/mo I find it difficult to believe ZERO talk about monthly fees happened over the course of the ordeal, trying to get docs notarized to take over at $225/mo Something would have been discussed, from their side No Price Conversation "EVER' happened, ever.....really? Does that sound remotely possible? The defendant says he was told $100 The guy says he said nothing, the lady says they told him nothing.....that doesn't smell right

You get clearance on your containment by a third party industrial hygienist. So a lab clears it as mold free not the contractor.

@@keri1364 Hurricane Sandy was in October 2012. The defendant got approval for the work at the end of July 2015, according to testimony. He was not “just devastated” by the hurricane. It had been almost 3 years since Sandy.

What a silly ruling. If he knew what they were being charged he may have not wanted the pod at all. That’s why the entire concept of “meeting of the minds” exists. Which is how she has ruled many other times in cases like this. They should split the bill. And they didn’t mitigate their damages either. 🙄

I agree with you because they didn't have a contract with him for what would be charged. Also by the plaintiff's own admission they had settled on the 450. Even if the defendant didn't remember, they said that's what they agreed on. Why would they now get more?

One thing that I have found out about the court tv concept is in order to keep it as concise as possible often the judge has reviewed the signed statements and parts of the evidence before the filming starts. This often leaves viewers shocked at verdicts that don't make sense or that are at odds with many similar verdicts. Sometimes it would help if we got to know this stuff and it might not seem as unfairly biased.

How many times has the judge told a plaintiff that they have the burden of proof and that if they don't have the proof of what they're saying she can only award them what the defendant will admit to? I've seen it many times! The plaintiffs had absolutely nothing in writing about the cost of storage I think the Judge should have awarded them $100 a month which would equal $300.

I don't know where the judge lives but the no man mowing without a shirt should be a national law Nothing is more gross then seeing these men with beer bellies, man boobs, sweaty hair out walking around in yards, sitting on porches and lets not forget the shorts and skinny chicken legs. Women don't walk around like that and if we did we would be arrested but men can what's that all about? It is so offensive --- YUK.

I wish they would enforce the - Wear a shirt when mowing - rule around here. And I don't know why only privileged communities can enforce decency rules.

Apartment complexes have management companies that create rule. Condo and townhouse communities have HOAs that create rules. Why are you aching to be offended?

Milian doesn't listen! The defendant said it best after the case ended. But this case really indicates how important it is to have every minute detail written out and agree upon in a contract so theres no misunderstanding or confusion.

Wrong scolding, Milan: when the wife described the entire process of getting the pod notarized to the defendant, it should have gone to your head that "NO business does this." This type of legal activity, taking up time, is WHY businesses raise their prices- spending all this time for one customer when they could have been servicing other/more customers. No business that I know of would go to all this trouble to get something notarized for a customer.

Wow. I definitely don’t agree with her on this one. They couldn’t prove how much he owed because they didn’t have his signature on anything. And I believed the defendant about the $100/month.
