So you want me to work an extra half an hour each day? 5 working days a week and 52 weeks a year, that's an extra 130 hours of billable time. Revise my contract to reflect the additional billable hours and I'll absolutely work that time, because I'm not giving 130 hours of my life for free.

This is why I love Australian labor laws. It is now illegal for employers to contact employees during non working times. Part of Australia's work life balance policy by the current Federal Administration. 🎉

Administrations come and go and so do labor laws. One must be prepared to stand up for one's self otherwise there will be a trampling of the worker.

In the states, if you are contacted by your employer in your off time and you have a regularly recurring schedule (read: predictable), then your employer must compensate you for that time. If your employer offers paid drive time to/from work as well then often times that time frame is extended to the time you accepted the phone call from said boss. Does *not* apply if you call them, though, since that would be dictating your own schedule. People would be calling their boss to chit-chat on the way home and then expect to be paid for it 😂

BTW, I don’t believe we’re a socialist country, but what are your objections to socialism? The thought that you might help out a fellow citizen? That works both ways you realise - you’d get support when you needed it too, as we all do from time to time.

If you never take your lunch break, not only are you losing pay (by working unpaid hours), you're also bringing yourself closer to burnout. Taking breaks INCREASES productivity. It's in both your and your workplace's best interests for you to take your scheduled breaks! And besides all that, IT'S THE LAW.

My dad worked with a man who was somewhat meticulous and liked to get in maybe 30 min early to work and stay a bit late to finish stuff. He kept a record of his time because he was like that. The company did not in any way ask or pressure him to do any extra time, and he never requested compensation. During an audit, it was discovered that he was doing this, and the company was forced to pay him for every extra hour going back several years. Compensable hours are defined in labor law. The company does not get to decide.

I actually agree with the company on this one. Unless the employee is given an unreasonable workload, or the company agreed to pay them extra, but didn’t, I actually don’t see any foul play by the company. I, of course, don’t have the full story of this case, but we must be careful what we wish for. By far, the biggest generation of wealth for a country is business, especially small business. Conditions must be favourable to start, maintain and expand a business. If the economy comprises of big government and big business, then that is not a very nice place.

On a similar note, here in the USA during the 2008 “economic recession” the talking point from management where I work was that payroll is the largest controllable expense. This “major retailer” used that as justification for reducing shift schedules to almost skeleton crew levels. As I recall, many folks decided to find other employment. Moral of the story is treat your employees better and avoid costly labor turnover.

@@figmo397 If you quit due to "hostile workplace", harassment, etc., but you have to explain it to the unemployment hearing judge. I did and got my unemployment benies.

That is also NOT entirely true. If you can prove they are breaking rules or harassing you, even if you quit you will be able to claim unemployment (at least in the US) provided you have proof. It's why the "document everything" mantra is becoming widespread these days.

lmao yeah that's how you get a class action lawsuit for unpaid overtime XD I just got my compensation from just that exact thing because they expected us to have our desktop ready to take calls before we were allowed to clock in. (Clocking in would immediately put you in "call ready" mode)

My job requires this. They have emailed us to be up and ready 10 minutes prior to 8am clock in. I refused. I am not getting paid for that and yes, prep time is working!

yeah the line starts at 8, the company pays is a starting at 8 so we get paid at 8. they do pay the electricity bill from when the office opens at 7:30. but they don't pay us.

@@leporid257 As a highly skilled accountant and banking compliance expert (I was an accounting and taxation professor) my situation may be a bit different but it was in my contract that I was to be paid at (in the early 2000's) $90 an hour for my first 30 hours, hours worked between 31 and 35 in a week were paid at double time and anything over 35 was to be paid at triple time. I only reached triple time once in four years. I also had six weeks vacation written into my contract. I know that Loe is a Canadian and I don't know the law up there today (I did live in Canada in the 1970's), however, if your contract includes a clause like my contract did I think it would hold up in court. Considering the gravity of the situation it would be in your best interest to consult with an appropriate attorney dealing in Canadian employment matters before depending on such a clause, though.

In my life, I was very fortunate to have excellent managers. If we had to work over, many times they bought lunch for us. There were times when we were behind, the manager worked with us, sometimes in the back cleaning things & never said a word about it. We were all willing to give more because of this. However, I left a job after 13 years, because of one manager. Workmates & customers were very upset about it. Things change, you need to have the strength to change too ~

It's so funny, I kinda have the opposite experience of this. I was an apprentice at a shipyard and the hourly worker's time was strictly regulated by the whistle. We had 6 whistles throughout the day: a 10 minute warning whistle before each shift, the start of day whistle, lunch whistle, 10 min warning to get back to work (effectively making it only 20 minutes for lunch instead of 30), and then the end of shift whistle. I had dreams about that damned thing and hated it with a passion. Then I was promoted to an office job and we had a two week training period where we learned how to be office workers. The relationship with that damned whistle was like walking out of darkness into daylight. The instructor told us to relax. If we were a little late coming in during the morning, or coming back from lunch, no big deal - just flex the time. We had time to get coffee and shoot the shit after the first whistle - no one cared if the computer was on yet or not. As long as you got the work done, they were happy. I never thought it would be true, but 27 years later I'm still at that damned job. 🤣 Don't get me wrong, work has plenty of bosses like those in these videos, but I've been blessed to work with truly great people and I'm thankful every day.

The interesting thing is they thing they can replace you quickly. It takes, on average, 90 days to replace skilled labor. That doesn't include train up time which can be up to six months.

Years ago, I had a supervisor who wanted me to clock in 10 minutes early every day. I asked if I could punch out 10 minutes early every day. He said no, so I said I'd be punching like I normally did every day. He wasn't my biggest fan.

I would have asked if I would be paid double time for the extra 50 minutes each week. I get that my skill set is unique but I charged double time for the first five hours over my contracted work time in a calendar week and triple time for any extra time worked over five hours in a calendar week. Saturdays and Sundays were triple time regardless of what I worked during the week. I had some double time hours but only reached triple time once in four years of consulting.

There's not a lot to love about nursing but the hours is one of the good ones. They track your hours meticulously because of healthcare labor laws in the US. You get paid for even 5 minutes of overtime. And if your company gets caught trying to screw with your hours you can get the whole facility shut down immediately.

I have never seen an employer, ever, get upset that their employee wants to take a full lunch break. That's a huge red flag, if that is really happening. Now, I've said to others that I often skip lunch or take a working lunch, but that's more in response to things like "I don't want to take up too much of your time" or "sorry to call you around lunch time" etc - never, ever an expectation that they should be doing the same. On the other hand - If I ask my employees to start at 7:30 instead of 8, as a condition of their job role, then yes their time does now end at 4:30... BUT mandatory OT is a thing. If I have a meeting that is mandatory for all employees to attend, then I expect them (with ample notice) to make themselves available for the meeting - and yes, compensated via OT pay, or let them know in advance which day I can let them out a half hour earlier to make up for their time. Work isn't always pretty, but sometimes schedules need to be flexible and so do people. If you work for a company that is respectful of your time otherwise and simply needs to fill a business need with a schedule change, and has given you ample notice, that seems like a reasonable request. If you work for a company that drops last minute changes on you - or in this case insinuates that you need to work unpaid during lunch or before shift, then run. Or don't - document it - and then submit a claim, along with the testimonies of your fellow coworkers 😁

Years ago I worked for a man who worked all hours and expected us to do the same. Because I was new, people were taking me out to lunch, which was lovely. The boss said, "Lunch is for wimps." His secretary took ten minutes for lunch. She read the newspaper and ate a packet of wine gums. The Thursday was my wedding anniversary and I had to ask his permission to leave on time. How long did I last in the job? A whole week!

I have. Managers pulled me into a meeting. I was confused what this was about. They were trying to be all friendly, just enquiring, etc. They asked why I took my full lunch break every day while others didn't. I was so shocked. I just about managed to pull myself together to chew them out, that I was contractually entitled to the time, and I didn't have to explain my use of it to anyone, and if they pulled me up on it again I would be seeking legal advice. What astonished me so much was that they were generally good bosses, as you seem to get with giant companies with proper HR teams and an acute knowledge of how legally fucked they could be if they pulled this kind of stuff. My guess is that some braincells went wandering that day.

Everywhere I worked had had optional 15 mins paid lunch or 30 min unpaid (and the managers never care which one you pick) and me and everyone else takes 15 mins paid every damn time because fuck sitting around at work without being paid. If she works from home sure, I’d take the lunch break but if I’m in the building I’m getting paid

@@blackroserevolution3989 that sounds terrible. If that's documented anywhere or you can get enough people to sign a statement about it, then it might be worth pursuing legal action, you might get a decent settlement. Check with your local labor laws first though.

I would not leave my leftovers rotting away at room temperature on my desk all afternoon -- THAT is rude and actually dangerous.

In 1992 my professor instructed us that because the competition for jobs was so intense, we should put on our resumes that we would be available to our employers 24/7. That became the norm almost immediately. Instead of giving us negotiating skills to our advantage as to our worker rights, this p.o.s. helped with the dissolution of 120 years of labor reform. I am glad to see some push back here, but what has been lost, labor unions and federal protections will never be recovered.🏴‍☠

You know what I raised my 5 kids with in the 70's to 90's? You know the rule that I lived and worked by from 1968 to now? "YOU can make ANY choices YOU want in life, but then YOU live with the consequences!" YOU chose to be a doormat, like the one on here, rather than search for alternatives, to stand up for yourself, to firmly BE worthy. My first introduction to your kind was after a mandatory meeting on my day off in 1975 when I said to a group that I had to clock out when asked where I was going. EVERYONE said I (they) would be fired; that it meant we had to attend, not that we would be paid for it. No one clocked in for a couple of more years until the nurses looked into unionization. They were laughed out of the meeting when asking if the union would seek the hospital to pay for those meetings! "It is the LAW for mandatory anything to be paid. It has been for years. 🙄😆😅😂🤣 🙄😆😅😂🤣 ("On Saturday, June 25, 1938, to avoid pocket vetoes 9 days after Congress had adjourned, President Franklin D. Roosevelt signed 121 bills. Among these bills was a landmark law in the Nation's social and economic development -- Fair Labor Standards Act of 1938 (FLSA).") I hope you have learned to KNOW the law and make yourself worth keeping. 💞

I don't know which union represents you but the United Auto Workers labor union allotted for a reasonable number of shop stewards to deal with this riff raff in shops where they represented employees. I would complain to one if your union has them and they ask again.

I've worked for a few health insurance companies in their IT departments, what I can tell you is that all of their low level frontline workers have to start 10-15 minutes early and are not paid for that time, how they get away with this and have done so for at least the last 10 years, I have no idea. I'm pretty sure this was always illegal they just somehow are able to violate it with ease.

I came to the comments to say that. I was an IT contractor from 2005-2022. We always had to have our machines up and all our apps open by the time our start time was, because that's when we were expected to start taking calls.

My father was a computer programmer throughout the '60s and '70s and into the '80s. He used to tell me the computer salespeople made more than the mainframe programmers like him and that programmers needed a union. There were aerospace companies that expected their techies to work some weekend hours and late other days. They got away with it, and many IT companies still do, by paying their techies--even at lower-level positions--as _salaried_ employees, rather than hourly. You make more, but you're working 50-60 hrs a week. When you calculate your actual hourly rate, you're making what the temps get. BTDT. Moral of the story: Stick to hourly "wage" jobs and make overtime if you work more or work for the govt or a strong union shop.

@@andreacook7431 At credit unions we had a similar situation, tills had to be counted and the counter set up for business before we opened each day. After close tills had to be balanced and counted. We paid employees for the time (about an hour a day).

A better way to handle it would be to record the conversation, then make sure HR is okay with the added overtime. The Manager doesn't seem very versed in Federal Law, but I am betting HR is very well versed and isn't going to want to incur any difficulties of finding themselves on the hook for penalties for having employees work off the clock.

Man, I really dodged a bullet with my job. I work for the State of Arizona, the DOT in the IT department, and when you're off work - you're off work. They are very much about a normal and reasonable work/life balance. And no one monitors when I log into my machine working remotely.

Yep. Worked call center and it was demanded. Along with you had to be on the phone no less than 92% of your scheduled time. Side note that included your bathroom breaks so you couldnt pee everyday. Had to have a doc note to legally protect yourself. Also, when you logged out and someone was in your seat when you came back you needed to look for another seat. Again on your time. Hated it.

I had an employer who tried to do this. He wanted everyone there 15 min early because some people were regularly late but didn’t want us to clock in until our start time. I knew it wasn’t legal and waited a couple of days for him to figure it out. He did.

At my last job, a call center for a cellphone company. Company policy was to be ready to take calls our shift started. No paid time to boot-up and login to multiple systems. This would take 15 minutes for each shift. For our breaks started when we logged out. The breaks were shorter due to the time it took us to do our login and log out. The initial login took longer. The end of our 10 hour shift 4/10's the ended when we logged out of the automated system. Inbound calls. We didn't get paid to close out the day. They lost a class-action suit against them. Only for the first 15 minutes.

I had an internship in a company that had similar method of control over their employees (or should I say trainee as we composed 85% or maybe more of the company). And they asked me the same things. While this experience was beneficial because now I know more easily how to detect red flag at work, I would have liked to see your video when it happened to me to know what I could’ve responded to protect myself

a lot of "overlings" who have no real authority like to treat the "underlings" like this. their power is in the fear they hope to instill in you. that's why you keep records and call them out on their bull shots as soon as they excrete them.

One of those ways in which things start off bad and get worse- I was used to salaried professionals being expected to put in the little extra, and have done for many years, but after a while employers start to take advantage. I hope to avoid becoming either or a serf or one of those barrack room lawyer types but it's a fine line to tread.

Many years ago, I had a job like that. The boss expected you to be on the floor 15 minutes early, and she always had something "that just has to be done _now_. But of course that was unpaid. And she'd chew on you for coming back literally 1 minute late, because "The company shouldn't have to pay you when you're not working!" So I started answering back with "Well you expect me to work without pay for 15 minutes every day. If the company doesn't want to pay me for when I'm not working, that's fine, but then you can't expect me to work for free." She started giving me the line about, "Well, that's how I know you're here." The store had a bench outside the store opening, and I started sitting out there until it was time to start my work. She could see me, so she knew I was there. Now, I'm working at a job that does just the opposite-if I work two minutes past my scheduled off time (usually because I'm wrapping up with a client) my boss expects me to actually log out when I'm done with the client.

We had to be ready to hit the floor at 2pm (start of my paid time), not show up then go get our radio & put on our vest. We had people show up for their 6pm shift at 6pm then slowly wander back down to security for their radio then back up to the staff room where they got themselves ready to go on the floor. Unfortunately the person was usually scheduled to be at a program that started at 6pm she wasn’t up there until 6:15 then have to find her place to sit like a lump on a log for 5hrs. and not interact with the clientele (she didn’t like them). Yes, we should’ve been paid for the 10mins prior to shift time but there were bigger fish to fry. At Sears they paid us until 9:10pm so we left the floor & were being paid for the time handing over the cash drawer.

I got to the office around 08:00 every day, and yet, my computer isn't turned on until the clock hits my official start time of 08:45. Those minutes before I get to work are spent on a pre-work nap. During this time, I do not check my emails, I do not answer any calls, nada. The CPU is booted up at 08:45 on the dot.

Working unpaid overtime devalues your time. If I’m really unproductive in the morning, I’ll shorten my lunch, but I generally do 8-12 and 1-5, unless I just need to wrap something up and go a little bit past 5

I use to go into the drivers restroom and have a catch up with other drivers. And the transport clerk called me over to the window and went to give me my paperwork for the day, I asked him if he was clocking me in at this time, said no. So I told him that I’ll be back to collect the paperwork when I was due to clock in. He wasn’t too happy with it

We get paid an extra 10 minutes a day to prepare, which is fine with me. There was once a discussion that you should be there before these 10 minutes because you should be ready by then. The conversation ended very quickly because that's what the 10 minutes are for and I don't get paid for more. Are you there 30 minutes before work start to smoke one? Good for you, I don't need it, thanks

This is why I like working in an Office and not at home. When my 8 hours are over, I leave. I dont check email on my phone, because they dont pay for my phone, so no emails are on my phone. I check emails the next day.

Many places have an option for "8 and gone" which means work a flat 8 hours and go for the day, or a choice to take a 30 minute lunch in the middle.
