Supreme Court Justice Antonin Scalia was found dead at a resort in West Texas. He was 79. Cenk Uygur, host of The Young Turks discusses what happens now. Yeah, I hate to rejoice in death, but I'm willing to make an exception for Scalia. His hypocrisy knew no bounds. He hated judicial activist judges, but made himself into the greatest activist judge of American history. One thing about President Obama, he's a lucky guy. A lot of luck is timing, and he's always had great timing. Maybe the best example was when he nailed Osama bin Laden, but I think this was another lucky break for the country. I think it's a no-lose situation. On one hand, if the neo-GOP stalls the nomination to the election, then it makes them look terrible and the Democratic Party wins even bigger. On the other hand, if Obama nominates any rational and qualified candidate who gets approved, then it has to flip the Supreme Court to a less radically extremist conservative position.

We should have a contest to pick the worst decision of this so-called Justice. He really hurt the country with decisions like Bush V Gore and Citizens United, but he might have some worst ones in there, too. Another interesting aspect of Scalia's legacy was his shadow second vote from Clarence Thomas. I would like to see a correlation study to see if any other justice has ever shadowed another one more closely. I even predict that Thomas will pick a new conservative to shadow. He does not even have the intellectual chops to pick different leaders to follow for different decisions.

Actually I think think Cenk just made a great point why the neo-GOP Senate might accept a highly centrist nominee. Putting this issue into the election could cost them dearly, and there's no way they could hope to stall four years after the election.

For those complaining about Cenk rejoicing in death; why present someone in a negative life while alive, when their perception can hurt them severely, but present that same person in a light less harsh when that person is no longer alive to face it? Why do Supreme Court Justices have life long tenure? It makes no sense. Doesn't that lead to a lot of very old people with very old-fashioned ideas gets to deside over your legal system? Why would you want that? It crazy to have to wait until somebody dies until you can get some new people and new ideas into the Supreme court.

+Åsa S That's the idea. The idea is justice moves very slowly in gradual steps with a lot of respect toward previous precedent. This is supposed to ensure that change there is gradual and reflects actual evolution of the public conscienceness rather than law ping-ponging between extremes every term as it sways with the political winds; surely you see the folly for example in a legal system where every 4-8 years or however long say gay marriage changes, for 4 years its constitutionally protected, then GOP president wins packs the court with conservatives, and for 4 years it ISNT protected again, etc etc.

The "electability" arguments against Bernie are gonna go into overdrive. The hypothetical polls where he does better against republicans need to be widely publicized. I hope Bernie's campaign puts out some ads emphasizing his electabilty. So many people still don't even know about him and they might just assume Hillary's got better odds, Bernie needs more coverage specially about those polls that show him do better vs the GOP.

+ig21100 I give no qualms about the way I feel for Scalia. He was a man who denied righst to people throughout his entire life, and not just gay and minorities. Climate change is the most serious issue facing the whole world and this guy voted yesterday against new actions that would greatly decrease the release of CO2 and methane into the air by regulating power plants. I felt a bit happy when he died. I don't think there should be a conservatives majority in the supreme court because that doesn't represent the views of Americans. progressives should be the majority and his death just had to happen for things to change

+Steve McNamara not when our money is used to kill people and endanger our citizens, not when our money is used to enforce a stupid war on drugs that has done nothing but imprison a high number of our population. The country was founded by political ideology and now is corrupted by special interest to the point where we call it lobbyist and special interest instead of actually labeling it what it is, corruption. We need to take power away from the ruling class and reduce/enact more checks and balances to avoid more corruption. People are jailed or worst of exposing wrong doings instead of being praised and rewarded. We have a shit system and it has been this way since the early 80s i think. When we had high taxes on the rich and had protections for the consumer, we had a thriving middle class and all that came down after the rise of these new cooperate republicans who revere Reagan. These people who would do anything to make it easier for a company to screw over the public is sick. The reason why we had the crash was because banks were allowed to gamble with peoples savings. They were not before the repeal of dodd frank and now we have another bubble brewing to explode unless we stop these people from just gambling for profit. They use to gamble in stocks and not give a dime to the very people they took the money from and after they lost it, it became this i don't know what happens game and the banks didn't go to jail or even suffer financially, only the employs at the bottom level felt the hit of the layoffs.

Steve McNamara Those who take on position of power and responsibility of that power that pass legislation that cause harm to its public on false pretense should be regarded as horrible human beings. I don't feel the same way as most of the people in the comment section but don't take this lot as a representative of the whole of america. Their anger and disrespect for this man to some degree is excusable but to do it in gross language is just a reflection of their character. I hope we can actually pass laws that protect the rights of the consumer. I dislike the idea that if we don't appease companies then they would go away. There is always someone there to fill the demand, make no mistake there will always be a company to sell you something without it being harmful to us. This notion that they have to sell bad products because it would cost more not to is not a valid excuse to poison or kill the public. We also need laws to punish companies who blatantly false advertise or lie about the effects of something.

Sometimes I think you Solipsistic liberals, your end game is just to kill conservatives, sometimes I get a clear glimpse into your mindset of solipsism and it's horrifically ugly How the hell can you unify the country with the most divisive president in a generation permanently jammed into the Supreme Court pontificating? Ginsburg and Sotomayor are too much, they are both too insane and you've used up your progressive quota on just those two. Replace the two of them with sane progressives and I'd have no problem with discussing a further moderate progressive. Jumping to replace the best conservative SC Justice hours after he died under suspicious circumstances, berating anyone for suggesting to settle the election first (hasn't been an election SC judge changeup in over 80 years - for a reason - it's a bad idea), and obviously threatening to replace him with a super progressive SC justice when you already have ginsburg, sotomayor, kagan, and john roberts who was supposed to be conservative but appears to be a liberal appointee on issues..

IMO this shouldn't change the dynamics of the election. Support for Bernie should still be dialed to 100. Let's not pretend Repubs will more willing to confirm a Clinton nominee. If anything Clinton would be more willing to nominate a Conservative to appease Repubs, and they will STILL try and block her. So, I say, go for the gusto - support a REAL progressive candidate who will appoint a REAL progressive justice to the court!! #Bernie2016

+dahalofreeek Yes they should be, but more often then not "liberal" Supreme Court Justices do vote impartially while "conservative" judges like Scalia regularly vote according to their personal bias rather then impartial in accordance with the constitution.

President Obama promises to do HIS job in making an appointment for a vacancy on SCOTUS. Every president is elected to a full four year term, and there's nothing in the Constitution that says his responsibilities decline or disappear in the last year. The Senate, likewise, should do THEIR job as outlined in the Constitution to ADVISE and consent. The Senate Judiciary Committee should provide a list of competent nominees with input from all members, regardless of political persuasion. That's how they are supposed to 'advise'. The president then selects the final nominee, and the Senate then consents, or does not. What McConnell and a number of the Republicans are suggesting is a dictatorship by committee.
