Chandler Halderson is having two of his convictions vacated after the judge in his case discovered a potential problem that could have forced him to grant a new trial or other possible relief.

If anyone is confused by this (the wording in this news report is not very clear), Chandler is still convicted of two counts for the murder of both his parents and two counts for the mutilation of each of their bodies. The two charges that were vacated were his two convictions for hiding the bodies. Since mutilation of a corpse is a higher charge than just hiding a corpse, if you do both, you're only supposed to be charged with the higher one (mutilation). The jury was only supposed to convict him of hiding the bodies if they found that there wasn't enough evidence to convict him of dismembering them, but enough to convict him of hiding their remains. Instead he was mistakenly convicted of both hiding and mutilating. So, the only thing that was thrown out was essentially two redundant convictions. He's still guilty of two counts of lying to police about a missing persons investigation, two counts of murder and two counts of mutilating a corpse.

The mutilation charges made the hiding charges redundant, or something like that. That's just how that works. The criminal justice system still has to do its admin correctly no matter how serious the crime. The lad's still guilty as hell and will never leave prison alive.

@@macysondheimdifficult to ask people to respect someone who behaved so disrespectfully, to say the least, to those who loved him. Obviously no murder is justifiable and most aren’t defensible, but this guy killed two loving people to avoid the discomfort and humiliation of admitting his own years’ long facade of a life. He preferred it to apologizing for taking financial advantage of everyone around him, and for betraying their trust continuously. Careful about sinking too much care into sociopaths. They’re good at eliciting pity from empathetic people. It’s a big tell.

Incorrect is incorrect x 2. OP is.correct. Sometimes, there's what called "merging" e.g. you are convicted of assault (harmful touch) and battery (threat of harmful touch) on appeal the convictions merge and the battery conviction is vacated. My guess is that the dismemberment counts were a fall back so they could at least get him on that and the 1st degree murder convictions encompass the acts of those counts and they are therefore vacated.

@@mattmcrae1458 You said it backwards “assault” is the threat of physical harm and “battery” is the offensive contact. However that’s under old _common law_ as modernly these days in most states it simply goes together or used interchangeably - in practice courts usually don’t differentiate the two. Also in the majority of states Chandler’s two lesser convictions would have stuck… they went highly technical under Wisconsin law here

Does any of this even matter? Once you're convicted of one murder in the first degree, who gives a crap what other charges you have - you should be in jail for life. So who cares if 2 convictions were vacated, that literally doesn't matter.
