These cases from the 18th and 19th centuries are so interesting-an intriguing insight into worlds and cultures long gone. As for Laurence Shirley, he wasn't mad; just a spoiled, entitled bastard. His behavior is very familiar to anyone who has ever worked for one of those small business with no HR department, where the owner has free reign to be tyrannical, bellicose, demanding and petulant. Even today, such entrepreneurs are only "nice" when the world beats them down hard and gives them no alternative.

What is most important to remember is that only in Great Britain would an aristocrat suffer death for the killing of a Commoner. Such a thing was unheard of in Europe in that period. Incidentally , Ferrers married into a branch of the Cholmondeley family but it is pronounced 'Chumley'.

Important tenant of English common law - that no one is above the law not even the king. Without this principle it all falls apart. It doesn’t always work the way it should, we all know about members of the elite who seem to slime their way out of accountability, but am glad it did in this case. You just cannot have the aristocracy killing people and getting away with it after all!

I hate the fact that they can get released early from an asylum. Sometimes you hear about mad killers who were let out after a couple of years. If a Dr decides you are no longer insane then you are free to go..(with the promise that you'll stay on your medication)
@jamesl9371
@jamesl9371 Жыл бұрын
@@thelogicaldanger the problem is that they sometimes get out or are allowed to be out to go to work or something and people interacting with them don’t even know they are dealing with a murderer. I think if you commit murder then you should never be free. The person that was murdered doesn’t get parole or freedom again. And sometimes they go and commit murder again or other crimes. The rights of innocent people are much more important than the rights of criminals

Can you imagine being a member of a mere 160 families who are singled out of 5 million people? And you were born into that minority status, you didn't choose it? With stoic realism rather than pity, hardly any of those suckers were sane. My paternal ancestors were high noblefolk in a European nation which I won't specify, and I too am crazy. I'm crazy because I'm a ghetto bitch, not because my forefathers were aristocrats. However my folks still managed to perpetuate the tradition of profound insanity in our family. And they climbed every mountain and forged every stream to do so.

That is of great interest to me as I now live in an area in the British Midlands.There is a little castle there which dates back to the Middle Ages but which was once the property of the Ferrers family.And if I recall correctly,one of the family bankrupted himself,improving & modernising it.Its a lovely little castle which has stood defiantly thru the reign of King John & that so n so Oliver Cromwell,even though both wanted it demolished.It & the (17 Moat House are both jewels in the town.Unfortunatly,more modern persons in authority have torn down many of the beautiful old buildings & put up some utter monstrosities.In fact,one person actually declared in print that he would pull down every old building in what was a charming little market town,had he got his way.Well,he certainly did a lot of damage,curse him.We had an archaeological dig some years ago.The older,local people still hate his guts & said he & his wretched council were responsible for tearing the heart of the town & making it an overspill of a nearby city.Its a darned shame.I have seen the old photos,it was a little pearl.And unfortunately councils don't seem so learn their lessons.Its just unbelievable!

I'd like to think that her 2nd marriage was successful. I mean, the poor lady died in a fire and it's suspected that it was a case of suicide. Apparently she had some issues with her mental health due to her age - might have been Alzheimer's, Dementia.... Either way, let's hope she rests in peace.

Fascinating and very sad case. The poor man did not want the job but was made to take it. He should have had protection every time he had to visit the earl. Just a brief note: cholmondely is usually pronounced chumly as far as I am aware. English is a weird language eh?!

This may be of a minority opinion but I feel just because one is proven insane they should stand trial just the same and the punishment should be just as it is with a sane person. It's not fair for the victim who had their life taken not to receive proper justice and that should take precedence over the killer sane or not.

What a strange story of legalities from way back when. How can he be crazy and still be allowed to defend himself? But he killed someone only out of arrogance. Very strange story, but still very good. You know how to find them...Hope Brief Cat is doing well.😺😺

By today's standards, "insanity" is specifically psychosis, or the inability to tell reality from delusions/hallucinations. Psychosis is not permanent. It is episodic. A person with bipolar II can have a severe manic episode that leads to psychosis, but will no longer be in psychosis when the manic episode is over. A person who was temporarily insane could defend themselves in court if the psychosis was over.

I just wanted to clarify as a mentally ill person. I have PTSD and neurodevelopmental disabilities (ADHD, autism) but can still be very articulate on subjects I am knowledgeable about.
@faithlesshound5621

@@janeeyre1990 The term "insanity" is used in England and Wales only as a legal defence in cases of murder, and since 1843 has been defined by the M'Naughten Rules. Otherwise we used to speak of "lunacy" as grounds for detaining people in hospital, but that was changed to "mental illness" in 1930 and then to "mental disorder" in 2008.

I understand the need to consider if one is mentally ill. However and especially since it is used so frequently today, I wish the USA would go to a guilty but insane verdict instead of not guilty by reason of insanity. This seems to me to be a more just while compassionate ruling.

Poor Mr. Johnson was placed in an difficult, no-win situation, in which the outcome was predictable. The Court in its wisdom, should have given this onerous legal obligation either to one of the Earl's Peers or an Official of the Court, to make it less likely for him to react by having a temper tantrum and take his anger out on someone who had lower social rank, which he was used to doing. Also would have be wise to take additional people with him for protection, given the Earl's unpredictable, but calculating behaviors.
