My son visited Iceland a few years back and gave me a novel about this case as a present on his return. It's called 'Burial Rites' by Hannah Kent. Highly recommended.

I find it hypocritical that Agnes was judged for having an intimate relationship with the victim while he, himself, and his married lover were spared that same judgement. Poor Agnes never stood a chance.

That's the way things were, at least up until the World Wars... Sexual equality in relationships didn't really start to become a thing until the 1960s and The Pill.

I guess my point was more about the inequality between affluent people and the poor. That man's well to do married lover had two of his children yet was not judged.

There is not even a proof that she, or the other two, were guilty. What about his married lover or her husband? They might have the same or even more motive.

It was interesting that this case was recently re-tried and that Agnes (posthumously) was spared the death penalty, but I'm not convinced that the accused trio had anything to do with the murders. The original prosecution built a death penalty case based on rumors and hearsay -- but no actual proof or evidence. They speculated that Agnes and the maid may have participated in the murders out of jealousy. Yet, there was no proof or evidence of that having been the case. They contended that the young man took part in the murders because he liked the maid and was jealous of her involvement with Natan, but, once again, they had no proof of this. Which means the three were punished or beheaded based solely on conjecture.

Well said...I am no legal analyst, but something just wasn't ringing true and I found myself thinking how unjust this is, how could they have even tried them? A provocative tale, thank you BC- as always, you make Mondays merciful.

To those presumptuous commenters who think they know more about the truth of this case after watching a 15 min video than an entire panel of 21st C. Icelandic jurists: That the narrator did not provide evidentiary details of the trial does NOT mean there was no evidence or that the accused were innocent. In fact, the modern reenactment of the trial DID find Agnes GUILTY, though her sentence was far less severe. BTW, modern Icelandic courts are just as competent (if not more) than those herein the U.S. -- any hearsay would have been excluded.

I got a bit excited already when I saw the Icelandic surname, nice that it actually was an Icelandic case. I'm wondering how come Skald-Rosa's husband wasn't suspected for having anything to do with the murder of her lover, especially if it was suspected/known that Nathan had fathered 2 of Skald-Rosa's children. Interesting to hear both about how the disappeared heads was found, and that they in modern days did a sort of retrial.

This was a thrilling case!! Iceland seems like such a mystical place to live so I was totally enraptured as I learned so much about its past. That's an issue I have with a lot of early cases. While there are some where there is good, clear evidence that the person who was found guilty actually did it, a lot of cases, like this one, are circumstantial - and it almost seems as if it was a case of, "Oh, well, we're fairly sure one of them did it, so if we punish all of them, we're sure to get it right."
@PogueMahone1

Good morning This case really bothered me in my gut something tells me that she was not guilty even though they did a mock trial and they would’ve given her 14 years. I feel that the three of them were found guilty because of their social circumstance. that’s how people were looking at her and her two co-defendants. They were not going to get a fair trial, especially after that poem was put in the paper and that makes it even worse and that’s just my personal opinion. It just seems like anyone that didn’t have money would never have a fair chance at anything that they were accused of. That’s just my personal opinion. Thank you for another great story, and from Iceland 🇮🇸 I hope you have a wonderful week. Looking forward to next Monday. Bless 🙏🏽🎄☃️🎁

Unfortunately, there's a lot of cases prior to the rise of forensic science where a lot of people were found guilty of crimes just by circumstantial evidence. I can name a lot of cases dating as far back as the medieval ages where people were condemned (usually to death) without any evidence at all.

Nattan was a player and some women don't like that. However, I'm not convinced of the guilt of Agnes and the other two accused. There seemed to be a lack of evidence and much reliance on rumours. If his affairs of the heart were the reason for his murder, then it was especially devilish that whoever killed him had no qualms about murdering a second victim, innocent in all that. We'll never know but it was fascinating. Thank you Brief Case for another Monday morning murder mystery.

A most interesting and sad case of peasants killing landowners. I feel they were punished more for that reason than the actual murders. In any case, I'm glad some form of true justice was given to them 200 yrs later. It's too bad there weren't opportunities to get out of that small village and go live somewhere else. I am curious though about what happened to her father and the 3rd victim/criminal sent to Denmark for prison. I like the fact that you covered a case from a place I never thought about much and had no idea there were settlements in that area during that time period. Thanks BC. Happy Holidays to you.

I go to Iceland about once a week. They have excellent bargains on frrozen foods 😂 (anyone from the UK will get the joke about the frozen food grocery store chain)😅

Really appreciate that you cover the less well known cases. I stopped following other “true crimers” as they all seem to cover the same cases and it gets boring after awhile. Can always expect a new and unusual case from you - many thanks!

What would have been really interesting in the retrial, is if they used the original legal rules properly applied with that evidence would death have still been the verdict.

Same country, but in Brisbane where it's just gone 22:30 Excellent episode, curious though. Is the portrait of Agnes from records kept or a dream you had? Or? For 33yrs old and having lived a hard working life, she looks stunning.
