One thing that stood out to me repeatedly is that to my understanding, both jingo and komado don't seem to have a proper grasp of their own license. Jingo wrote that they want attribution, but their license has a big image saying "not necessary but preferred". komado says plushies and ingame skins are prohibited, but their license says "contact us" and "monetizing all forms of derivative works (not directly made with the 3d model file) is permitted". It feels like the license was generated from a booth template, and like the template wasn't reviewed by a copyright lawyer because it's poorly made. For example, the very first definition and the main subject of the license (arguably the most critical part of the whole thing): 『 the Digital Content - Any digital data and its part(s) as described in the Digital Content to be licensed under the terms for particular cases. 』. This is a meaningless circular definition. This phrase appears many times throughout the document, and from it we can infer that it means the 3d model file specifically. This is very important, as the merch clause only says "Use in tangible goods", without qualifying the subject, whereas pretty much every other clause explicitly states "the Digital Content" as its subject. Hence we can reasonably infer that the merch clause also only pertains to merch crafted from direct use of the 3d model, by posing it and rendering it as a printed image, or 3d-printing it as a figurine (or possibly a physical dvd containing images or mmd videos made with the model). All the stuff relevant to filian is covered by another, 'derivative work' clause, which permits 'money-making' from 'secondary works', in this case artworks, acrylics, figurines and plushies made by other artists from scratch by using the model as artistic reference. From this interpretation of the terms, there would be no reason to contact the artist for additional permission or to negotiate revenue sharing. I was hoping Legal Mindset would do an adversarial reading of the licensing contract, to see if he also came to these conclusions. However he only did a surface-level commentary on the infographic, possibly because the situation was already de-escalating and there was no need to go deeper. I considered the hypotheticals in case the artist, once contacted, would try to extort filian with large merch fees by holding her existing investment into the model as hostage. We now know that the artist's intent was only to ensure proper attribution so that different customers are prevented from attacking each other.

Riot Games sued Moonton for copying their MOBA characters for not being different enough. Rima, ANY correspondence talking about your model is officially part of your contract. When you commission artists, their artwork becomes completely yours (unless explicitly stated). I studied in trade school for contract law.

If you pause to analyze it, you can see that she combined Keanu Reeves' E3 2019 moment on stage with George Floyd's 2020 brutal murder by asphyxiation into a classic double entendre. The latter part required a person in a specific circumstance that the audience would recognize by name. Floyd's case fits there shockingly well, and in fact I cannot think of another good reference to use here (best I got was Saddam Hussein's hanging in 2006, but it's not as fitting). In fact, I was able to find at least 2 meme images making this exact joke in late 2020, so she wasn't even the first one to come up with this association. In summary, that aspect of the joke was about the specific way he died, and not what his skin color was (this detail was a key part of the murder, but is irrelevant to the joke itself). Hence labeling the joke as 'racist' is straight up wrong and illogical. A more accurate label would be something like 'disrespecting the dead victim of a crime', or more generally, 'disrespecting the dead', which extends to jokes about victims of 9/11, school shootings, war and ethnic conflict, and even the old ww2 stuff like nazis, death camps and nuking japan. The discourse around those is realy old and peoples' sensitivity to them comes and goes. And 'disrespecting the dead' is currently not a good buzzword for engagement baiting on today's social media. So based on the above, all those tweets about racism are outright slander and without merit. The people posting them are a mix of virtue signaling npcs parroting things they heard, and antis desperately trying to find something negative to use (and they're using it wrong). Not only that, but labeling anything and everything as racist gradually makes term meaningless in public discourse. So ironically, the people posting those tweets are collectively causing harm to those affected by actual racism.
