​@@theshadowbehindyou9631How do you mean? In Texas, we have many people that are undocumented or poorly documented. They have no problems getting aid. And, everything, including TWC (Texas Workers Compensation), is English and Spanish. I was born in Texas, and I am having trouble getting another job, after losing my last job, because I don't have a physical social security card. This is even after submitting a W2 form and other forms with my SS number on them. I was then asked for my birth certificate, which I submitted. This stilI wasn't good enough for Whataburger. I will be glad when I am done with school. I have worked with Hispanic people that were not legal immigrants, and they were able to get jobs. I don't like the way the judge treated her, though.

Hard job being a legal translator. He has quite a burden. Long winded responses are harder to work with. He’s a sweet man.

It is. Even if you know what you’re translating from the defendant will doom their case, you’re legally obliged to translate absolutely everything, even if the defendant changes their testimony mid-sentence.

@@mlgerab I've heard him many times, refer to her as his assistant. She could be a paralegal, but my best guess would be legal secretary. She likely doesn't pick up his laundry from the dry cleaners, or go grocery shopping for him, so she's not his "personal assistant".

Pretty sure that the Honorable Judge Rangel has spent enough on eyewear to pay for at least a semester of college for the child of the sales rep at her optometrist's retail shop... But I'd say it's money very well spent!😁

Nah… it’s super helpful. Interpreters work hard to divorce ego from the product, and any help is awesome. And when the judge speaks Spanish, you can trust that a lot of the minute details that can get lost in translation are caught.

I have been handling workers compensation cases for 22 years for the injured workers and employers in CA. Our main goal is to provide benefits to the injured employees. We also do investigate to ensure the employees were in fact injured at work, etc. CA has WORK COMP APPEALS BOARD. The Judges are all worker’s comp judges. The attorneys all specialize in workers comp for with the employees or the employees. In CA the system is overly employee friendly!! Even if we know they are exaggerating their injuries, etc. it’s better to settle than to go to Trial as the Judges don’t want to tell the employees they don’t get anything!! I’m surprised that all states don’t have their own courts and judges for workers compensation cases.

I worked for over 30 years for commercial property and casualty insurance companies, including some workers comp. This lady doesn't stand a chance without an attorney, especially if her case is borderline. It's sad, maybe not even fair, but it's just the way it is. I don't think Judge Rangel is necessarily being harsh; I feel she's trying convey a sense of urgency for the claimant to get an attorney if she really feels she has a legit WC claim. If she was wanting to play hardball, she could have just dismissed the case out of hand. #GiveYeseniaARaise... 😏🙌🏼

Thank tou for your comment. I was thinking this way, but I have no legal training, and strictly going by acquaintances have gone through in these courts. I know that I would not go it myself after what I have heard. You are dealing with a government identity in these cases that likes to have it's own way. Probably because of everything that has transpired in the history of workers comp.

Day 1 at the Sydney Uni law school is a big day in many ways as I know you'll understand. The difference between a Yarn & the Truth is explained with the gloves off in this way. The truth is settled by 3 things ..... Time, place & circumstance !!! Anything else is a yarn & of course just like me, Aussies love yarns both getting & receiving them. Poor old her I could get her hooked up with a law firm in the USA over the phone from here in Oz where I am now.

OMG! The workman's comp case sent me back to 8th grade Spanish where we had to write up a short speech about lawyers and then give the speech at a Hispanic lawyers luncheon. (Unfortunately for us my Spanish teacher's husband was a lawyer so....) Anyway, I started giving my speech and all the lawyers started smiling at me and my teacher left the room. I did not know why! After the other kids were done we went back to school. Only then did my teacher (with tears in her eyes) tell me that I got the word "abogado" (lawyer) wrong. I used the word lawyer in my speech 6-8 times only instead of saying "abogado" I said "albondigas" - I'll let Yesenia tell you what that means... Yes, that was the end of my Spanish classes. Thanks for the memory!

@@LawTalkWithMike I have worked for several companies that I had knowledge of the cases of workers comp filed. Because here in California the biggest workers insurance company is a state run organization the employees don't have much of a chance in any big payoffs. So they got tired of having to pay out so they divided it up so that the employees have to file separate claims for each injury, like arm, back, shoulder, etc. etc. So the employee now got smart and file separate claims for injury so they get more money. There are certain attorney's that only handle workers comp and they make deals like settlements with the insurance companies and just come out and tell the employee after the fact. Most employees don't know their rights so they give in to it all. I saw one guy who actually was severely hurt and he had been fighting for over 8 years to get a settlement.

Injured workers have to file within 30 days, I wonder if that's why the lawyers are telling her she can't file a case or claim.

I gotta say, Judge Rangel is kinda piling on. This poor lady isn't a stubborn and back talking defendant. She's trying to navigate a system that's nearly impossible for native English speakers to engage with. I know the judge can't offer legal advice from the bench, but explaining in clear language in a compassionate way wouldn't be out of order, I think.

It seems like it would be easy to find someone that does workers comp. Lexington here has billboards up everywhere of lawyers and one of out of every three TV commercials is about a lawyer. There is constantly ads running about lawyers that do workman's comp and there is billboards with law firms that handle workman's comp. Maybe it's just something special to the lawyers here in Kentucky do.

The Great and Honorable Judge Jeffrey Middleton will never be eclipsed in my heart, but I'm quite fond of Judge Rangel. Even though she's being kind of tough with this nice-lady-with-no-case, here. I'd invite them both to my barbecue. postscript: it would be nice if I was busy and important enough to need an assistant as seemingly sweet and kind as Yesenia.

Funny! A latina judge in far west Texas absolutely speaks Spanish. Probably her first language. Texas Workers Comp! I am, unfortunately, intimately acquainted with Texas Workers Comp. My ex was accident prone and we dealt with it in Odessa (mentioned by lady herself) and Dallas. Yeesh. There are 13 workers comp lawyers on a list for El Paso but if you don't know what you're doing and don't speak English, it must feel impossible.

In my area of Ohio, there is something called legal aid whom assist you and recommends attorney’s who fit your case law specifically. …no charge. I say give her additional time with threat case will be dismissed otherwise. Sheesh.

Love you, Yesenia! You deserve a raise! ❤️ It was kind of nice finding out my Spanish is still pretty sharp. Also, I love that the tie matches the microphone.👍 Really, she's been to five attorneys and nobody has successfully told her she doesn't have a case? Maybe she doesn't really understand that her case has little merit. I feel badly for her, because she's been hurt, but there are these situations in workman's comp and malpractice where the person who is injured thinks that because things didn't turn out well or the way they expected, there's a pot of gold at the end of the rainbow. A negative outcome does not equal a payday. The judge was her usual generous self, giving her a decent chance. Cudos to her!

From my workers comp knowledge is the problem is most people forget to use the Administration process must be followed in almost every state before a lawsuit is ripe.

Also , like to add that the time gating can be as little as 3 to 6 months, If you don't file the Administrative papers you can not win a lawsuit.

This one kind of pi$$ed me off. As someone who has been in a similar situation (child custody), it's not that easy for a working class person to just "get an attorney." Especially in this gal's case, where she was apparently injured or disabled while working. And we all know how hard workers comp & other disability services will fight to not pay out. I'd bet dollars to donuts she was given the run around & she just kept waiting for her claim to go through, not understanding that she had a limited amount of time to settle it. I also KNOW that a bias exists that makes it less likely for a person of color, particularly if there is a language barrier, to get a positive outcome in these situations. I just feel for her & didn't think Judge Rangel yelling at her was the least bit helpful

I have 2 lawyers in my weekly gaming sessions. With an introduction from both of them, to a lawyer who "cant turn down any case right now", it took WEEKS to even get a phone call back from the guy. Maybe in some places the concept of calling someone up and speaking to them on that phone call is a thing, but I havent yet called the business office of any law firm in south texas and not spoken to an automated recording service that promises to call me back as soon as they get around to it.

I do not know how workers comp in other states works, but in Ohio the Ohio Bureau becomes an automatic party to the case if filed outside our administrative court system and typically they would make some sort of settlement to not be bothered with the case.

That is a good attorney to say your case has no merit….instead of wasting time and money. The best advice I’ve received was from my pastor when I needed a lawyer for my ex and child support and he said hire a good attorney and let him do his job. So true.

My first wife's EEOC complaint was marginal, so her chance of winning was iffy. So the attorney said he couldn't take the case without a big fee up front.

Hi Mike & like so many of our gang I think Comrade Yesenia is sensational !!! I've had to interpret for Vietnamese people in Australia a lot & even in the USA the last time I was there. I'm OK but hardly a professional & I feel so sorry for the poor woman.

I am surprised to read that Judge Rangel had her law license suspended 8 times for failing to pay her law licensing dues on time. She does not look the type to forget much of anything let alone her law license dues. Kind of weird.

I was too. I was trying to find info about the phoenix project. The recovery program that she helped create or at least that’s what I’ve heard and I couldn’t find anything on that but saw her suspensions. One of the excuses was that El Paso used to pay while she a judge and then sometimes around 2011 they stopped. Then she said something about her staff being slow with the mail. I’m not aware if it is an issue for a judge to be making rulings in court in suspension.

work comp in Texas is definitely skewed to the companies. Most local lawyers will not take a WC case in Texas, even if they sound like they have merit.

There are all sorts of things we have to so that are difficult but I feel like everyone expects hand holding and for things to be done for them. If something is important to you then you have to be willing to do some work to get it done.

Also, they do not have to have an attorney. They have California workers compensation Information and Assistance Officers at the board to help injured workers file their cases, etc. They also have free seminars every week to reach injured employees what benefits are available. Most attorneys in CA will take a case as in CA they will receive some kind of compensation and the attorney obtains .15% of whatever they are able to get their client.

I'm not sure that the Judge can't pick up on the fact that she doesn't know that she can get attorneys via technology.

Your right on target Mike workers comp is a Nightmare Having worked for Osha and Yes Most Lawyers will Not take a Case on a contingency unless it is a big payday

I feel so bad for this lady! The judge has been on the other side of this for so long that she doesn't realize what clients go through trying to find help. Texas doesn't have any bad ass Mike's around! 😁

Seems to be a clash of cultures here similar to the one that had OJ Simpsons housekeeper explaining on the stand that she agreed with a LEOs statement during the investigation that didn't agree with her testimony in court because in her home country the proper response to a question from an authority figure was "whatever you say sir/ma'am", a combination of noblesse oblige & self preservation. Hence; "whatever you decide judge" , expecting an in loco parentis position from the judge. Cultural as well as linguistic interpretation required?

It seems that she doesn't have a good case. She'll never find a lawyer. It would be horrible to throw more money at this. Like opposing council said there's no lump sum bucket of money at the end of the rainbow. True, if someone just sat her down and explained the bottom line maybe she would stop spinning her wheels.

Have someone from the court write her a legal stamped letter. Copies of your documents of medical bills and a letter from her doctor. See if legal aid has one

one big impediment to these types of cases in texas , really restrictive limits on total possible compensation. makes it very easy for costs to exceed reward potential, thus noone will take a number of these cases

Hasn't she seen the Lerner and Rowe commercials? lol, sorry wrong state. All kidding aside, I have a feeling that someone, family or friend got in her ear and told her she deserves a bunch of money where those 5 Attorney's probably like you said told her she doesn't have a case but she wants to believe who got in her ear over the legal experts.

I am a little upset about her yelling at her. Why doesn't she suggest that she use the telephone to call attorneys. Every business in Atlanta (almost) has a Spanish speaker. And they are in El Paso for pete's sake. Plus the interpreter verified that she can use a telephone. I feel badly for the lady but I'm only halfway through the video so far. (Later) I also feel like Judge doesn't really know what to do with the case and she is taking it out on the poor woman. This case makes my heart hurt, as Yesenia said.

do they have to have workman's comp. in your state? my son-in-law had to sue his company because they didn't have it anymore, without telling the employee's. They paid his bill themselves till he had to have surgery then stopped. I don't understand why they weren't charged by the state with a crime, as it is required in michigan. He won but it took 3 years and he only got about 1/2 of what was owed .
